About this file
This document contains questions and answers related to the prequalification process for an Electronic Lien and Titling (ELT) program being implemented by the Illinois Secretary of State's Office. The ELT program will allow multiple vendors to participate in the registration of lenders, receipt and maintenance of title records, and transactional capabilities for correcting and updating title records. The document clarifies that ELT participation is currently voluntary for lenders in Illinois, with no minimum number of lenders required to be enrolled with a service provider. It also confirms that vendors must have an operational ELT system implemented in at least one other state to meet the qualification requirements, and that the system must be usable by or on behalf of lienholders, car resellers, and motorists. The state has also confirmed that the vendor's intellectual property will not be transferred to the state as part of the contract.
Regarding pricing and other terms, the document does not provide specifics, but notes that the state is seeking proposals from multiple vendors to implement and operate the ELT program in Illinois. The state will own the title records, but the vendors will be responsible for all aspects of the program.

Question Set 2 Electronic Lien & Titling Prequalification
23-350SOS-SOS35-B-34702
1. Is ELT mandatory for lienholders in IL? Or is there a threshold for when lienholders must be enrolled as ELT.
ELT is voluntary for lienholders with perhaps future transition to mandatory participation
2. Is there a minimum number of lienholders that should be enrolled with an SP?
No
3. Section D.2.2.2. - Does ELT Service Provider Gateway experience count towards the State’s qualification requirement?
Vendors must have a fully operational system in another state
4. Section D.2.2.2. - Would the State please confirm that the requirement to have implemented/operated as ELT service provider outside of Illinois is fully met with a system implemented in one state (or alternately, with related systems implemented in multiple states)?
Yes, this requirement is met if an ELT service provider has implemented such a system in at least one other state
5. Section D.2.2.3 - Typically, ELT systems might not be used directly by particular parties, but are used on their behalf. Would the State please confirm that “for lienholders, care resellers, and motorists” is satisfied by a system that is used by or on behalf of each of these types of parties?
Yes, the requirement that the system be usable by lienholders, car resellers, and motorists is satisfied by a system that is used by or on behalf of each of these types of parties
6. Section F.10. - ELT systems created and used in other states, and adjusted for use in Illinois, are owned by their creators. This clause would seem to transfer a provider’s intellectual property to the State. Would the State please confirm that that code that comprises the system would not be owned or transferred to the State?
The ELT vendors code would not be owned by the Illinois Secretary of State
