About this file
This is Addendum #3 to Request for Qualifications (RFQ) #0008505 issued by the Texas Facilities Commission (TFC) for Architect/Engineer (A/E) services for the design of the Texas Southern University School of Law facility. The addendum, dated May 1, 2026, addresses eight questions submitted by potential respondents regarding submittal format, timeline, staffing requirements, cost estimation responsibilities, consultant procurement procedures, and definitional clarifications. Key clarifications include that submissions should be organized by package as indicated in OpenGov with numbered pages and a paginated table of contents; resumes should only be provided for major consultants performing 15 percent or more of the project; A/E firms must provide rough order of magnitude (ROM) pricing for each design phase while TFC reserves the right to hire separate estimating consultants; and the definition of major subconsultants is those performing more than 15 percent of the project work. The addendum maintains the original proposal deadline of May 5, 2026 at 3:00 PM and confirms that all Basic Services must be provided under TFC's awarded A/E contract, with Special Services to be negotiated prior to contract award or potentially procured through separate IDIQ contracts at TFC's discretion.
The addendum specifies that respondents should reference TFC's A/E Guidelines, CAD standards, and the Professional Services Agreement template available on TFC's website, which defines Basic Services, and that the 2025 Uniform General Conditions are available for download. Respondents are directed to confirm the "Difference Between Initial Owner Budget and Contract Award" as equivalent to the Final Construction Cost rather than the Successful Respondent Amount. The procurement maintains the original HUB set-aside designation of 23.7 percent for A/E services under Texas Government Code Chapter 2161, with Method A and Method B documentation requirements based on subcontracting percentages. Funding for the project totals $193 million with construction costs estimated between $185 million and $200 million, contingent upon continued state appropriations availability. The TFC Procurement Department contact for addendum acknowledgment is James Wooley at 512-463-1766 or james.wooley@tfc.texas.gov.

ADDENDUM #3
DATE: 05/01/2026
REQ #: 0008505
TITLE: RFQ for A/E Services for Design of the Texas Southern University – School of Law
PROPOSAL DEADLINE: 05/05/2026
Addendum item #1:
To answer questions from potential Respondents.
# QUESTION RESPONSE
1 Should the submittal be structured to mirror the RFQ; listing each requirement and responding to it directly (e.g., “1. Company Description”)? Or is a different format acceptable as long as all required information is included?
Your submission should be structured per package as indicated in OpenGov. The format of your package is at your discretion. Each package should be organized to provide numbered document pages and contain an organized, paginated table of contents corresponding to the section and pages of your submittal.
2 Can you please release the timeline for the CMAR
RFQ?
We don't anticipate soliciting the CMAR until the project is fully funded by the 90th legislature in 2027.
3 Should we produce resumes for all consultants or only those that provide 15% or more to the project?
Only provide resumes for the major consultants that will be performing 15% or more of the project.
4 It is noted that the AE will assist in developing priorities and ROM pricing, so does that mean the AE will not require a cost consultant for reconciliation at key phases? Will this service be provided by the PMF or by TSU-contracted cost consultants?
For Each design phase, the A/E is to provide rough order of magnitude pricing (ROM). In addition, the Owner reserves the right to hire estimating consultants.
5 Third Party consultants are listed which duplicate IDIQ agreements for similar professional services currently under negotiation direct with TSU. Could these be procured by TSU directly or is it preferred they stay direct through TFC? Could any be added to the AE agreement as Reimbursables?
All Basic Services are to be provided under the Texas Facilities Commission (TFC’s) awarded A/E contract. The provision of Special Services, as identified in TFC’s standard contract, will be negotiated prior to contract award. TFC may choose to use IDIQ contracts, at their discretion, to provide special services for The Project.
6 To assist with sub-consultant selection, please confirm the services that TFC and TSU will consider as Basic Services under this contract. If available, please confirm any known additional services so that AE teams can identify consultants that are key to the success of the project..
The selected A/E firm will adhere to TFC’s A/E Guidelines, CAD standards, and specific criteria. A template of the Professional Services Agreement can be reviewed on the TFC’s website, and the 2025 Uniform General Conditions (an update to the template) is also available for download. The referenced Professional Services Agreement defines “Basic Services” on page 3.
7 Where asking for "Difference Between Initial Owner Budget and Contract Award," is the Contract Award the same as the "Successful Respondent Amount" OR is it the same as "Final Construction Cost"?
It is the same as the Final Construction Cost.
8 Is the definition of major subconsultants in item 3.b.1.c the same as in item 3.b.4, where the definition of major subconsultants are those performing 15% or more of the project?
Yes, a major subconsultant is a subconsultant that will be performing more than 15% of the project.
All other aspects of the RFQ # 0008505 remain as is.
