About this file
This file contains Enhanced Minimum Wage Provisions applicable to state and local contracts in Pennsylvania, effective February 2024. The provisions establish mandatory wage requirements for all contractors performing services under state and local contracts, along with compliance, notification, and enforcement mechanisms.
Contractors are required to pay a minimum of $15.00 per hour to employees performing services directly called for in the contract, as well as to employees spending at least 20 percent of their time performing ancillary services necessary for contract performance. Beginning July 1, 2023, and annually thereafter, the minimum wage rate adjusts based on the annual percentage change in the Consumer Price Index for All Urban Consumers (CPI-U) for Pennsylvania, New Jersey, Delaware, and Maryland, with adjusted amounts published in the Pennsylvania Bulletin by March 1 each year for implementation on the following July 1. Exceptions to these provisions apply to employees exempt from minimum wage under the Minimum Wage Act of 1968, those covered by collective bargaining agreements, and employees required to be paid higher wages under prevailing wage, Davis-Bacon, or other applicable state and local laws. Contractors must post the provision conspicuously or provide electronic notice to employees annually, maintain wage and employment records for Commonwealth review, and include these provisions in all subcontracts. Non-compliance may result in contract termination, nonpayment, debarment, or referral for civil or criminal action.
