GOING-TO-THE-SUN ROAD REHABILITATION, RISING SUN TO ST. MARY, PHASE 13

(2) Through another subsidiary of a parent corporation.

(b) If the contractor reorganizes as an inverted domestic corporation or becomes a subsidiary of an inverted domestic corporation at any time during the period of performance of this contract, the Government may be prohibited from paying for Contractor activities performed after the date when it becomes an inverted domestic corporation or subsidiary. The Government may seek any available remedies in the event the Contractor fails to perform in accordance with the terms and conditions of the contract as a result of Government action under this clause.

(c) Exceptions to this prohibition are located at 9.108-2.

52.211-10 Commencement, Prosecution, and Completion of Work (Apr 1984) Alternate I (Apr 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than October 12, 2016 subject to such extensions as may be authorized. The time stated for completion shall include final cleanup of the premises.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed will be determined during negotiation by April 1, 2015. The completion date will be extended by the number of calendar days after the above date that the contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

52.211-12 Liquidated Damages—Construction (Sep 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of: See Special Contract Requirements, Subsection 108.04.

(b) If the Government terminates the Contractor’s right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

52.211-13 Time Extension (Sep 2000)

Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.

52.211-18 Variation in Estimated Quantity (Apr 1984)

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract.

Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.

Section 559. — WATERPROOFING

559.02 Add the following:

Membrane Aggregate Top Coat 702.05(g)

Construction Requirements

559.03A Aggregate Covered Membrane. Add the following Subsection:

Prepare concrete surface to receive aggregate covered membrane in accordance with manufacturer’s recommendations.

Install pourable concrete joint seals at the bridge deck joint locations and details shown in the plans prior to applying the membrane system. Install joint seals per the manufacturer’s recommendations. Install joint seals in one continuous piece.

Apply membrane system according to manufacturer’s recommendations. Apply membrane system to concrete slabs at designated locations. Apply in dry weather when temperature is above 10°F.

Use slow setting membrane system to allow for aggregate to be broadcast into the membrane before initial set. Immediately apply aggregate in a uniform manner to provide an even texture and appearance. Remove excess aggregate after initial set. Place aggregate in a manner to allow for traffic to run directly on aggregate membrane surface temporarily prior to construction of the roadway section.

Protect surfaces of nearby objects to prevent overspray or spattering from membrane application.

Remove and dispose of any material used as a protective covering. Clean and remove any membrane overspray.

559.06 Acceptance. Add the following:

Material for pourable joint seals will be evaluated under Subsections 106.02 and 106.03.

Installation of pourable joint seals will be evaluated under Subsections 106.02 and 106.04.

Measurement

559.07 Add the following:

Do not measure pourable joint seals for payment.

Section 559. — WATERPROOFING

Delete this Section and substitute the following:

Description

559.01 This work consists of furnishing, preparing, and applying, in accordance with this specification and manufacturer’s recommendations a concrete surface sealer on the concrete decks of bridges as shown.

Material

559.02 Conform to the following Section and Subsections:

Sealer for Concrete Surface High Molecular Weight

Methacrylate (HMWM)

Construction Requirements

559.03 Seal Concrete Surface.

(a) General.

Do not permit debris and sealing material to enter the waterway. Select application methods or construct adequate containment to prevent debris and sealing material from entering the waterway. Plug all deck drainages, openings, and cracks prior to surface preparation and application operations.

Submit a specific operation plan including the following information. Allow 7 working days for review and approval. If the submittal must be resubmitted the time for acceptance starts over.

(1) Materials. List the materials proposed for use. Provide manufacturer’s literature including recommended surface preparation, application procedure, and material handling and storage precautions, including a product material safety data sheet (MSDS) and a spill prevention and clean-up plan.

(2) Surface preparation plan. Provide a detailed description of the surface preparation method to be used. Include a description of equipment, materials, and proposed dates, traffic control, staging, and any other information necessary to control the work. Provide documentation that the plan has been reviewed and approved by the manufacturers.

(3) Sealer placement plan. Include a list of the materials, equipment, procedures, and minimum and maximum air and deck surface temperatures.

(4) Personnel qualifications. Provide a list of proposed personnel and their qualifications to do this work. Key personnel must be able to demonstrate experience in application of the sealer or a similar product.

Special Contract Requirements Project: MT PRA GLAC 10(40), Going-to-the-Sun Road Rehabilitation Rising Sun to St.

Mary, Phase 13

(b) Deck cleaning procedure. Remove the existing asphalt concrete wearing surface and aggregate base prior to placing the sealer. Take care not to damage the stone curbing.

Thoroughly clean the entire surface of the existing concrete deck by blast cleaning (sand or shot blast). Ensure cleaning debris does not enter creeks or waterways. Care shall be taken while cleaning that all dirt is removed. Do not damage the concrete surfaces. Remove all traces of laitance, grease, dirt, dust, oil, asphalt, paint, or other foreign materials which may prevent penetration.

Prepare the deck surface so that it is smooth and free of voids, sharp projections, form release agents, concrete curing agents, and other contaminants.

Install erosion control devices/sandbags as necessary to ensure that no materials are directly discharged into streams.

Dispose of all removed materials according to Subsection 203.05.

(c) Surface preparation. The surface shall be dry and be vacuum cleaned to remove loose particles immediately before the sealer is applied. If the concrete is subjected to rain or moisture, the surface shall be allowed to air dry for a minimum of 24 hours before the sealer is applied. In the early morning before noon the CO may direct a waiting period for drying by the sun on the surfaces to be sealed.

If the surfaces are not sealed within 7 calendar days after the blast cleaning, the CO, due to debris, may direct a pressure wash, air dry for a minimum of 24 hours and then vacuum clean of the total or partial surface to be sealed at the Contractor’s expense.

All surface preparation work shall be completed and approved by the CO, before sealer application can commence.

(d) Weather limitations. Sealer materials shall not be applied during wet weather conditions, or if adverse weather conditions are anticipated within 4 hours of the completion of sealer application, or if rain has fallen within a period of 24 hours prior to application.

Ambient and surface temperatures shall be between 40º and 90º F per the manufacturer’s recommendations at the time of application and until the sealed concrete is dry to the touch.

(e) Sealer application. Plug all deck drains and scuppers to prevent sealer from flowing off the bridge. Do not use sand dikes to divert sealer from deck drains and scuppers. Collect and dispose all excess sealer material properly.

The sealer shall be used as supplied by the manufacturer without the use of any thinning alterations, or additives unless specifically required in the manufacturer's instructions.

Thorough mixing of the sealer before and during its use shall be accomplished as recommended by the manufacturer. The CO will view any mixing of all materials. The equipment for all sealing operations will be clean of foreign materials and in good working order for the application rate.

F-23c

Project: MT PRA GLAC 10(40), Going-to-the-Sun Road Rehabilitation Rising Sun to St. Mary, Phase 13

Apply sealer on the top surface of the bridge decks to the limits shown on the plans.

Care shall be taken to ensure that the entire surface of the concrete is covered and all pores filled.

Mix and apply the resin to the deck at a rate recommended by the manufacturer; but not less than 2.5 to 3.5 square meters per liter (11.3 to 15.9 square yards per gallon). Sweep excess resin to untreated areas not less than 10 minutes or more than 20 minutes after the initial application in order to avoid puddle formation. Keep all cracks which are visible to the eye constantly filled for 30 minutes after initial application by using brooms, brushes, or squeegees to refill them.

Hand broadcast dry (less than 0.5 percent moisture) silica sand on the treated area to obtain a uniform coverage of 0.5 kg per square meter (0.9 lb per square yard). Apply the sand before the resin gels. Sand shall be graded such that 100 percent passes a 2.00 millimeter (no. 10) sieve and not less than 98 percent is retained on a 1.00 millimeter (no. 18) sieve.

Do not allow any vehicle or pedestrian traffic on the deck surface until HMWM has fully cured. After HMWM has attained full cure, vacuum or sweep excess sand from deck and curb surfaces. No artificial means to accelerate the drying of the sealer shall be allowed.

Acceptance

559.04 Material for concrete sealer will be evaluated under Subsections 106.02 and

106.03. Preparation of the surfaces to be sealed and the sealant work as completed will be evaluated under Subsection 106.02.

Concrete bridge deck surface preparation will be evaluated under Subsections 106.02 and 106.04. See Table 559-1 for minimum sampling and testing requirements. Materials for membrane waterproofing will be evaluated under Subsection 106.03.
