About this file

This is a Public Works Project Requirements document issued by the New Mexico Department of Workforce Solutions Labor Relations Division, outlining mandatory compliance requirements for state and local public works projects valued at $60,000 or more. The document establishes the responsibilities of contracting agencies, general contractors, and subcontractors working on the Primary Clarifier #1 Rehabilitation Project, which involves replacing mechanical equipment, electrical control panels, and performing concrete/grout repairs on primary clarifiers installed in 1998 that have reached the end of their useful life. All contractors and subcontractors of any tier, excluding professional services, must be actively registered with the Public Works and Apprenticeship Application (PWAA) website prior to commencing work. General contractors are required to submit a complete Subcontractor List and Statements of Intent to Pay Prevailing Wages to the contracting agency within three days of contract award. Upon project completion, contractors must submit Affidavits of Wages Paid to the contracting agency, and contracting agencies must close the project in the PWAA system no later than 90 days after completion.

All subcontractors and sub-tier contractors must comply with New Mexico's Public Works Minimum Wage Act and pay prevailing wages as established by the state. Contractors are required to contribute to either an approved Apprenticeship Program or the Public Works Apprentice and Training Fund in accordance with the Public Works Apprentice and Training Act. The Wage Rate poster provided through PWAA must be displayed at the job site in an easily accessible location. The contracting agency bears responsibility for ensuring all contractors maintain active registration and for updating subcontractor lists whenever changes occur. Additional guidance and required forms are available through the New Mexico Department of Workforce Solutions Labor Relations Division website, with inquiries directed to public.works@dws.nm.gov or (505) 841-4400.
