About this file
This is Addendum No. 1 (Questions and Answers) to a Request for Proposals issued by Lamar University, a Texas State University System institution, for NCAA Title IX Compliance Education and Advisory Services. The procurement seeks a qualified consulting firm to conduct a comprehensive assessment of the Athletics Department's compliance with federal Title IX requirements, NCAA regulations, and conference standards, with deliverables including independent training forums, resource reviews, policy recommendations, and formal reporting. The solicitation is open to competitive sealed proposals with no incumbent or preferred vendors identified. The proposal submittal deadline is February 10, 2026, at 2:00 PM (CDT), with projected award on March 2, 2026, and contract execution by March 30, 2026. The contract term is one year from execution with options to renew for four additional one-year terms if both parties agree in writing. Training is anticipated to be completed by April 30, 2026, delivered on-site over typically three to five training days per year, with the scope limited specifically to the Athletics Department.
The pricing proposal must include a lump-sum monthly fee with itemized travel expenses complying with GSA Per Diem Guidelines, and Addendum No. 2 permits respondents to provide optional annual pricing escalation percentages. Payment terms are net thirty days upon receipt of undisputed invoices. No specific budget range or not-to-exceed amount has been disclosed. Respondents must provide General Liability insurance ($1,000,000 per occurrence), Workers Compensation coverage at statutory limits, Automobile insurance ($1,000,000), and Professional Liability insurance ($1,000,000), with Lamar University and the Texas State University System named as additional insureds. The University retains all work products as works for hire and exclusive property, with respondents relinquishing all intellectual property rights. Respondents may submit exceptions to the University's Terms and Conditions as addendum to their proposals, and all qualifying proposals will be evaluated according to five weighted criteria: Statement of Qualifications and Availability (20%), Ability to Provide Services (20%), Performance on Past Similar Projects (15%), Project Specific Information (20%), and Pricing and Delivery Proposal (25%).

ADDENDUM 1
Prospective Respondent Questions
1. Is there an online submission you use?
Answer: Please refer to Section 1.7 of the RFP for submission instructions.
2. On page 4, the RFP states “The length of such Contract shall be one (1) year from contract execution or date outlined in the contract, whichever is later, with an option to renew for four
(4) additional one (1) year terms if both parties agree in writing.” Given that the RFP is asking for a lump sum monthly fee, may we include notes about renegotiation of rates and/or potential yearly pricing escalation if needed?
Answer: RFP Addendum No. 2 has been added to revise Exhibit A – Respondent’s Pricing and Delivery Proposal to allow Respondents to provide optional annual pricing escalation percentages. The Addendum will be posted to the TxSmartBuy ESBD for vendor review.
3. On page 27, the RFP states that one aspect of Criterion Four is “Acceptance of the Texas State
University Systems Terms and Conditions.” May we note any potential exceptions that we would like to take the RFPs terms and conditions in our proposal?
Answer: Any exceptions to the University’s Terms and Conditions may be submitted as an addendum to the Respondent’s proposal.
4. Is Lamar University currently considering any incumbent or preferred vendors for this Title IX voluntary review, or is the University seeking proposals through an open evaluation process?
Additionally, is there an anticipated budget range or not-to-exceed amount allocated for this engagement that proposers should be aware of?
Answer: Per Section 1.1 of the RFP solicitation, Lamar University is seeking competitive sealed proposals for the selection of one qualified and responsible Consulting firm to provide these services. There is no anticipated budget range or not-to-exceed amount determined for this project at this time.
5. When evaluating proposals, will Lamar University consider vendors available through pre-established cooperative purchasing agreements (e.g., state, regional, or national cooperatives), and if so, how are those agreements weighed in the selection process?
Answer: This is a competitive bid solicitation. All qualifying Respondent proposals will be evaluated and weighted in accordance with the guidelines outlined in Section 4 – Requirements for Statement of Qualifications Package of the RFP document.
6. The scope of work outlined appears to focus on Title IX compliance in Athletics. Can you confirm whether the review is limited to athletics, or whether other institutional areas (e.g., policies, procedures, reporting, training, investigations, campus climate) are also within scope?
Answer: This solicitation is specific to the University’s Athletics Department.
7. I see that the contract execution date is March 30th. What is the desired delivery date of services?
Answer: The target date for training completion in 2026 is April 30th. Annually, the early Spring Semester
