About this file
This addendum modifies RFP No. 304T-26-445A1 issued by the Texas Comptroller of Public Accounts Statewide Procurement Division for master tool sets and individual tools to be used by the Texas Department of Transportation and other state agencies and institutions of higher education through the Texas SmartBuy cooperative purchasing system. The addendum addresses three substantive revisions to Part A of the original solicitation: the distribution and on-site repair requirement has been revised from a mandatory 24-hour timeframe to "a commercially reasonable amount of time"; the warranty period requirement has been reduced from ten years to one year (or the manufacturer's standard warranty, whichever is longer); and the documentation requirement for respondent qualifications has been changed from listing a "dealer network" to listing a "sales and service network" across Texas. The addendum also provides answers to six questions posed by potential respondents, clarifying that vendors may submit an entire product category on the pricing sheet, that minimum discount percentages (rather than ranges) must be submitted for line items, that only tools within listed automotive maintenance and repair categories are required to be offered under the contract, and that additional automotive equipment categories such as lifts and tire changers will not be added to the procurement.
Respondents must acknowledge receipt of this addendum by signing and returning it with their proposal submission, as failure to do so may result in disqualification. The addendum does not address proposed redlines to either Part A or Part B of the RFP, referencing instead Section A.15.9 regarding negotiations, assumptions, and exceptions. Contract Specialist Monica Suarez of the CTCD/CTCM manages this procurement. All pricing must remain firm and all-inclusive, with a 1.5 percent Texas SmartBuy administrative fee applied to purchases, and respondents must maintain a minimum of $500,000 in commercial general liability insurance.
