About this file
This document is an Equal Benefits Ordinance (EBO) Disclosure Form and Certification of Compliance issued by the City of Long Beach. It establishes nondiscrimination requirements for contractors entering into agreements with the City.
The EBO applies to for-profit employers with City contracts valued at $100,000 or more for the purchase of goods, services, public works, improvements, or construction projects, and to for-profit entities generating $350,000 or more in annual gross receipts when leasing City property pursuant to a written agreement exceeding 29 days in any calendar year. Contractors subject to the EBO must provide equal benefits to employees with spouses and employees with domestic partners, including health benefits, bereavement leave, family medical leave, membership and membership discounts, moving expenses, retirement benefits, and travel benefits. Cash equivalent payments are permitted if employers make all reasonable efforts to provide domestic partner benefits but are unable to do so due to insurance provider limitations. Contractors must certify compliance before contract execution or provide evidence of a City-issued waiver and grant authorized City representatives access to records for verification.
The EBO includes provisions allowing contractors to delay implementation under specific circumstances: by the first effective date after the first open enrollment following contract start date (not exceeding two years) if the contractor submits evidence of taking reasonable measures to comply; at such time as administrative steps can be incorporated into the contractor's infrastructure (not exceeding three months); or upon expiration of the contractor's current collective bargaining agreement. Failure to comply after the implementation period expires constitutes material breach, subjecting the contractor to contract cancellation, termination, or suspension; designation as an irresponsible bidder with a three-year disqualification period; liquidated damages assessed against monies due; and other remedies available at law or in equity. Contractors must complete and submit the certification form with contractor information, answer compliance questions, indicate provisional compliance timelines if applicable, and provide required documentation at contract award.
