About this file

This is an Americans with Disabilities Act (ADA) compliance document applicable to state and local government contracts as of February 2024. The document establishes mandatory accessibility and non-discrimination requirements for all contractors performing work under the agreement. Contractors must ensure that no qualified individual with a disability is excluded from participation in the contract or its associated activities based on disability status. The contractor is required to comply with Title II of the Americans with Disabilities Act (42 U.S. Code 12101 et seq.) and all implementing regulations set forth in 28 C.F.R. 35.130, which establish general prohibitions against discrimination applicable to state and local government entities.

The contractor assumes full indemnification responsibility for the Commonwealth against any third-party claims, suits, demands, losses, damages, costs, expenses, litigation costs, attorney's fees, and liabilities arising from the contractor's failure or the failure of its employees or agents to comply with ADA requirements. This indemnification obligation is determined at the Commonwealth's sole discretion. No specific pricing, funding amounts, set-asides, or contract term information is provided in this compliance document, as it functions solely as a contractual obligation clause rather than a procurement specification or award document.
