Engineering Services DRAFT

Performance Work Statement (PWS) In support of:

Lubricator Assembly, CIWS MK15 / MK7

NSN 1285-01-198-3925

P/N: 5191506

1. Introduction

The purpose of this Performance Work Statement (PWS) is to develop a repair procedure and all associated technical data for the Close-In Weapon System (CIWS) MK15 / MK7 Lubricator Assembly and qualify a source of supply as an approved repair facility or Designated Overhaul Point (DOP) to perform the developed and approved overhauled procedures. A complete, competitive Technical Data Package (TDP) will be the primary deliverable and will consist of all drawings, obsolescence analysis, schematics, Bill of Materials (BOM), test procedures, diagrams and specifications required to return components to Ready for Issue condition. Repair procedures will utilize available, non-proprietary process specifications. The design and repair process will be qualified in accordance with NAVSEA requirements.

2. Documents

Government Manuals shall be provided and will include:

· SW221-B2-MMO-040 - (CIWS) MK 15 MODS 21, 22, 25-28, Phalanx Block 1B Baseline 2 Illustrated Parts Data

· SW221-GM-MMI-010 - (CIWS) MK 15; Gun and Ammunition Handling System, Block 1; Intermediate Maintenance With Illustrated Parts Data

Assembly level drawing and component level drawings and parts list are available in Naval Ships Engineering Drawing Repository (NSEDR). Distribution statements on available technical data will be DISTRIBUTION STATEMENT D: DISTRIBUTION AUTHORIZED TO THE DEPARTMENT OF DEFENSE (DOD) AND U.S. DOD CONTRACTORS ONLY; ADMINISTRATIVE OR OPERATIONAL USE; (OCT 2015). OTHER REQUESTS SHALL BE REFERRED TO PEO IWS 11.0. Contractors must retain the authority required to receive and utilize the currently available technical data.

3. Requirements

All products developed under this contract shall be considered Government work and shall have no license encumbrances. All data shall be developed and provided in accordance with the data right clauses in the contract and as identified in this Agreement. Unless the Contractor has expressed a claim to providing data to the Government with less than unlimited data rights, the Government will assume unlimited data rights.

Under this PWS, the contractor shall perform all necessary activities to qualify the Lubricator Assembly, ID Sub-Components and Material, and ensure no obstacle exists, which prevent production of additional components. The Contractor shall ensure that the revised configuration resulting from this engineering project is backwards compatible with the existing configuration.

All deliverables shall be submitted electronically in Microsoft Word or Excel format (with the exception of the draft TDP). Duplicate delivery in Portable Document Format (PDF) format is also acceptable. The Contractor shall retain all analysis and solution data and artifacts developed under this task, in support of the contemplated buy with Nonrecurring Engineering (NRE) costs implementation task.

Technical Data delivered under this PWS will include a fully defined TDP, including Drawings, Parts Lists/BOMs, illustrated parts breakdowns or functional diagrams if necessary, a complete repair manual sufficient for competitive government repair contracts, and will have appropriate distribution statements.

Contractor performing under this PWS will ensure at least one source of repair/overhaul will be approved by appropriate Navy Technical Authority (TA). The approved source may be the contractor developing the technical data or in business with that contractor. Future awards for repair overhaul of the subject part number will be contracted to that approved overhaul source.

The Contractor shall invoke these same requirements with its Subcontractors or Vendors at any tier requiring the delivery of technical data, except contractual instruments for commercial items or commercial components. This shall include pre-notification of rights in data and shall ensure that Subcontractors and Vendors are required to provide the same depth of data that the prime is obligated to provide to the Government. Subcontractor or Vendor data may be provided directly to the Government if rights limitations preclude their being provided by the way of the prime Contractor. Any deviation in Subcontractor and Vendor data content must be approved by the Government procuring agency.

4.1. Status reports

The Contractor shall submit the Contractor’s Progress, Status, and Management Report in accordance with contract requirements.

4.2. Program Management Review (PMR)/Technical Interchange Meeting (TIM) The Contractor shall attend regular (quarterly) program management reviews, as required and approved by the Government Program Manager. The purpose of these meetings shall be to brief the progress of the project from a programmatic perspective and the progress of each assigned task. The Contractor shall solicit input and concurrence of work performed. The Contractor shall generate presentation materials as required to aid in the discussion of programmatic and technical issues. The Contractor shall provide conference agendas, meeting minutes, and track Action Items (AI) associated with the aforementioned meetings/reviews.

These reviews will be held virtually, or in person at the contractor’s facility or at a government facility depending on the status of the project and the nature of the meeting.

4.3. Program Management Plan (PMP)

The Contractor shall deliver a PMP following the requirements set forth in the overarching PWS. The Contractor shall include an Integrated Master Schedule (IMS) with their delivery of the PMP.

4.4. Integrated Master Schedule (IMS)

The IMS will initially be delivered with the PMP. Updates will be provided via Status Reports.

4.5. Reliability, Availability and Maintainability (RAM) Program Plan Contractor shall develop and deliver a RAM Program Plan. The Contractor shall report status of the RAM program at Design Reviews and TIM. The RAM Program Plan shall be in the Contractor’s format. The Plan shall identify and describe the planned Contractor activities for implementation of the RAM Plan up to and including Customer Design Review.

RAM Program shall include:

a)Monitoring and control of Subcontractors/Suppliers
b)Maintainability design criteria
c)Software design documentation as needed
d)Environmental Stress Screening as needed
e)Reliability Development Growth Testing as needed
f)R&M design review information (AoA, TIM)
g)Incorporating corrective actions into the design

4.7. Counterfeit Prevention Plan (CPP)

Contractors that supply electronic parts or systems that contain electronic parts shall share established policies and procedures to avoid, detect, mitigate and disposition counterfeit electronic parts to prevent such parts from entering the United Stated Air Force (USAF)/ DoD supply chain. These policies and procedures shall be documented in a CPP for Government review and approval. The Contractor shall provide appropriate training and shall require all personnel working procurement within their company, to include at a minimum their supply chain management specialists, receiving inspectors, and engineers, to complete said training. The Contractor shall determine the appropriate training required. Training may be developed in-house or may be other Industry accepted training. The CPP shall describe and list the training provided by the Contractor to their personnel.

4.8. Mil-Spec and Standards from/to list

The Contractor shall develop a Mil-Spec from/to list to ensure all military and commercial production standards are met. The list as a minimum shall provide relevant information regarding Original/Legacy Specifications and updated military revisions as well as the associated commercial specification (if it is no long a military specification).

4.9 Government Technical Representative

The Technical Point of Contact (TPOC) is responsible for monitoring, processing, and the overall technical management of the contractor’s performance of this contract and should be contacted regarding questions or problems of a technical nature.

5. Design

5.1. Candidate Solutions

The Contractor shall identify substitute candidate components/materials which meet all technical performance, and weapon system requirements. Candidate items shall be evaluated to determine future availability/sustainability. Availability is defined as available from the Original Equipment Manufacturers (OEM) approved manufacturers and shall not be based on available stock levels or availability from surplus material vendors. Test Equipment and tooling required for qualification and production shall be addressed. All required production documentation shall be addressed. Unavailable documentation shall be justified. All findings shall be compiled and delivered in a Candidate Solution Report.

5.2. Analysis of Alternatives (AoA)

The Contractor shall conduct an analysis of alternatives review, which can be held in conjunction with System Requirements Review (SRR). This review shall detail each possible solution path for obsolescence issues where multiple, significantly differing solutions exist. It shall establish a primary path and be reviewed at an associated TIM. The AoA shall address current known obsolescence, and shall also address parts that have projected obsolescence (i.e. lack of existing approved manufacturing sources). Based on the list of current and projected piece part obsolescence, the Contractor shall identify and evaluate proposed alternatives for long term sustainment. Equipment form, fit and function shall be maintained. The AoA Review will address testing requirements for implementation of the proposed solution(s). Testing requirements may include, but are not limited to, bench test, component test, sub-system level test, and system level test.

5.3. System Requirements Review (SRR)

The Contractor shall conduct a SRR, which can be conducted in conjunction with the AoA TIM, with Government participation at a location mutually agreed to by the Government. The SRR shall review requirements associated with system design changes and validate that system requirements are being met. The Contractor shall deliver a Conference Agenda prior to the SRR and Meeting Minutes following the SRR.

5.4. Design Reviews

5.4.1. Preliminary Design Review (PDR)

The Contractor shall conduct a PDR with Government participation at a location mutually agreed to by the Government. The Contractor shall present class determination for all piece part substitutions and design changes at the PDR. The Contractor shall close all PDR action items prior to entry into Critical Technical Design Review (CTDR). PDR planning and topics for discussion shall include, but not be limited to the following:

a)Verify cost, schedule, and performance are all accurate & executable
b)Brief deliverable status
c)Deliver agenda, distribute meeting materials, conduct meeting, assign and track action items, and develop and deliver minutes
d)Present class determination for all piece part substitutions and design changes
e)Brief way forward to show adequate processes are planned and metrics are in place
f)Ensure key players/proper technical resources are represented at the review
g)Brief logistics planning to include the assessment of the following elements: Architecture and logistics elements for manufacturability, testability, Reliability, Availability and Maintainability (RAM), supportability, Commercial-off-the-Shelf (COTS) and Diminishing Manufacturing Sources and Material Shortages (DMSMS)
h)Brief the status of Government Furnished Property (GFP)
i)Risk Register updated with any known or potential risks and associated risk handling strategies to execute the program within accepted risk profiles
j)Test and Evaluation Program Plan (TEPP) updated as necessary in preparation for review at PDR and updated and delivered after the PDR, incorporating any changes identified in the PDR as necessary
k)Receive Approval of PDR from Government

5.4.2. Critical Technical Design Review (CTDR)

The Contractor shall conduct a CTDR to include Government participation at a location mutually agreed to by the Government. The Contractor shall close all CTDR action items prior to entry into System Verification Review (SVR). CTDR planning and topics for discussion shall include but are not limited to the following:

a)Verify cost, schedule, and performance are all accurate & executable
b)Brief deliverable status
c)Deliver agenda, distribute meeting materials, conduct meeting, assign and track action items and develop and deliver minutes
d)Brief way forward to show adequate processes are planned and metrics are in place
e)Ensure key players/proper technical resources are represented at the review
f)Brief status of test and qualification plans
g)Identify required Certifications
h)Brief status of Test and Evaluation interfaces (e.g., identified and coordinated)
i)Brief status and details of draft Test procedures for systems testing
j)Brief plan for systems engineering (e.g., developed and implemented)
k)Brief logistics planning to include the assessment of the following elements: manufacturability, testability, RAM, supportability, and DMSMS
l)Brief the status of GFP
m)Brief Risk Register updates to include details showing: Risks are identified and managed properly for Development Test and Operational Test (DT/OT)
n)Show product baseline complete and ready for fabrication and software coding if software is required
o)Brief status of subcontract efforts
p)Brief method and status of deficiency tracking
q)TEPP updated as necessary in preparation for review at CTDR and updated and delivered after the CTDR, incorporating any changes identified in the CTDR as necessary
r)Receive approval of CTDR from Government

5.4.3. System Verification Review.

The Contractor shall conduct a formal SVR/Functional Configuration Audit (FCA) with Government participation at a location mutually agreed to by the Government. The Contractor shall close all CTDR action items prior to entry into SVR. CTDR planning and topics for discussion shall include but are not limited to the following:

a)Verify cost, schedule, and performance are all accurate & executable
b)Brief deliverable status
c)Deliver agenda, distribute meeting materials, conduct meeting, assign and track action items and develop and deliver minutes
d)Brief way forward to show adequate processes are planned and metrics are in place
e)Ensure key players/proper technical resources are represented at the review
f)Brief status of test and qualification plans
g)Identify required Certifications
h)Brief status of Test and Evaluation interfaces (e.g., identified and coordinated)
i)Brief status and details of draft Test procedures for systems testing
j)Brief plan for systems engineering (e.g., developed and implemented)
k)Brief logistics planning to include the assessment of the following elements: manufacturability, testability, RAM, supportability, and DMSMS
l)Brief the status of GFP

6. Test and Evaluation

6.1. Test and Evaluation Program Plan

The Contractor shall create a Test and Evaluation Program Plan (TEPP) plan which includes the requirements for qualification

6.1. Material Testing

The Contractor shall determine what materials, if any, require further testing to assure feasibility of the proposed solutions. These materials will be procured and tested as needed via direct Contractor inspection or a Subcontractor’s evaluation. This may include components, prototypes, or other testing, as required, for specification validation and verification.

The results of these tests shall be briefed as they become available through existing technical and programmatic meetings as well as the MSR. The Candidate Solution Report shall be revised if needed at the end of the Project to maintain the accuracy of the overall solution.

6.2. Test Readiness Review (TRR)

The Contractor shall conduct a TRR at Contractors facility with Government participation. The TRR shall cover all aspects of planned acceptance and applicable qualification to ensure the redesigned replacement units meet the requirements per performance acceptance test requirements. Testing requirements may include, but are not limited to, bench test, component test, sub-system level test, and system level test. The Contractor shall deliver a Conference Agenda prior to the TRR. Following the TRR, the Contractor shall provide Meeting Minutes and an updated TEPP, as required. The Contractor shall manufacture, test, evaluate, and qualify the fully functional units in accordance with the TEPP. The TEPP shall include qualification of the updated configuration to ensure all resources are scheduled and acquired to complete the effort to include test planning, test execution, administration, data collection and analysis. The Contractor shall resolve all issues that arise during testing until all technical parameters/requirements are met in accordance with the TEPP and scope of the PWS. Testing will be accomplished on fully functional final configuration units, and acceptance testing will be accomplished on the same configuration units.

6.3. Weapon System Sustainment Testing

Operation of the equipment (Lubricator Assembly) within the application test environment shall be verified through test, analysis, or demonstration at Contractors facility witnessed by a Government Team. The Contractor will be responsible for scheduling with the Government Team. The Contractor shall provide integration, maintenance, and troubleshooting support during integration testing. The Contractor shall provide data analysis anomaly reporting, resolution, and performance. The Contractor shall update the TEPP as necessary in preparation for testing and update and deliver the TEPP after Weapon System Sustainment Testing, incorporating any changes identified during Weapon System Sustainment Testing as necessary.

7. Prototyping and Qualification

7.1. SVR/FCA

The Contractor shall conduct a formal SVRFCA with Government participation at a location mutually agreed to by the Government. The SVR/FCA shall show verification of achievement of functional and/or allocated baseline requirements per performance acceptance test requirements through documented verification (e.g., analysis, demonstration, examination, testing, or any combination thereof). The Contractor shall deliver a Conference Agenda prior to the SVR/FCA and Meeting Minutes following the SVR/FCA.

7.2. Deliverable Units and Prototypes

The Contractor shall develop and provide two each (one for testing, one for destruction) fully functional prototype Lubricator Assemblies. Prototype units shall be Fit, and Function Interface replacements of the original sub-assemblies. Functionally Equivalent Units shall be produced as necessary to facilitate earlier qualification testing by the Contractor and Subcontractor.

7.3. Qualification Testing

The Contractor shall conduct all qualification testing and/or analysis as described within the TEPP. This includes but is not limited to Hardness Critical Item (HCI) qualification of the new circuit and sub-components. If testing has already been accomplished, the documentation demonstrating the results of that testing shall be provided to the government. The contractor shall deliver to the government all Qualification Test or Analysis Reports.

7.4. Qualification Approval

Navy In-Service Engineering Activity (ISEA) Engineers shall provide final disposition of product verification and source approval.

8. Period of Performance and Delivery Schedule

8.1 Period of Performance

The period of performance shall be 12 months after date of contract award. Early completion and delivery is acceptable and highly encouraged.

8.2 Project Delivery and Events Schedule

The contractor will submit all deliverables in accordance with contract requirements. The Government will have 15 business days to review each deliverable and provide comments to the Contractor. After said 15 business days, in the event no feedback is provided, the deliverable will be considered accepted.

9. Data Marking

9.1 Asserted Rights in Technical Data

Mark all technical data to be delivered to the Government IAW data rights as described in the Terms and Conditions. Technical data delivered or otherwise provided under a contract without restrictive markings shall be presumed to have been delivered with unlimited rights and may be released or disclosed without restriction.

9.2 Removal of Unjustified and Nonconforming Markings

IAW DFARS 252.227.7013(h), Proprietary markings shall be considered non-conforming and not authorized. The words "unlimited rights" shall be considered non-conforming and not authorized. All nonconforming markings will require removal and redeliver the drawings within 60 calendar days.

9.3. Distribution Code

Mark all scientific technical information (STINFO) to be delivered to the Government IAW DODI 5230.24.

•Distribution Statement A shall be used for technical data with asserted license rights of Unlimited where Export Control is not required.
•Distribution Statement D shall be used for technical data with asserted license rights of Unlimited where Export Control is required.
•Distribution Statement E shall be used for technical data with asserted license rights of Limited.
•Distribution Statement E shall be used for technical data with asserted license rights of Government Purpose.
•All documents assigned a distribution statement other than A shall be marked on the first page with the Export Control Warning Label.

9.4. Export Control Warning Label

Mark all STINFO determined to contain export controlled data to be delivered to the Government IAW DODI 5230.24. The Export Control Warning shall be placed directly below the Distribution Statement on the title page, with abbreviated markings on subsequent pages.

9.5. Destruction Notice for Unclassified Documents

Mark all limited-released (marked with a Distribution other than A) STINFO to be delivered to the Government IAW DODI 5230.24. The destruction notice shall be placed directly below the Export Control Warning on the title page of each document.

9.6 Classification

Mark all technical data to be delivered to the Government with classification markings representing the highest classification of the document. The Contractor may mark all unclassified technical data to be delivered to the Government “UNCLASSIFIED”.

9.7. General Marking Guidance

· All markings shall be conspicuously electronically fixed as to not interfere with other markings contained within the document and IAW the Terms and Conditions of the Agreement.

· All markings shall be legible when viewed at normal 100 percent viewing resolutions.

· All markings shall be electronically fixed to the first page of the electronic document.

· Coversheets shall not be used unless coversheet page numbering is sequentially consistent with the document.

10. Security

10.1. Safeguarding of Unclassified Controlled Technical Information Safeguarding of Unclassified Controlled Technical Information is applicable to this effort. The Contractor shall control information as described in other sections of this PWS, and IAW terms and conditions of the Agreement.

10.2. Release or Removal of Information

Contractor personnel shall not release or remove system documentation, data, or reports generated by or through use of Government systems.

10.3. Access to Confidential, Proprietary and/or Sensitive Information Contractor personnel may be required to access Confidential, Proprietary and/or Sensitive Information held by the United States Navy (USN) relating to tasks performed under this Agreement. This information may belong to other Contractors, other third parties, or the USN. Contractor personnel shall provide a completed Nondisclosure Agreement to the Government Program Manager, Government Representative, and Agreements Officer (AO) prior to performing work that involves Confidential, Proprietary, and/or Sensitive Information held by the USN relating to the tasks to be performed under this Agreement.

It should be noted that Confidential, Proprietary, and/or Sensitive Information shall not include information that the Contractor personnel or the Contractor can demonstrate:

• was known by the Contractor personnel or the Contractor without restriction as to further disclosure when received or was developed independently by the Contractor by individuals who had no direct or indirect access to such information,

•was obtained from a source other than the USN, its employees, agents, or Contractors through no breach of confidence,
•was in the public domain when received or thereafter enters the public domain through no breach of confidence by Contractor or Contractor personnel, or
•was used or disclosed with the prior written approval of the USN.

10.4. Security Clearance

All Contractor employees shall possess appropriate security clearances to support the Subject Item Weapon System.

10.5. Access to Information Systems

Contractor must have or obtain access to all required digital information systems and repositories to collect and upload technical data pertaining to the subject item repair. Contractor must have or obtain all identification necessary to access these systems which may include PKI certificates or Common Access Cards (CAC).

11. Government Material

11.1. Furnished Equipment, Materials, Property and Software

The Contractor shall identify all Government Furnished Equipment (GFE), Government Furnished Material (GFM), Government Furnished Property (GFP) and/or Government Furnished Software (GFS) in support of this Agreement within the first full month’s status report. These items will be provided to the Contractor in “as is” condition. Upon receipt/acceptance of these items, the Contractor shall perform a physical inspection of the items and submit formal documentation to the Government Program Manager detailing the date items were accepted, item descriptions, quantity, model, serial number and condition. Upon completion of the contract, all items shall be returned to the Government. If these items are not returned in their original state, a Report of Survey (ROS) will be completed by the Government and Contractor to determine the cause for the deterioration from the good working order and/or condition of the items. At that time, Contractor Liability for Government Property shall be determined IAW the Terms and Conditions of the Agreement.

11.2. Damage to Government Property and/or Base Support

The Contractor shall protect Government property to prevent damage during the period of time the property is in the possession of the Contractor (i.e. GFE/M/P/S) and/or being used at a Government facility (i.e. Base Support). The Contractor shall report promptly to the Government Program Manager, Government Representative, AO and Administrative Contracting Officer (ACO) and all available facts relating to each instance of damage to Government property.

11.3. Major Mishap

When a major mishap ($2,000 or more) involving Government property (GFE/M/P/S and/or Base Support) occurs, the Contractor shall immediately secure the accident scene and the damaged item until released by the accident investigative authority as designated by the Government Safety Office. Such release shall be accomplished by the ACO with coordination from the Government Program Manager.

a)Mishap notifications shall contain, as a minimum, the following information:
b)Contract, Contract Number, Name and Title of Person(s) Reporting
c)Date, Time and exact location of accident/incident
d)Brief Narrative of accident/incident (events leading to accident/incident)
e)Cause of accident/incident, if known
f)Estimated cost of accident/incident (material and labor to repair/replace)
g)Nomenclature of equipment and personnel involved in accident/incident
h)Corrective actions (taken or proposed)
i)Other pertinent information

11.4. Investigation

If the Government elects to conduct an investigation of the accident, the Contractor shall cooperate fully and assist Government personnel until the investigation is completed. The Contractor shall include a clause in each of its subcontracts requiring Subcontractor cooperation and assistance in accident reporting and investigation.

The Contractor shall report ALL Contractor labor hours (including subcontractor labor hours) required for performance of the services provided under this contract, Reverse Engineer and TDP via a secure data collection site.

Reporting inputs will be for the labor executed during the period of performance for each Government Fiscal Year (FY), which runs 01 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help.

The Use and Safeguarding of Information: Information from the secure web site is considered to be Proprietary in nature when the contract number and Contractor identity are associated with the direct labor hours and direct labor dollars. At no time shall any data be released to the public with the Contractor name and contract number associated with the data.

12. CONTINUATION OF ESSENTIAL SERVICES DURING CRISIS

IAW DFARS 252.237-7023, this requirement is not considered mission essential.
