Key Term Local Educational Agency (LEA)
A public board of education or other public authority legally constituted within a State for either administrative control or direction of, or to perform a service function for, public elementary schools or secondary schools in a city, township, school district, or other political subdivision of a State.
Background Under section 1120 of Title I, Part A of the Elementary and Secondary Education Act of 1965, as amended (ESEA), each participating LEA must provide Title I services to eligible private school children, their teachers, and their families. Theses services must be equitable to those provided by each LEA.
If an LEA is prohibited by law from providing equitable services or if the U.S. Secretary of Education determines that an LEA has substantially failed or is unwilling to provide such services to private school children, that LEA is “bypassed.” In such an instance, the Secretary makes arrangements to provide these services to eligible private school children, their teachers, as applicable, and their families through a contract with a third party provider.
Contract Funding Authority ESEA, Title I, Part A , Sections 1120(e) & 9504
Authorizes the Secretary to make arrangements for services and pay for the cost of those services, including the administrative costs of arranging for those services, from the appropriate allocation or allocations.
PURPOSE of these contracts To provide equitable services under Title I to eligible children attending private schools, their teachers, and their families in the 14 bypassed LEAs in Virginia.
To provide equitable services under Title I to eligible children attending private schools, their teachers, and their families in the 54 bypassed LEAs in Missouri.
Period of Performance The period of performance for this contract is twelve months from the date of award with four additional twelve-month option periods to be exercised at the discretion of the U.S. Department of Education based upon the availability of funding and satisfactory contractor performance.
