About this file
This is a Justification for an Exception to Fair Opportunity under FAR Subpart 16.5, issued by the Defense Logistics Agency (DLA) Contracting Services Office in Philadelphia for a contract modification.
The document authorizes a sole-source, six-month extension of professional services for the Enterprise Workflow Support Capability (EWSC) to be awarded to Phoenix Data Security, Inc. under contract SP470924D0050 - SP470925F0037. EWSC is an enterprise-wide information system serving approximately 1,000 end users worldwide that provides DLA customers with tailored software solutions for business processes and workflow management, enabling real-time data exchanges, metric tracking, and work product automation. The requested activity is DLA Information Operations (J6) at Fort Belvoir, Virginia. The justification cites FAR 16.507-6(b)(3) exception authority based on logical continuation of services and investment protection, arguing that Phoenix Data Security, Inc.'s existing institutional knowledge of the RSA Archer operating system and proven performance as both a prior sub-contractor and current service provider make it the sole viable contractor to avoid operational disruptions, cost duplication, and mission risk to critical security workflows affecting the DLA Office of Inspector General, J2 Security and Intelligence, Office of General Counsel, and Privacy Compliance Office. The Contracting Officer determined the anticipated cost will be fair and reasonable through comparison to the Independent Government Cost Estimate and historical pricing based on OY2 rates previously determined fair and reasonable. Section 7 states DLA will continue exercising full and open competition for subsequent acquisitions whenever practicable.

CONTRACTING SERVICES OFFICE - PHILADELPHIA
700 ROBBINS AVENUE
PHILADELPHIA, PENNSYLVANIA 19111-5092
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
UNDER FEDERAL ACQUISITION REGULATION (FAR) SUBPART 16.5
Multiple Award Schedule/Multiple Award Contract (MAC) Orders under MAC/Fair Opportunity, FAR 16.507-6(b)(3)
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:
Requesting Agency:
Defense Logistics Agency (DLA) Information Operations (J6) 8725 John J. Kingman Road Fort Belvoir, VA 22060-
Contracting Activity:
DLA Contracting Service Office – Philadelphia (DCSO-P) 700 Robbins Avenue Philadelphia, PA 19111
2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED:
Pursuant to Federal Acquisition FAR 16.507-6(b)(3), the action being approved is an exception to the fair opportunity process to execute a six (6)-month extension under FAR 52.217-8, Option to Extend Services. This justification authorizes the procurement of additional support for Enterprise Workflow Support Capability (E.W.S.C) under SP470924D0050 - SP470925F0037. This justification and approval authorizes and approves the extension of services for engineering and sustainment support of the Enterprise Workflow support Capability (E.W.S.C).
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET
THE AGENCY’S NEEDS, INCLUDING AN ESTIMATED VALUE:
DLA Information Operations has a requirement to extend current professional services assisting with the Enterprise Workflow Support Capability (EWSC) and to provide associated technical support by a period of six (6) months. EWSC is an enterprise-wide Information System (I.S.) whose mission is to support DLA customers by providing tailored software solutions to assist in performing individual business processes and/or meet workflow-based business requirements. EWSC is considered an administrative enabler, providing DLA customers real-time data exchanges with the ability to implement business processes, track metrics, and automate work products’ efficacy, thereby improving productivity and reducing costs incurred to the Government. The current iteration of EWSC consists of a multi-tenant virtual infrastructure supporting approximately 1,000 end users world-wide and around the clock.
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY AND
SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION OF THE
PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THAT THE
NATURE OF THE ACQUISITION REQUIRES USE OF THE EXCEPTION
CITED:
Pursuant to FAR 16.507-6(b)(3), the action being approved is an exception to fair opportunity issued on a sole-source basis in the interest of economy and efficiency because the work to be performed is a logical follow-on. This justification authorizes the use of other than full and open competition to award Phoenix Data Security, Inc. for a 6- MONTH extension of their contract for professional services of sustainment and enhancement of EWSC.
Logical Continuation of Services & Investment Protection: This modification logically aligns the current task order with the full scope of work successfully performed under the predecessor contract. It represents a correction to ensure the successor task order is fully resourced to execute the complete, known requirement, protecting the Government’s prior investment in Phoenix Data Security Inc’s expertise and ensuring a seamless continuation of critical services. The continuation of services presents a known cost based on current pricing as opposed to the unknown potential costs and associated risks – including significant operational gaps and delays in critical security workflows for DLA J2 Security and Intelligence potentially affecting onboarding of future contract personnel and lapses in investigations guided by the DLA Office of Inspector General. Along with potential system failures, increased management overhead and potential work stoppage for the DLA Office of General Counsel and the Privacy Compliance Office along with those already listed above totaling roughly 1,000 registered users. Awarding this requirement is vital to maintaining DLA mission readiness and warfighter support. It provides the immediate technical acumen necessary to sustain critical, non-classified internal operations.
Recognizing the economic and efficiency goals that underpin the spirit of FAR 16.507- 6(b)(3), it is in the Government’s best interests for Phoenix Data Security Inc. to continue performing this work. No other contractor can enter this operational ecosystem at this time with the same institutional, on-the-ground knowledge that this contractor possesses.
To do so would risk duplication of costs and efforts as well as introducing mission risk through the discordance of a new contractor’s start-up processes that could not fundamentally anticipate and understand the nature of this program without significant time and undertaking.
The current provider, Phoenix Data Security, Inc was initially awarded the service and support contract based on strong knowledge of the RSA Archer operating system, and proven track record while performing as the sub-contractor during the prior award and period of performance. It is that hard-won knowledge that the Government now seeks to harvest through this logical follow-on in the interests of economy and efficiency.
5. DETERMINATION BY THE ORDERING ACTIVITY CONTRACTING
OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE
FAIR AND REASONABLE:
The Contracting Officer has determined that the anticipated cost to the Government for this sole-source modification will be fair and reasonable. The Contracting Officer will ensure price reasonableness in accordance with FAR 15.404-1(b)(2) by employing one or more of the following price analysis techniques:
1. Comparison of the proposed price to the Independent Government Cost Estimate (IGCE). The IGCE was prepared by the required activity and is based on the known complexity of the work being added by this modification. This is in accordance with OY2 rates which were determined fair and reasonable at time of award.
2. Comparison with historical prices. The proposed labor rates and pricing for the added scope will be compared to the pricing of the already-awarded base task order and any similar work.
6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:
N/A
7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS
MADE:
DLA has and continues to exercise competition as often as possible and conducts ongoing reviews to keep abreast of new technology, both in industry and the Government. As a continuing effort DLA uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition whenever practicable.
