About this file
This document contains Special Terms and Conditions for an insurance requirement associated with a Texas contract opportunity with the Texas Commission on Environmental Quality (TCEQ). The terms establish mandatory insurance coverage requirements for vendors and their employees, agents, or subcontractors who will be performing work on premises occupied or controlled by TCEQ. Vendors must maintain commercial general liability insurance at reasonable limits and worker's compensation coverage for all employees performing contract work on TCEQ-controlled premises, either through insurance policies or qualified self-insurance programs where legally permitted.
The insurance policies must include specific provisions naming TCEQ and its officers and employees as additional insureds under the Commercial General Liability Insurance policy. Additionally, the policies must contain a waiver of subrogation in favor of TCEQ, its officers, and employees for bodily injury including death, property damage, or any other loss arising from the contract. These requirements ensure adequate protection and risk management for the state agency throughout the contract performance period.
