About this file
This is a Conflict of Interest Disclosure form for RFP No. 301-26-07016 issued by the State of Texas. The document serves as a certification requirement that must be completed, signed, and submitted with a respondent's proposal, with failure to do so resulting in disqualification. The form requires respondents to affirm that they have read and understand the conflict of interest provisions outlined in RFP Part B, including sections addressing prohibited bids and contracts, gifts to public servants, disclosure of conflicts of interest, and compliance with applicable laws. Respondents must certify that neither they, their employees, nor their subcontractors possess any interests that would create a conflict of interest or be adverse to contract performance, except as otherwise disclosed in the form.
The disclosure requires respondents to indicate whether they have actual or potential conflicts of interest to report or whether no conflicts exist. If applicable conflicts are identified, respondents must complete additional information regarding former executives or employees, including their names, the relevant state agency, separation dates, and employment dates with the respondent company. The form also establishes compliance requirements under three specific sections of the Texas Government Code: Section 669.003 (restrictions on contracting with executive heads of state agencies), Section 572.069 (prohibitions on employment of state officers and employees who participated in procurement), and Section 2252.901 (restrictions on contracts with former or retired agency employees). Respondents agree to a continuing duty to supplement responses if circumstances change or additional information becomes available subsequent to proposal submission.
