The Department is soliciting quotes for Zebra ZXP Series 7 Dual Side Card Printers with dual side lamination, Magicard Rio Pro Duo Card Printers, associated laminates and color ribbons, blank PVC cards, and custom lanyards. Specific quantities for each item are detailed in Attachment A, with the Department intending to place orders as needed rather than committing to fixed volumes. The quote submission deadline is September 24, 2015, at 9:00 AM Mountain Daylight Time, with responses to be submitted via email to Chelsea Bunker at chelsea.bunker@state.co.us. The resulting award will be for an initial one-year term with the option to renew for four additional one-year periods at the State's sole discretion. No formal public bid opening is scheduled, and the Department reserves the right to award to a single vendor or make multiple awards if deemed in the State's best interest. Bidders must be registered in the Vendor Self Service (VSS) system prior to the solicitation opening date; non-registered vendors will only be considered if adequate competition among registered vendors is not demonstrated.
Pricing must be submitted as firm fixed price, F.O.B. Destination, and must be inclusive of all administrative support, supplies, hardware, software, training, insurance, and other costs necessary for performance. Vendors must provide separate pricing for installation services, warranty coverage (both initial and extended), and maintenance/support packages, along with lead times and delivery dates. The State is exempt from all federal excise taxes and state and local sales and use taxes; no taxes of any kind shall be charged to the State. Payment will be made within 45 days of receipt of products or services and a correct invoice, with interest accruing thereafter at the rate specified in Colorado Revised Statutes. Service-Disabled Veteran Owned Small Businesses (SDVOSBs) meeting Colorado requirements must submit certification from the U.S. Department of Veterans Affairs to qualify for the 3% contracting goal preference. All equipment must be newly manufactured; refurbished equipment is not acceptable. Vendors must maintain Commercial General Liability Insurance with minimum limits of $1,000,000 per occurrence and $1,000,000 general aggregate, Automobile Liability Insurance with $1,000,000 combined single limit, and Workers' Compensation Insurance as required by Colorado statute, naming the State as an additional insured. Award will be made to the bidder whose response is most advantageous to the State, with price/cost being the primary consideration, though experience, qualifications, past performance, and delivery capabilities may also be evaluated.

Bidders: Check the Vendor Self Service System (VSS) at: https://codpa-vss.hostams.com/webapp/PRDVSS1X1/AltSelfService for any updates or modifications. In the event that it becomes necessary to revise any part of this Documented Quote, a modification notice will be posted on VSS. It is very important that bidders check VSS on a regular basis, as this is the sole method for communicating any changes. Modifications published on the VSS system take precedence over information in this Documented Quote.
Because of the limited competition expected from VSS vendors on this solicitation, the procuring agency intends to use both VSS and additional methods of vendor notification and may make the specifications available to non-registered vendors through additional means. However, quotes, bids, or offers submitted by non-registered VSS vendors will not be opened or considered (except as necessary to determine registration status) unless, after examination of quotes, bids, or offers submitted by VSS registered vendors, it is determined that there is not adequate competition among VSS registered vendors. If adequate competition (as defined in Colorado Procurement Rule R-24-103-101-01) exists among registered vendors, quotes, bids, or offers from non-registered vendors will not be considered. A vendor is considered registered if its registration is received in VSS prior to the solicitation opening date and time.
*While a minimum of 3 business days will be allowed for bidders to respond, the Department of Revenue
(“Department” and/or “State”) may then, in its discretion, award upon a determination of adequate competition (minimum of 3 viable responses).

The solicitation includes an RFP, IFB, or any other form of order by buyer. If a bid or proposal is not referenced, this PO is an OFFER TO BUY, subject to vendor’s acceptance, demonstrated by vendor’s performance or written acceptance of this PO. Any COUNTER-OFFER TO SELL automatically CANCELS this PO, unless a change order is issued by buyer accepting a counter-offer. This PO shall supersede and control over any vendor form(s) or part(s) thereof included in or attached to any bid, proposal, offer, acknowledgment, or otherwise, in the event of inconsistencies or contradictions, regardless of any statement to the contrary in such form(s) or parts thereof. 2. Safety Information. All chemicals, equipment and materials proposed and/or used in the performance of this PO shall conform to the requirements of the
Occupational Safety and Health Act of 1970. Vendor shall furnish all Material Safety Data Sheets (MSDS) for any regulated chemicals, equipment or hazardous materials at the time of delivery.

This PO shall not be modified, superseded or otherwise altered, except in writing signed by purchasing agent and accepted by vendor. Each shipment received or service performed shall comply with the terms of this PO, notwithstanding invoice terms or acts of vendor to the contrary, unless this PO has been modified, superseded or otherwise altered in accordance with this section.
4. Delivery. Unless otherwise specified in the solicitation or this PO, delivery shall be FOB destination. Buyer is relying on the promised delivery date, installation, and/or service performance set forth in vendor’s bid or proposal as material and basic to buyer’s acceptance. If vendor fails to deliver or perform as and when promised, buyer, in its sole discretion, may cancel its order, or any part thereof, without prejudice to its other rights, return all or part of any shipment so made, and charge vendor with any loss or expense sustained as a result of such failure to deliver or perform as promised. “materials”) delivered by vendor in performance of its obligations under this PO shall be the exclusive property of buyer. "Services" as used in this section includes services performed or tangible material produced or delivered in the performance of services. If any of the services do not conform to PO requirements, buyer may require vendor to perform the services again in conformity with PO requirements, without additional payment. When defects in the quality or quantity of service cannot be corrected by re-performance, buyer may (a) require vendor to take necessary action to ensure that future performance conforms to PO requirements and (b) equitably reduce the payment due vendor to reflect the reduced value of the services performed. These remedies do not limit the remedies otherwise available in this PO, at law, or in equity.

Vendor shall continue performance of this PO to the extent not terminated and be liable for excess costs incurred by buyer in procuring similar goods or services elsewhere.
