SAFEGUARDING

"CONTROLLED UNCLASSIFIED

INFORMATION" (CUI) INFORMATION

1. The “CUI” marking is assigned to controlled unclassified information at the time of its creation in a DOD User Agency. It replaces the “FOR OFFICIAL USE ONLY” or “FOUO” marking for controlled unclassified information. It is not authorized as a substitute to a security classification marking but it is used to protect official Government Information withheld from the public until a review by the cognizant security authority determines it may be released to the public.

2. Other non-security markings such as “Limited Official Use” and “Official Use Only” are used by non-DOD User Agencies for the same type of information and should be safeguarded and handled in accordance with instructions received from such agencies.

3. Use of the above markings does not mean that the information cannot be released to the public, only that it must be reviewed by the Government prior to its release, to determine whether a significant and legitimate Government purpose is served by withholding the information portions of it.

4. IDENTIFICATION MARKINGS :

a. An unclassified document containing CUI information will be marked "CUI" at the bottom of the front cover (if any), on the first page, on each page containing CUI information, on the back page, and on the outside of the back cover (if any).No portion marking will be shown.

b. Within a classified document, an individual page that contains CUI and classified information will be marked at the top and bottom with the highest security classification appearing on the page. If an individual portion contains CUI information but no classified information, the portion will be marked CUI.

c. Any document, image, slide deck, presentation, etc., containing CUI will have a CUI designation indicator on the front cover, or front page. The designation indicator will contain the following information appended to the lower right-hand corner of the document prior to transfer:

d. Removal of the "CUI" marking can only be accomplished by the originator or other competent authority. When CUI status is terminated, all known holders will be notified to the extent possible.

5. DISSEMINATION: Contractors may disseminate CUI to their employees and subcontractors who have a need for the information in connection with a contract.

6. STORAGE: During working hours CUI shall be placed in an out-of-sight location if the work area is accessible to persons who do not have a need for the information.

During non-working hours, the information shall be stored to preclude unauthorized access. Filing such material with other unclassified records in unlocked files or desks is adequate when internal building security is provided during non-working hours. When such internal security control is not exercised, locked buildings or rooms will provide adequate after hours protection or the material can be stored in locked receptacles such as file cabinets, desks or book cases.

7. TRANSMISSION: CUI may be sent via first-class mail or parcel post, bulky shipments may be sent fourth-class mail.

8. Legacy “FOR OFFICIAL USE ONLY” or “FOUO” information will be protected as in the same manner as CUI.

9. CONTRACTOR OWNED IT SYSTEMS: The NIST SP 800-171 identifies the baseline CUI system security requirements for industry established by Part 2002 of Title 32, CFR. Additionally, Section 252.204-7012 of the DFARS specifies a waiver process for defense contractors in accordance with NIST SP 800-171 for contractor IT or networks.

10. AGGREGATION AND COMPILATION: Contractors must monitor CUI for aggregation and compilation based on the potential to generate classified information pursuant to security classification guidance addressing the accumulation of unclassified data or information. The DoD requires contractors to report the potential classification of aggregated or compiled CUI to a DoD representative.

text: This contract vehicle includes a requirement for each Contract company to hold a facility clearance at the Secret level or higher. All work requiring access to classified information will be at the Government's facility. The contractor shall provide subcontractor DD Form 254s at the base contract and Task Order (TO) levels. The Contract Officer Representative (COR) will be identified in the TO DD254 and be required to sign block 13. Also refer to Army Regulation 380-67, Personnel Security Program, for applicability if contractor personnel require access to sensitive compartmented information in the performance of their duties. The security requirements are in accordance with the attached DD Form 254, Department of Defense Contract Security Classification Specification. Internet site https://www.dcsa.mil/mc/ctp/fc/ contains a complete booklet with instructions on how to prepare and submit a DD Form 254 to obtain security clearances of Secret or higher. If a security clearance is required, interim coverage may be obtained from the Department of Defense. Further instructions can be found at the DSS website: http://www.dss.mil/isp/tools.html

All contractor personnel security clearance (PCL) actions will be processed through the home office Facility Security Officer (FSO). All contract employees will be US citizens. All contract employees who require access to classified information will have current eligibility of SECRET or higher, Non-SCI access of SECRET and NATO SECRET- for SIPRNET access only. Interim secret clearances are not authorized SIPRNeT access on Fort Leavenworth, KS.

Visitor Group Security Agreement (VGSA) between Contractor & USACAC, Fort Leavenworth, KS, applies.

“The COR has reviewed this Security Specification and certifies the requirements are complete and adequate for performance of the contract. The COR understands the provisions and will ensure that it is complied with within the limits of his/her responsibility, and that any violations are brought to the attention of the Contracting Officer."

8a. The work is to be performed at Government facilities at Fort Leavenworth, and other locations as delineated on individual TOs, with the potential to travel to various other sites inside and outside the continental United States (CONUS/OCONUS)

10g. Personnel not assigned to a NATO staff position, but requiring access to NATO classified information, NATO Secret or access to the NATO accredited SIPRNET terminals, must possess the equivalent FINAL or Interim U.S. Security Clearance based upon the appropriate personnel security investigation required. A designated representative from the TRAC Security Office will ensure required employees are NATO briefed prior to access being granted. The contractor will maintain strict compliance in regards to NATO information IAW NISPOM, Chapter 10, Section 7. Written concurrence from the Contracting Officer (KO) is required prior to subcontracting NATO.

10h: Foreign Government Information (FGI) is not releasable to contractor employees who have not received a FINAL clearance at the .appropriate security level. Access to Foreign Government Information (FGI) will be granted on a case-by-case basis approved by the KO or government activity security manager. Written concurrence of the KO is required prior to subcontract.

10j: "Controlled Unclassified Information generated and/or provided under this contract shall be safeguarded and marked as specified in DoDI 5200-48. For Official Use Only (FOUO) Information generated and/or provided under this contract shall be safeguarded as specified in DoDD 5400.07 (DoD Freedom of Information Act Program) and marked as specified in DoDM 5200.01, (Information Security Program, Marking of Information), Vol. 2, AR 380-5 or AR 25-55."(See Addendum #1)

10k: This contract requires access to Non-Classified Internet Protocol Router Network (NIPRNet) and Secure Internet Protocol Router Network (SIPRNet) networks to perform this contract. All contract personnel shall complete Information Assurance/Cyber Awareness Challenge training at the start of the contract and annually thereafter. Contract personnel shall complete a NIPRNet Computer-User Agreement, SIPRNet Computer User Agreement or both, if required. Once training and user agreement forms have been completed, a DD Form 2875, System Authorization Access Request (SAAR), will be provided by the COR or Government Program Manager to the contractor. The government activity Information Assurance Manager (ISM) and security manger must approve the DD2875 prior to network access.

10k: NIPRNet - Contract personnel must have a TIER 1 or equivalent/higher level background investigation initiated, a favorable fingerprint check with the Federal Bureau of Investigation and be issued a Common Access Card (CAC) prior to access the NIPRNet. At the discretion of the sponsoring activity, an initial CAC may be issued based on a favorable review of the FBI fingerprint check and a successfully scheduled NACI at the Office of Personnel Management.

10k: SIPRNet - Contract personnel must have a FINAL TIER 3 or equivalent/higher level clearance to access SIPRNet. Contract personnel are not authorized to access, download or further disseminate any classified information from SIPRNet which is outside the scope of the defined contract requirements unless specifically authorized in writing by the Government Program Manager and the KO. Due to the large volume of NATO materials contained within the SIPRNet, access authorization at the NATO SECRET level and a NATO Security Briefing are required. The Facility Security Officer (FSO) will provide NATO briefings to cleared contract personnel requiring access to NATO Information IAW DoDM 5220.22-M, National Industrial Security Program Operating Manual and post NATO SECRET access in the Joint Personnel Adjudication System (JPAS) for indoctrinated contract personnel.

11a: Contractor performance is restricted to CAC facilities at Fort Leavenworth and other locations in the Continental United States (CONUS) and Outside CONUS (OCONUS) in support of CAC missions. The Government Requiring Activity will provide security classification guidance for performance of this contract. The contractor will submit visit requests to the Security Management Office for need-to-know verification.

11f: Overseas performance will take place in various countries as outlined in applicable Task Orders (TO).

11l: All materials generated by the contractor will be derivatively classified and the classification levels will be reviewed by the KO/COR or government activity security manager. Classified materials received or generated in the performance of this contract are the property of the US Government and will be returned to the government upon completion of the contract.

11l: Contract personnel will complete annual regulatory security training to include Information Security Program, Managing Personnel with Security Clearances (if applicable), Foreign Disclosure (FD), Derivative Classification, Controlled Unclassified Information (CUI) and Threat Awareness and Reporting Program (TARP) training. Contract personnel must receive annual TARP training by a counter-intelligence (CI) agent or other trainer as specified in AR 381-12. All subcontract personnel are also required to attend TARP training per requirements in AR 381-12. The contractor will provide contract personnel's training certificates to the government activity security manager.
