About this file

This is a Professional Services Agreement from the City of New Smyrna Beach, Florida, for the provision of professional engineering services for marine applications. The agreement establishes a contract pool of qualified firms or individuals to provide engineering services on an as-needed basis through purchase orders and work orders issued by the City. Services include reviewing City codes, resolutions, ordinances, and applicable State of Florida codes, and preparing complete project documents including final plans, technical specifications, construction estimates, and bid documents for marine-oriented projects. The contract term is three years from the award date, with the option to renew administratively for one two-year extension, resulting in a maximum cumulative term of five years. The City makes no guarantee regarding the number of available projects or that the selected firm will perform any work during the contract period.

Compensation is based on the consultant's submitted fee schedule, with monthly invoicing for services completed during each billing period unless otherwise specified in a scope of services document. The consultant must provide a Certificate of Insurance within fourteen days of bid acceptance by City Commission. The agreement is governed by Florida law with venue in Volusia County, and both parties have waived the right to a jury trial. The contract documents include the City's advertised bid with addendums, the award bid proposal, presentation of services, and the fee proposal. The agreement requires a Human Trafficking Affidavit from the contractor and is subject to the Consultants Competitive Negotiation Act under Florida Statutes 287.055.
