About this file
This is a Darfur Contracting Act compliance form issued by the State of California Department of Pesticide Regulation (DPR-049, Rev. 1/11) that applies to companies bidding on state contracts. The form implements Public Contract Code Sections 10475-10481 and is required for any company that has conducted business activities or operations outside the United States within the previous three years. Companies meeting this criterion must certify their compliance status to be eligible to submit bids or proposals for state contracts. The form provides two compliance pathways: companies can certify that they are not a scrutinized company under Public Contract Code 10476, or they can submit written permission from the Department of General Services if they are a scrutinized company that has been granted case-by-case permission to bid. Companies without international business activities in the previous three years are not required to complete this form.
The form requires companies to provide their company name, Federal ID Number, and authorization signatures as part of either compliance option. For Option 1, an authorized official must certify under penalty of perjury that the prospective bidder is not a scrutinized company. For Option 2, companies must include a copy of written permission from the Department of General Services Director demonstrating that the state has determined it is in the best interests of California to permit the scrutinized company to submit a proposal. The certification must be executed with the signatory's printed name, title, date, and the county and state where execution occurred.
