Aransas Pass Aquatic Center Boardwalk Replacement - Bid Packet Summary

This is a construction bid packet issued by the Coastal Bend Bays & Estuaries Program, Inc. (CBBEP), a 501(c)(3) non-profit organization, for the Aransas Pass Aquatic Center Boardwalk Replacement project located at 400 E. Johnson Avenue in Aransas Pass, Texas. The project scope consists of removing the existing timber boardwalk structure including all framing members and piles, and constructing a new boardwalk with a layout resembling the original configuration featuring approximately ten 10-inch square timber piles, structural grade reinforced HDPE framing members, and reinforced polymer decking. The new boardwalk will serve pedestrian foot traffic only, with all excavated materials to be removed from the site and vegetated areas protected throughout construction. Sealed bids are due by 1:00 PM on December 4, 2025, with a non-mandatory virtual pre-bid conference scheduled for 12:00 PM on November 17, 2025. Proposals may be hand-delivered, sent via FedEx or UPS to the CBBEP office in Corpus Christi, or submitted via email to mkramer@cbbep.org. The contract time for completion is five months from the Notice to Proceed, with liquidated damages assessed at $300 per calendar day for delays. All bids will be opened publicly and read aloud on December 4, 2025, with the award conditioned upon availability of funds and the CBBEP's discretion to select the bid deemed most advantageous or best value rather than necessarily the lowest bidder.

The bid packet requires a 5 percent bid bond or certified check with each proposal and includes performance and payment bonds equal to 100 percent of the contract amount, both required within seven business days of award. Bidders must submit insurance certificates demonstrating commercial general liability coverage of $2,000,000, automobile liability of $1,000,000, excess liability of $1,000,000, professional pollution liability of $2,000,000, and maritime employers liability of $500,000, with all certificates naming CBBEP as an additional insured. The contractor must comply with Davis-Bacon prevailing wage requirements, Texas workers' compensation insurance mandates, and all applicable environmental, archaeological, and occupational safety regulations including OSHA standards. The contract includes a one-year maintenance guaranty period with warranty inspections to be conducted 11 months after CBBEP acceptance, and the contractor must provide a Spill Response Plan, daily activity reports, Demolition Plan, and record drawings as required submittals. The project involves marine construction conditions including tidal fluctuations of approximately 0.6 feet under ordinary conditions and potential wind-driven water level changes of up to 2.5 feet or more, with the contractor responsible for all associated impacts and rework at no additional compensation.

NOTICE TO CONTRACTORS – B

WORKERS’ COMPENSATION COVERAGE

Texas law requires that most contractors, subcontractors, and others providing work or services for a construction project be covered by worker's compensation insurance, authorized self-insurance, or an approved worker's compensation coverage agreement.

Even if Texas law does not require a contractor, subcontractor or others performing project services (including deliveries to the job site) to provide 1 of the 3 forms of worker's compensation coverage, CBBEP will require such coverage for all individuals providing work or services on this project at any time, including during the maintenance guaranty period. Motor carriers which are required to comply with Texas Transportation Code, Section 643.101 and which provide accidental insurance coverage under 43 TAC 218.16 need not provide 1 of the 3 forms of worker's compensation coverage.

The Contractor agrees to comply with all applicable provisions of Texas Administrative Code Title 28, Section 110.110, a copy of which is attached and deemed incorporated into the project contract. Please note that under section 110.110:

1. Certain language shall be included in the Contractor's Contract with CBBEP and the

Contractor's contracts with subcontractors and others providing services for the project;

2. The Contractor shall submit to CBBEP, certificates of coverage for its employees and for all subcontractors and others providing services on the project. The Contractor shall obtain and submit updated certificates showing extension of coverage during the project;

and

3. The Contractor shall post the required notice at the job site.

By signing this Contract, the Contractor certifies that it will timely comply with these requirements.
