About this file
This is an Addendum I to RFP 701-26-008 issued by the Texas Education Agency (TEA) for Teacher Liability Insurance, dated February 10, 2026. The addendum addresses ten questions submitted by prospective vendors regarding the solicitation requirements. The RFP seeks to establish a teacher liability insurance program for classroom teachers as defined by Texas Education Code § 5.001(2), which encompasses educators employed by school districts who teach an average of at least four hours daily in academic or career and technology instructional settings. The program explicitly excludes teacher's aides and full-time administrators. Vendors are responsible for proposing viable options for policy structures, including per-claim and aggregate limits, sub-limits, and exclusions; claims-made versus occurrence-based policies; and the scope of legal support services to be provided by licensed Texas attorneys. The addendum clarifies that direct-to-consumer business experience may satisfy reference requirements if end-user customers are provided as references.
Pricing for the program will operate on a cost-per-participant model with tiered pricing based on different enrollment levels, and vendors should propose bonus structures for achieving specific participation thresholds. The contract will establish annual estimates and limits on classroom teacher participation based on contract negotiations, with TEA maintaining discretion over aggregate caps. The addendum confirms that total costs will not exceed the allotted budget, and teachers will not be charged additional fees beyond the state-funded amount for required services. TEA retains flexibility to negotiate vendor-proposed service tiers exceeding RFP requirements and may extend eligibility to clinical teachers and teacher residents through negotiated arrangements. Database compliance with Texas-RAMP, TEA system integration, and access requirements will be determined during contract negotiations.

Texas Education Agency RFP 701-26-008, Teacher Liability Insurance
Addendum I, February 10, 2026 Vendor Discussions
This addendum incorporates the following changes to the above-referenced solicitation:
I. Questions - The following questions and associated responses are hereby incorporated into the above-referenced solicitation:
1. Question: Does TEA require specific per-claim or aggregate limits, sub-limits (civil rights, criminal defense, bail bonds, identity theft), or prohibited exclusions in the policy?
TEA Response:
The responding vendor should propose viable options for limits, sub-limits, or prohibited exclusions in the policy and provide a rationale for each option, as well as their recommended option if awarded this contract. This recommendation may be negotiated with the selected vendor during contract negotiations.
2. Question: Does TEA require a claims-made or occurrence-based policy?
TEA Response:
The responding vendor should propose viable options for claims-made or occurrence-based policies and provide a rationale for each, as well as their recommended option if awarded this contract. This recommendation may be negotiated with the selected vendor during contract negotiations.
3. Question:
A. How does TEA define “classroom teacher” for eligibility and enrollment validation?
B. Are there any other classifications of public-school staff that are eligible for the program?
TEA Response:
3A.) For the purposes of this solicitation, the definition of classroom teacher is defined by TEC 5.001(2), “Classroom teacher" means an educator who is employed by a school district and who, https://statutes.capitol.texas.gov/?tab=1&code=ED&chapter=ED.5&artSec=5.001 not less than an average of four hours each day, teaches in an academic instructional setting or a career and technology instructional setting. The term does not include a teacher's aide or a full-time administrator.
3B.) No other classifications of public-school staff are eligible for the program.
4. Question:
A. For notices of cancellation or renewal and provision of an annual certificate of insurance, does TEA require any particular communication medium, such as direct postal mail?
B. Will an email notification meet the requirements?
C. Are there any other required communications that may necessitate the use of direct postal mail?
See Attachment B, 65-B of the TEA Terms and Conditions
5. Question: The RFP requires submission of a fiscal year budget. The variable in that calculation is number of classroom teachers who participate in the program.
A. Are there annual estimates or limits to the number of classroom teachers that will be allowed to participate in the program?
B. If not, would a cost-per-participant model be a better metric given the variability, and possible ramp up over time of participation by eligible members?
C. If a cost-per-participant model is preferred, does TEA have a sum-certain amount at which the program would cap out for each fiscal year?
TEA Response:
5A.) The contract will have annual estimates/limits to the number of classroom teachers that will be allowed to participate in the program, but they will be based on contract negotiations regarding the cost-per-participant model and other contractual tasks.
5B.) Regarding a cost-per-participant model, please refer to section 4.1, Evaluation Criteria, subsection C-5 from this RFP: “TEA seeks to align all payments with this contract with the number of teachers enrolled in this program and seeks to set different unit prices for different tiers of numbers of teachers.” In addition, respondents should suggest bonuses for achieving certain uptake thresholds. These costs and quantities may be negotiated during contract negotiations.
5C.) TEA doesn’t have a sum-certain amount at which the program would cap out for each fiscal year. This will be based on contract negotiations.
6. Question:
A. Does the database of participants need to be Texas Ramp Compliant?
B. Will TEA want access via login credentials to the database of participants?
C. Does the database need to integrate with any TEA systems?
TEA Response:
6A.) TX-RAMP will be established during contract negotiations, if required.
6B.) TEA access will be established during contract negotiations, if required.
6C.) Integration will be established during contract negotiations, if required.
7. Question: The RFP expectation is that the vendor will provide assistance to classroom teachers in understanding their rights, duties, and benefits.
A. Would TEA please provide more details about the type and scope of legal support the agency expects the vendor to provide classroom teachers, beyond the provisions of the liability insurance policy?
B. Can TEA provide examples of what would be covered by the "legal support" expectation and what would fall outside the "legal support" expectation?
C. In addition, does TEA require this legal support to be provided by a licensed Texas attorney?
TEA Response:
7A.) Responding vendor should propose viable options for legal support offered to classroom teachers and provide a rationale for each of these options, as well as their recommended option if awarded this contract. This recommendation may be negotiated with the selected vendor during contract negotiations.
7B.) Examples could include, but desired full scope of legal services are not limited to: legal consultation and legal document support. The responding vendor should propose viable examples of legal services. These recommendations may be negotiated with the selected vendor during contract negotiations.
7C.) TEA requires legal support to be provided by a licensed Texas Attorney.
8. Question: Section 3.3 H of the RFP requires 3 project references of a similar size, scope, and complexity from other companies. Our organization offers the goods and services that are the subject of this RFP directly to end user customers rather than to other businesses. Would our direct-to-consumer experience fulfill the requirements of 3.3 H by describing our business and utilize end user customers of our products as the required references?
TEA Response: Yes, direct-to-consumer experience will fulfill the requirements of 3.3H.
9. Question:
A. Should the cost to deliver the contractually obligated services to the number of teachers who wish to enroll exceed funds appropriated and provided through this contract, will the contractor be permitted to charge enrolled teachers the difference between the amount provided by TEA and the actual cost of the services?
B. Should the contractor wish to offer tiers of service that exceed those required in the RFP, will the contractor be permitted to collect payments from teachers who elect to enroll in a higher tier for the additional costs that exceed what the contractor is paid by the state?
TEA Response:
9A.) Cost will not go over the allotted amount. A potential vendor can provide a cost estimate based on participating teachers' paying into the program.
9B.) The scope of this RFP is for classroom teachers as defined by TEC 5.001(2), which states:
"Classroom teacher" means an educator who is employed by a school district and who, not less than an average of four hours each day, teaches in an academic instructional setting or a career and technology instructional setting. The term does not include a teacher's aide or a full-time administrator.” The contractor and TEA may agree on an approach for non-classroom teachers and the additional services for classroom teachers in the contract negotiation phase of this solicitation. TEA is open to negotiations regarding vendor-proposed tiers of service that exceed those currently required in this RFP during contract negotiations.
10. Question: Are clinical teachers or teacher residents eligible to participate?
For the purposes of this solicitation, a clinical teacher or teacher resident may be eligible to participate based on different tiers that may be offered. This will be confirmed during contract negotiations. The responding vendor may propose options for services that would be provided to teacher residents.
II. All other provisions of the solicitation remain the same.
