a. This contract is referred to as the Republic of Korea Regional Hazardous/Designated Waste Disposal Contract. It specifies requirements for the removal, transportation, and disposal (or recycling) of wastes generated by the United States Government (USG) Department of Defense (DoD) classified as designated waste (DW) under current Korean Environmental Governing Standards (KEGS) and regulated by the Republic of Korea (ROK) Ministry of Environment (MOE), non-designated/non-regulated wastes, hazardous materials (HM) and hazardous wastes (HW) regulated by the United States Environmental Protection Agency (EPA) located in or around United States Forces Korea (USFK) military installations and activities within the territories of the South Korean Peninsula, i.e., ROK, including U.S.

controlled contingency locations and other pickup locations currently listed or not currently listed on this contract at the time of award. Current pickup locations for waste removals and other required services are identified in Attachment 4 of the contract. Infectious/biohazardous medical waste, ammunitions, explosives, controlled pharmaceuticals, and radioactive wastes will not be turned in for removal under this contract.

For purposes of this contract, Designated Waste (DW) is synonymous with the term Hazardous Waste (HW). USFK HW will be identified as DW upon leaving the USG DoD installation or activity boundary for disposal at a ROK waste disposal facility.

The USFK KEGS regulations may be located at:

https://www.usfk.mil/Portals/105/Documents/Publications/Regulations/USFK-Reg-201- 1-Korean-Environmental-Governing-Standards-2020.pdf

This regulation provides specific criteria and management practices for environmental protection on USFK installations. The Contractor shall always be responsible for maintaining complete compliance with all subsequent and official updates made to these regulations.

b. The Contractor agrees to provide all services necessary for the final recycling, treatment, and/or disposal of the materials listed in the Price Schedule of this contract in accordance with (IAW) the KEGS and respective national and local environmental laws and regulations, as well as any applicable international agreements governing the transportation of dangerous goods and the terms and conditions of this contract. This includes ensuring all vehicles transporting materials subject to this contract are properly placarded IAW applicable Korean transportation laws and requirements. These services shall include all necessary Contractor personnel and subcontractor (henceforth referred to as “joint venture partner”) personnel labor, sampling and analysis, transportation, packaging, equipment, and compilation and submission of all documentation pertaining to include inspecting, packaging, marking, labeling, loading, unloading, removal, transportation, disposal, and recycling of materials subject to this contract from DoD/USFK installations and activities throughout the ROK.

c. Definitions of terms used in this Performance Work Statement (PWS) are provided in Attachment 2. A list of Acronyms used in the PWS are provided in Attachment 3.

d. All materials/wastes subject to this contract must be identified and transported IAW https://www.usfk.mil/Portals/105/Documents/Publications/Regulations/USFK-Reg-201-1-Korean-Environmental-Governing-Standards-2020.pdf https://www.usfk.mil/Portals/105/Documents/Publications/Regulations/USFK-Reg-201-1-Korean-Environmental-Governing-Standards-2020.pdf

Korean transportation and safety standards and/or those indicated in the Globally Harmonized System (GHS). All items turned in under this contract, regardless of condition, are being discarded by the USG as waste for disposal or recycling.

e. The standard performance time for the removal of all wastes at all pickup locations is 20 business days from the date of Task Order (TO) issuance, except when expedited removal/service CLINs are ordered. Refer to Section 1.2.11 for expedited removals/services.

The Contractor agrees that for those portions of the services provided on a USG installation, services will be provided during the core hours for the specified facility. Typical core working hours are 0730-1600 hours, Monday through Friday and do not apply to U.S. Federal and Korean Public holidays. Hours of operation for specific installations and facilities may be obtained from the DLA Disposition Services Gimcheon. A schedule of U.S. Federal holidays and Korean Public holidays is presented in Section 1.1.8. The current primary pickup locations are listed in Attachment 4.

f. This contract is a firm-fixed price indefinite delivery/indefinite quantity (IDIQ) contract written as a performance-based contract.

g. This contract consists of one (1) 30-month Base Period, followed by one (1) 30-month Option Period.

h. The six-character disposal Contract Line Item Number (CLIN) consists of two parts.

The term “Base CLIN” refers to the first four characters of the CLIN. The Base CLIN represents the waste description according to the waste profile for a particular waste stream.

The term “CLIN Suffix” refers to the last two characters of the CLIN. The CLIN Suffix designates the unit of measure for purposes of tracking and Contractor payment. Example: Base CLIN “CS01” represents Corrosive Acids, Inorganic other than HF and HNO3, <50% in Water, and the CLIN Suffix “C4” designates the unit of issue as a 55-Gallon Container. Accordingly, one (1) 55-gallon drum of this waste would be represented by ordering one (1) Each of CLIN CS01C4. General information regarding Profile Based CLINs may be found at:

http://www.dla.mil/DispositionServices/Offers/Disposal/HazardousWaste/HazWasteDisposal.a spx.

i. CLIN pricing for specified waste streams as awarded and reflected in the contract Price Schedule shall be for the complete removal, transportation, and final disposal or recycling of the waste for which the CLIN was ordered on the Task Order. Transportation shall include the removal of the waste from any pickup location in ROK, including all U.S. DoD/USFK military bases and activities, and delivered to the final treatment, storage, and disposal facility (TSDF) or recycling facility. New pickup locations may be unilaterally added to the contract by the USG at any time during the life of the contract at no additional charges to the USG.

Disposal shall include all pre-disposal treatment, such as physical, chemical, or thermal treatment, and ultimate disposal of all wastes and treatment residues at a qualified TSDF as defined below. Recycling shall consist of the partial or complete conversion of waste into reusable energy or materials.

j. Some CLINs ordered under this contract require the Contractor to provide a http://www.dla.mil/DispositionServices/Offers/Disposal/HazardousWaste/HazWasteDisposal.aspx

Certificate of Destruction or Disposal (CD), e.g., some polychlorinated biphenyls (PCBs), demilitarization-required items, Aqueous Film-Forming Foam (AFFF)/ Polyfluorinated Alkyl Substances (PFAS), etc. The Contractor is cautioned to closely read all CLIN descriptions where such requirements are indicated. Unless explicitly written elsewhere in this PWS, the Contractor must only provide a CD when so reflected in the Price Schedule CLIN description and IAW Section 2.1.

k. Publications and attachments applicable to this contract will be made available upon request. During the solicitation and life of this contract, the USG may make requirement changes, additions, and/or deletions to those initially identified.

l. When turning in containerized waste for removal by the Contractor, Generators shall utilize containers meeting United Nations (UN) specifications, KEGS, and applicable ROK transportation laws and regulations for the storage and transportation of HW/DW on and off the installation. The Contractor shall ensure containers and packaging meet ROK transportation laws and regulations prior to removal of DW from the USG installation or activity.

m. Minimum Task Order charges under this contract will be two thousand United States dollars ($2,000.00) except when minimum Task Order charges do not apply, i.e., those Task Orders in which the following services have been ordered: general support services, expedited removal services, expedited performance services, industrial cleaning services, sampling and analysis services, lab packing services, repackaging/loose packing services, provision of supplies, and rental equipment services.

n. Required time frames for Contractor performance of services including waste removal are expressed in business days. For timekeeping purposes in the performance of services, the day in which the Task Order (TO) is issued to the Contractor will constitute “Day 0” (zero), and the following business day will constitute “Day 1”. All business days thereafter, whether in whole or in part, will constitute one (1) day for timekeeping purposes. A business day will be defined as any day in which normal business is conducted. It does not include weekends, U.S. federal holidays, ROK public holidays, or other days in which the Contractor is denied installation access due to force protection or other conditions.

o. For purposes of this Contract, the term Treatment, Storage, and Disposal Facility (TSDF) refers to a commercial waste management facility and/or commercial recycling facility listed on the DLA Qualified Facility List. Per KEGS 6-2.n., a Hazardous Waste Storage Area (HWSA) refers to one or more locations on a USFK installation where HW is collected prior to shipment for treatment or disposal. A HWSA may store more than 55 gallons of a HW stream and more than one quart (0.95 liter) of an acute HW stream. Per KEGS 6-2.h., a Hazardous Waste Accumulation Point (HWAP) refers to a shop, site, or other work center where hazardous wastes are accumulated until removed to a Hazardous Waste Storage Area (HWSA) or shipped for treatment or disposal. A HWAP may be used to accumulate no more than 208 liters (55 gallons) of hazardous waste, or one quart (0.95 liter) of acute hazardous waste, from each waste stream. The HWAP must be at or near the point of generation and under the control of the operator.

p. The Contracting Officer's Representative (COR) is a USG representative designated by the KO and is authorized in writing to perform specific technical or administrative functions.

The Contractor will receive a copy of the written COR designation. It will specify the extent of the COR's authority to act on behalf of the KO. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

1.0 REMOVAL PHASES

The requirements for removal of wastes under this contract are divided into three main phases:

Pre-Removal (1.1), Removal (1.2), and Post-Removal (1.3). The Contractor and their Representative must always perform in a prudent, conscientious, safe, and professional manner.

The Contractor shall ensure that its agents, employees, and representatives involved in handling and packaging the hazardous waste be trained for the level of expertise required for the proper performance of the task and in the areas of chemical incompatibility, general first aid procedures, and spills. The Contractor shall provide Material Handling Equipment (MHE) and Personal Protective Equipment (PPE), unless otherwise stated. The MHE and PPE must be appropriate to safely handle the hazardous waste to include meeting any additional military installation specific requirements. The Contractor agrees that all personnel and equipment used in the performance of this contract are subject to safety inspections by USG personnel while on federal property.

1.1 PRE-REMOVAL

The Contractor has the option to perform a pre-removal inspection of all waste containers at least five (5) business days prior to the day of the removal. Any discrepancies associated with the marking and/or labeling of containers as described in Section. 1.2.3, shall be corrected during the pre-removal inspection. If not corrected, discrepancies shall be reported to the COR for resolution. See Section 1.1.1.1 for CLIN disputes.

1.1.1 CLIN SELECTION CRITERIA

CLINs are assigned to waste streams by the USG and are designed around EPA regulations, treatment, and disposal technology standards. U.S. Department of Transportation (DOT) regulations, including Proper Shipping Name (PSN) and Hazard Class are not a basis for CLIN selection. The waste description, generation process, physical state, and EPA Waste Code(s) are the primary considerations for CLIN selection. CLIN selection begins with the identification of a Base CLIN category and sequence number. It is selected if available from the Price Schedule and is completed with the assignment of a CLIN Suffix to identify the turn-in and billable unit of issue.

a. Base CLIN categories and their descriptions used for waste disposal CLINs under this contract are as follows:

(1) Batteries (BA) – Used for all battery types. Managed on USG installations as

Non-Hazardous Waste (NHW), Hazardous Waste (HW), or Universal Waste (UW), as applicable under US EPA laws and regulations. Managed by the Contractor as

Designated Waste (DW) upon removal from the installation where applicable ROK Waste Codes are assigned.

(2) Corrosives (CS) – Used for all corrosive wastes meeting the US EPA definition of corrosive and carrying the US EPA Waste Code D002, unless it is a Lab Pack/Loose Pack, or unless the waste is concurrently assigned a D001 (ignitable) or D003 (reactive) Waste Code. Managed on USG installations as HW as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) upon removal from the installation where applicable ROK Waste Codes are assigned. Some corrosive acid oxidizers may carry the D001 Waste Code and be assigned a CS CLIN.

(3) Compressed Gas Cylinders/Cartridges (CY) – Used for all types of compressed gas cylinders, vessels, canisters, and cartridges. Base CLINs are assigned based on the specific chemical name of the gas or gases comprising the contents of the cylinder, vessel, or canister. Cartridges are assigned Base CLINs based on whether the gas is flammable or inert. Managed on USG installations as HW or NHW as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) upon removal from the installation where applicable ROK Waste Codes are assigned.

(4) Flammable/Combustible/Ignitable (FL) – Used for all ignitable and other than reactive or corrosive oxidizers carrying the D001 Waste Code, unless it is a Lab Pack or Loose Pack, or unless the waste is concurrently assigned a D003 (reactive) Waste Code. FL CLINs may also be assigned to waste streams not carrying the D001 Waste Code but containing flammable or combustible constituents such as Petroleum Oils and Lubricants (POL), organic solvents or chemicals. Managed on USG installations as HW or NHW as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) upon removal from the installation where applicable ROK

(5) Lab Packs/Loose Packs (LP) – Used for most overpacked small containers of chemicals and consumer commodity-type products. “Lab Pack” refers predominantly to the overpacking of multiple containers of like laboratory chemicals into a single outer container. The chemicals must be of the same KEGS/ROK hazard class and a detailed inventory must be affixed to the outer container. Lab packing is a packaging method performed by the Contractor (or joint venture partner) under a separate service CLIN.

“Loose Pack” refers predominantly to the overpacking of multiple containers of like consumer commodity products (e.g., paints, lubricants, expired products, etc.) into a single outer container and does not require the preparation of a detailed inventory.

Generators of this waste may be authorized to loose-pack containers for turn-in. Lab-packed and loose-packed drums and boxes containing smaller containers of same type wastes provide the best alternative when consolidation is impractical. For purposes of disposal, Lab Packs and Loose Packs share the same Base CLIN depending upon the contents of the inner containers and their assigned EPA Waste Code(s) when applicable.

Managed on USG installations as HW or NHW as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) if applicable upon removal from the installation where applicable ROK Waste Codes are assigned.

(6) Non-RCRA, Non-State and State-Regulated (NR) – Managed on USG installations as Non-Hazardous Waste (NHW) as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) or non-Designated Waste, as applicable, upon removal from the installation and where applicable ROK

(7) PCB-Related (PC) – Used for all wastes containing or contaminated by a source of PCBs. Managed on USG installations as a toxic substance under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) upon removal from the installation where applicable ROK Waste Codes are assigned.

(8) PFAS-Related (PF) – Used for various wastes containing or contaminated by a source of per- and PFAS including some AFFF wastes. Managed on USG installations as a toxic substance under US EPA laws and regulations. Managed by the Contractor as non-Designated Waste or Designated Waste (DW) as applicable, upon removal from the installation where applicable ROK Waste Codes are assigned.

(9) Recycle/Recovery (RE) – Used for various wastes that require by contract and/or regulation the recycling/recovery of constituents and/or components contained in the waste stream, including some lamps and mercury-containing devices. When “RE” CLINs are ordered, the Contractor is required to recycle/recover the waste under which the CLIN was ordered or notify the KO when recycling services are unavailable and receive written permission from the KO to dispose of property (see 1.1.1.g).

(10) Reactive (RX) – Used for various reactive wastes bearing the D003 EPA

Waste Code or potentially bearing reactive characteristics. Managed on USG installations as HW as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) upon removal from the installation where applicable ROK Waste Codes are assigned.

(11) Toxic (TX) – Used for various toxic wastes that are not ignitable, corrosive, or reactive wastes bearing the D001, D002, or D003 EPA Waste Codes, respectively, apart from hexavalent chromium (Cr+6) related waste bearing the D001 Waste Code exclusively due to the oxidizing properties of Cr+6. Managed on USG installations as HW as applicable under US EPA laws and regulations. Managed by the Contractor as Designated Waste (DW) upon removal from the installation where applicable ROK

b. Base CLIN selection criteria is further based upon information found in the waste profile sheet to include the waste description, physical state of the waste, and the presence of assigned EPA Waste Code(s). Every Base CLIN offered to Generators for use in the Price Schedule has corresponding permissible EPA Waste Code(s), unless the CLIN is for non-EPA regulated waste. “Permissible EPA Waste Codes” does not imply that any or all those waste codes so listed will apply, but that no other EPA Waste Code(s) are allowed to be carried for the waste under the assigned CLIN. Furthermore, the term “Listed" for purposes of this contract does not imply that all EPA Listed (F, K, P, and U) Waste Codes may apply. The USG will ensure that all wastes being turned in for removal will carry the applicable EPA Waste Code(s) for management of waste on the DoD installation/activity.

c. CLINs in the contract Price Schedule also identify Possible ROK Waste Code(s) for most CLINs. Possible ROK Waste Code(s) are provided as a good faith attempt by the USG to inform the Contractor of possible regulatory considerations. However, USG shall not be held responsible for misrepresentation of Host Nation regulations. The Contractor will ensure that all wastes being removed from the DoD/USFK installation/activity for treatment, disposal, or recycling will carry the proper ROK Waste Code(s) on the shipping manifest and all other related documents, container labels, and markings as required under applicable ROK regulations.

The USG is responsible for assigning proper profile-based CLINs to every waste stream being turned-in for removal. A Master Disposal and Recycling CLIN Catalog with Permissible EPA Waste Codes and Possible ROK Waste Codes is provided as Attachment 6 of this contract.

d. Some waste streams may fit under more than one CLIN. A Base CLIN is generally authorized for use by the USG when the subject waste meets the waste description, physical state, and permissible EPA Waste Codes, as specified for that CLIN in the contract. Base CLINs will be selected using the following Waste Codes and other descriptions as the order of precedence:

(1) PCB-Related, Containing or Contaminated by a Source >2 ppm

(2) Reactive (D003)

(3) Ignitable/Oxidizer (D001), other than Cr+6 related waste bearing the D001 Waste Code exclusively due to the oxidizing properties of Cr+6.

(4) Corrosive (D002)

(5) Toxic (D004-D043 and any additional D-Codes newly established by EPA)

(6) Acutely Hazardous (P-Listed)

(7) Leachate (F039)

(8) Electroplating-Related (F006-F012, F019)

g. Recycle/Recovery Base CLINs beginning with “RE” are designated for mandatory recycling/recovery by the USG. If the Contractor asserts that a waste designated for recycling cannot be recycled because it does not meet the required recycling parameters:

(1) The Contractor must notify the KO in writing of the rationale and proof for waste rejection at least five (5) business days before pickup. This must include written input from at least two recycling facilities listed on the Qualified Facilities List (QFL), at least one of which is not owned by the Contractor.

(2) The KO will notify the COR to resolve requests to change the assigned mandatory recycling CLIN to the appropriate disposal CLIN. The final decision to change a mandatory recycling CLIN to a disposal CLIN is solely that of the USG. If the USG agrees with the CLIN change, the applicable disposal CLIN will be assigned.

FUEL SUBSTITUTION: Unless expressly prohibited by KEGS/ROK regulations, fuel substitution to include blending will meet the recycling/recovery requirements for wastes with a minimum energy value of 2,500 BTUs/Lb, including wastes containing solvents, paints, antifreeze, and used oil.

1.1.1.1 CLIN DISPUTES

a. CLIN discrepancies noted on a TO during a pre-removal inspection and/or during removal by the Contractor will be addressed immediately via the COR and the Generator. If the COR, Generator, and KO concur with the CLIN change request, a TO Modification will be issued.

b. If the Contractor asserts after removal that an inappropriate CLIN has been assigned, the burden of proof lies with the Contractor. The Contractor must provide documentation electronically to the KO and COR within 15 business days from the Treatment, Storage, and Disposal Facility (TSDF) receipt date supporting the assertion through independently acquired laboratory analysis at the Contractor’s expense, TSDF fingerprinting results, Photographs, Safety Data Sheet, and/or other written supporting documentation such as a TSDF “off-spec” notification and explanation for the off-spec determination. Requests for a CLIN change without supporting documents will not be accepted. After review of the documentation, the Contractor will be notified by the KO of the USG’s final determination.

c. The Contractor must ensure that the waste in question is not treated or disposed of until the USG has made a final CLIN determination. If the subject waste has been treated and/or disposed of prior to the USG’s final determination, the Contractor will be deemed to have waived its objection to the CLIN assignment.

1.1.2 PERMIT/SPECIAL REQUIREMENTS

a. The Contractor shall, without additional expense to the USG, be responsible for paying all fees, preparing, or obtaining any necessary licenses, permits, customs notifications (if applicable), other notifications, waste profiles, and/or reports, which result from a Contractor's transportation, recycling, or disposal decision. This includes acquiring any required permits or registrations necessary to operate on any installation. This includes signing (on behalf of the USG) waste profiles required by Treatment, Storage, and Disposal Facilities (TSDF), which includes recycling facilities.
