II. EVALUATION FACTORS FOR AWARD
Basis for Award
An award will be made to the responsive and responsible Offeror whose offer, conforming to the solicitation, is determined to offer the best value to the Government in terms of: 1) technical acceptability; 2) past performance 3) price. It is the Government’s intent to award a firm fixed- price purchase order based upon initial offers without entering into discussions or negotiations (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price standpoint, reflecting ANY AVAILABLE DISCOUNTS. While it is the Government's intent to make award based upon initial offers, the Government may, nevertheless, determine during the evaluation period that it is necessary to conduct discussions.
Order of Importance
The technical evaluation criteria that are addressed in the Technical Proposal are considered equal to price in the selection of the contractor for award. When the Technical Proposals are evaluated as essentially equal, the quoted price may become the determining factor in making an award.
Evaluation Criteria
The Offeror’s proposal will be evaluated in terms of the following criteria:
1) Technical Acceptability
a) Qualifications
b) Experience/Past Performance
2) Price
Technical Acceptability Technical acceptability of the Offeror’s proposal will be evaluated based on the following:
Qualifications - The Offeror’s submission of valid licenses and certifications listed in the “Proposal Format” section. Statement confirming AutoCAD capabilities is also required.
Experience/Past Performance – The Offeror’s relevant and successful work experience in fire escape refurbishment and paint application based on documentation submitted in accordance with the “Proposal Format” section and any other available past performance information.
Price
The Offeror’s quoted price will be evaluated in accordance with FAR provision 52.217-5 “Evaluation of Options”. The provision is provided in full text here:
FAR 52.217-5 Evaluation of Options (Jul 1990)
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). For Optional CLIN 0200, the not-to-exceed quantity of 20 bolts will be used for evaluation purposes.

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate
Solicitation Number DTRT5715Q80080
(weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those
Solicitation Number DTRT5715Q80080 classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
END OF GENERAL DECISION
STATEMENT OF WORK (SOW)
Fire Life Safety Refurbishment to the Steel Fire Escape Stairs at the FAA Oakdale (QRC) Air Route Surveillance Radar (ARSR)
1 Sgt. Messerschmidt Road Oakdale, PA 15071
INTRODUCTION-BACKGROUND
The Federal Aviation Administration (FAA) Oakdale Air Route Surveillance Radar (ARSR-9) facility, located in Oakdale, PA has an exterior fire escape / exit route in need of repairs. The facility was built in 1961 for the Air Force as part of the Air Defense Command. Transfer of ownership to the FAA was approximately in 1975. ARSR-9 is made of reinforced concrete construction with nominally 10-in thick exterior walls. There are 5 floor levels (Level 1 is at grade) of approximately 3,600 sq. ft. per floor. A radar dome is located on the roof at nominal 80-ft height. There is an existing steel fire escape stairway on the exterior of the building which is presently in need of maintenance and repair in order to pass inspection certification. The existing fire escape doors and wall barriers are being replaced under a separate contract (not part of this scope of work). The fire escape structure is in need of a total refurbishment including structural repairs (bolts, bracket replacements, etc.), maintenance, removing surface rust, scraping, priming and painting.
Figure 1: Photo of ARSR-9, Oakdale, PA (with escape ladder showing)
The following statement of work (SOW) is intended to outline the task requirements for project submittals, fire escape structural design refurbishments/maintenance repairs, and the surface
Solicitation Number DTRT5715Q80080 preparation, priming and painting of the exterior fire escape structure. This SOW will be reviewed at the pre-bid conference along with a site visit walk-through of the work. It is mandatory that the perspective bidders attend the pre-bid conference/site visit before submitting a bid and it is also strongly recommended that their structural engineer attend the pre-bid meeting.
PROJECT SUMMARY
A survey inspection was conducted of the structural integrity and condition of the fire escape by a qualified inspector. There were discovered areas requiring maintenance/repair as listed and described below (see Task 4). The Contractor shall provide all the necessary labor and materials to repair the fire escape structure, surface preparation, prime and paint the 5 story exterior steel fire escape. The Contractor may be required to co-ordinate work with other FAA projects (i.e. – fire door replacements or another contract activity) and will be provided advance notification if this applies (once awardee final schedule is presented to the government). This requirement will be discussed at the pre-bid meeting.
CONSTRUCTION WORKING HOURS
Working hours for the project shall be five (5) eight hour days occurring on Monday through Friday between the allowable hours of 0600 to 1600 unless otherwise mutually agreed on by the Volpe Center Contracting Officer (CO) and FAA. The contractor shall work a minimum of 8 hour days, but may work up to 10 hours on site per day with the mutual agreement of the CO,FAA and contractors. This can be further discussed at the pre-bid meeting. The Volpe Center will provide a government representative RE, Resident Engineer, on site for the duration of the construction project to oversee the work effort.
