Contract Opportunity Summary
This is a draft special provisions and contract document from the Michigan Department of Transportation (MDOT) for Contract ID 63112-202527, involving design and engineering support services for the Bald Mountain Recreation Area park route in Orion Charter Township, Oakland County, Michigan. The project scope encompasses maintaining traffic throughout construction on the park route, M-24, and Greenshield Road within a Construction Influence Area extending approximately one-quarter mile in all directions from the work limits. Work must commence no earlier than May 15, 2020, following receipt of a formal notice of award, with an interim completion date of August 15, 2020, and a final completion date of October 15, 2020. The Engineer for the project is Gina Red Craig at the MDOT Oakland TSC. A preconstruction meeting is required after award and prior to work commencement, at which time the Contractor must submit an Internal Traffic Control Plan (ITCP) for Engineer approval within 7 calendar days. Lane closure requests must be submitted to the Engineer 7 calendar days in advance, with the Engineer providing approval or comments within 4 calendar days. The project includes restrictions on work during specific holiday periods (Memorial Day, Independence Day, and Labor Day) and special park events, with detailed traffic control limitations specified in tabular form.
The contract incorporates comprehensive special provisions addressing traffic control, materials sourcing, labor compliance, environmental controls, and project administration. Liquidated damages apply for failure to meet interim and final completion dates, calculated daily based on the original contract amount according to specified schedules. The document includes requirements for Buy America compliance for steel and iron products, prevailing wage and certified payroll submissions, soil erosion and sedimentation control measures with associated penalties for non-compliance, prompt payment requirements for subcontractors, and construction document management through MDOT's ProjectWise system using digitally encrypted electronic signatures. Additional provisions establish requirements for temporary traffic control devices, maintenance of traffic during construction, contractor performance evaluations, and timely project closeout procedures, with detailed specifications for materials, equipment, and construction methodologies throughout the contract duration.

9. Unless active work prevents it, maintain access to all parking lots along the park route.
10. Upon approval of the ITCP, complete and submit the “Lane Closure
Notification/Request Form” to the Engineer for approval prior to the actual closure date.
Submit the lane closure request 7 calendar days in advance of the lane closure for approval.
This includes all shifts/shoulder/lane/ramp closures as stated per the proposal or any new lane closure requests submitted by the Contractor. The Engineer will have 4 calendar days to review the lane closure request for approval or provide comments for revisions required to obtain approval. Do not implement a lane closure prior to approval by the Engineer. In addition, notify the Engineer when the lane closure is removed or cancelled. See Lane Closure Notification/Request Form contained in the proposal.
e. Traffic General.
1. For any lane open to traffic, provide a minimum lane width of 11 feet with 2 feet of shy distance on both sides unless identified otherwise on plans.
2. Do not close lanes or utilize traffic regulation sequences where work can be accomplished with a shoulder closure. Do not occupy any part of the active traffic lane with personnel or equipment when utilizing a shoulder closure. Place lane closures and traffic regulation operations only in areas as show on the plans unless otherwise directed by the Engineer.
3. Prior to shifting traffic onto shoulders or opening any lanes/shoulders and/or ramps, remove, by sweeping, all accumulated debris that has collected within the shoulder and/or within the closed lane/shoulder.
4. A speed reduction will not be used.
5. Repair, at no expense to the Department, any damage done to staging area, signs, or any road surface due to the Contractor’s operations.
6. Develop and submit to the Engineer an Internal Traffic Control Plan (ITCP) per subsection 104.11.B of the Standard Specifications for Construction. Submit the ITCP at the preconstruction meeting. The Engineer will have 7 calendar days to review the ITCP for approval or provide comments for revisions required to obtain approval. Include in the ITCP, at a minimum, the proposed ingress/egress locations for construction equipment and vehicles, traffic control devices that will be utilized to warn the motoring public of ingress/egress locations, and measures that will be taken to ensure compliance with the ITCP. Ensure that the ITCP minimizes conflicts between construction vehicles and motorists and maintains overall safety and mobility within the work zone. No work may begin prior to approval of the ITCP. Additional time required to obtain an approved ITCP will not be cause for delay or impact claims. All costs associated with obtaining an approved ITCP, providing and executing all parts of the approved ITCP including required traffic control devices, or resolving an incomplete or unacceptable ITCP will be borne by the Contractor.
7. Protect the work area at the end of each day. Close all open access points on the project to traffic with Type III barricades or other devices approved by the Engineer. Restore undercuts or excavations in areas immediately adjacent to active traffic lanes to a one-on-four slope from the edge of the roadway at the end of each working period or as directed by the
OAK:KRC 4 of 6 1-17-20
Engineer. Delineate any shoulder under construction that is not in a finished condition left overnight, as shown on plans.
8. The Engineer will be responsible for notifying emergency services, transit agencies, law enforcement and schools prior to any lane closures, detours or major traffic shifts. In addition, the Contractor will be responsible for working with and complying with any coordination that is necessary with the Department and emergency services, transit agencies, law enforcement and schools. All costs associated with these coordination efforts will be considered included in the pay item “Minor Traf Devices”.
9. All costs associated with maintaining devices during/post a storm event are considered included in the “Operated” item for the traffic control devices.
10. Remove all temporary traffic control devices from MDOT right-of-way during any shut down periods unless needed for directly maintaining or channelizing traffic. No additional payment will be made for removal and/or redeployment of these devices except for in the case of an approved extension of time.
11. Once work is initiated that includes any lane restrictions, that work must be continued daily until completed. A lack of work activity for more than 3 days will require the removal of lane closures at no expense to the Department.
f. Traffic Regulator Control.
1. Maintain two-way traffic at all times on open segments of the park route using traffic regulator control. A traffic regulator sequence is allowed to cover the entire open portion of the park route. Place the arrow panel, signs and channelizing taper for the traffic regulator operation at locations approved by the Engineer for adequate visibility by oncoming traffic.
2. Do not utilize more than one (1) traffic regulator operation at one time on the park route.
g. Pedestrian or Non-Motorized Facilities.
1. Maintain all facilities in accordance with The Americans with Disability Act (ADA) requirements. Provide facilities equivalent to or better than the route a person would have encountered prior to construction activities. If facilities cannot be maintained, close facilities to pedestrian traffic.
2. Keep sidewalk or trail areas clear of any equipment or materials at all times the sidewalks are open to pedestrian traffic.
h. Unique Project Traffic Control Requirements.
1. Utilize the letterboard at the M-24 entrance to the park to communicate closures to the public. The board will be changed by park staff as directed by the Engineer.
i. Traffic Control Devices. Ensure all traffic control devices are in accordance with the
MMUTCD and must meet the “acceptable” criteria as defined in the ATSSA publication entitled
OAK:KRC 5 of 6 1-17-20
“Quality Guidelines for Temporary Traffic Control Devices and Features” at the time of initial deployment and after each major stage change.
1. General.
A. During non-working periods, any work site with uncompleted work must have applicable advance signs and channelizing devices at specific locations, as directed by the Engineer, at no additional cost to the Department.
B. Notify the Engineer 24 hours in advance of when traffic control devices are being delivered to the project site, to allow for initial inspection of devices to take place.
C. Remove from the project site all traffic control devices (including detour signing) no longer needed for a particular operation and equipment for construction within 14 calendar days of reopening the shoulder/lane/roadway.
2. Channelizing Devices.
A. Channelizing devices required for this project are as shown in the contract unless otherwise directed by the Engineer.
B. Ensure all devices have sufficient ballast to prevent moving or tipping. If moving or tipping occurs, place additional ballast, as directed by the Engineer, at no additional cost to the Department. No more than two ballasts are allowed on each channelizing device.
C. Do not use caution tape on this project.
3. Temporary Signs.
A. Additional W20-1 (ROAD WORK AHEAD) signs are included in the quantities to be placed on all intersecting or adjacent roads where construction activities may be encountered.
B. W8-7 (LOOSE GRAVEL) signs are included in the quantities to be placed on the park route in areas where chip seal is applied.
C. Fabricate, install, and remove temporary sign overlays on existing signs with the pay item for Sign, Type B, Temp, Prismatic, Furn. Attach the overlay in accordance with subsection 812.03.D.2 of the Standard Specifications for Construction.
j. Measurement and Payment. Payment will be in accordance with the standard specifications unless otherwise specified.
No additional payment will be made for the following activities:
1. Transporting traffic control items from site to site.
2. Providing sufficient vehicles and staff to make changes as-needed on site during work.
OAK:KRC 6 of 6 1-17-20
3. Providing sufficient vehicles and staff to remove closures from the roadway.
4. Additional signing or maintaining traffic devices required to expedite the construction will be borne by the Contractor.
