PLEASE NOTE THAT THIS SOLICITATION IS SET-ASIDE FOR 8A FIRMS ONLY.

THIS IS A 8A COMPETITIVE SOLICITATION

MINIMUM GUARANTEE

The Government’s only obligation is the Guaranteed Minimum Quantity of Service for the Base Period under the contract. The minimum quantity is $50,000.00 of delivery orders for the base year contract. PLEASE NOTE: GUARANTEED TASKINGS WILL ONLY BE ISSUED FOR BASE YEAR CONTRACTS IN THE AMOUNT OF $50,000.00 TO BE ESTABLISHED BEFORE THE LAST DAY OF THE BASE YEAR.

CONTRACT MINIMUM/MAXIMUM QUANTITY AND CONTRACT VALUE

The minimum quantity and contract value for all orders issued against this contract shall not be less than the minimum quantity and contract value stated in the following table. The maximum quantity and contract value for all orders issued against this contract shall not exceed the maximum quantity and contract value stated in the following table.

GENERAL INFORMATION

1. GENERAL INFORMATION

1.1 Description of Services/Introduction: The U.S. Department of Labor (DOL), Employment and Training Administration (ETA), Office of Foreign Labor Certification (OFLC) is seeking an experienced contractor to provide the following services for its new enterprise-level labor certification platform (formally called the iCERT Visa Portal System) as well as its legacy foreign labor certification systems that support the permanent and temporary visa programs.

These services (with exception noted below) will be performed offsite with a secure connection to the DOL-ETA network.

Exception: The Database Analyst will perform his/her responsibilities in The Department of Labor’s Office of Foreign Labor Certification.

1.2 Background: OFLC implemented a one-stop portal system, formally called the iCERT System to improve access to employment-based visa application services and USDOL immigration news and information, and establish a more integrated customer account platform for filing and tracking applications across all of the employment-based visa programs administered by OFLC. The iCERT System provides a single point-of-entry for employers and will serve as the platform for future software development efforts over the next 5 years by integrating all employment-based visa application processing administered by OFLC into a common business solution.

1.3 Objectives: ETA is now seeking experienced contractor services to enhance and build new application filing and case processing modules that will be integrated into the iCERT System platform, and provide overall maintenance and end user support to the OFLC legacy labor certification systems separately supporting the permanent and temporary visa programs. Five key objectives for this Statement of Work (SOW) were established:

1. Improve customer service and linkages to State/Federal partners

2. Integrate OFLC business processes

3. Enhance visa program integrity efforts

4. Improve system performance

5. Reduce long-term IT costs to upgrade, enhance, and maintain the system

1.3.1 To be successful in achieving these key objectives, the contractor will work collaboratively with the OFLC iCERT Management Team and provide services such as business solutions management, software development and integration, testing, maintenance and documentation, and help-desk and end user support under this SOW. The contractor will ensure that all systems are maintained in a reliable manner that provides a consistent, timely, and appropriate service to the OFLC. In addition, the contractor will be required to follow ETA’s System Development Lifecycle Methodologies (SDLCM) and work closely with ETA Security Team to maintain all security documentation in accordance with DOL standards for physical, access, and application security. The iCERT and OFLC legacy systems are developed in ColdFusion application software and share a networked computer infrastructure with an Oracle database back-end system for data storage and retrieval. The systems run on a Microsoft Windows operating system, utilize the Internet Explorer browser environment, and all application code is tracked and managed using the CCC-Harvest solution.

1.4 Period of Performance: The Period of Performance (POP) shall include (1) Base Year and four (4) Option Years from the date of contract award. The Period of Performance shall be as follows:

Orders placed through the IDIQ contract period will identify POP for each Task Order.

1.5 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this SOW. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract.

1.7 Hours of Operation

1.7.1 DOL is normally accessible between the hours of 6:00am and 7:00pm; however, in no event will Contractor personnel be allowed to report for work prior to the arrival of Government personnel. Normal business hours are Monday through Friday, except for Federal holidays, or when the Government facility is closed due to local or national emergencies, administrative closings or other Government directed facility closings. The work day consists of eight (8) hours per day. Work hours outside the normal workday and administrative workweek, if needed; require advance approval from the contracting officer. Contractor personnel shall be present for work within the normal workday and administrative workweek unless prior approval has been granted for leave/vacation or other excused absence (i.e. sick leave).

1.7.2. Overtime Rates: Overtime rates will be negotiated at time of award of IDIQ contract.

1.7.3 The contractor shall at all times maintain an adequate work force to provide for the uninterrupted performance of tasks defined within this statement of work. When hiring Contractor personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential. For all Contractor positions filled, any time an employee must miss more than five (5) consecutive days of work, the Contractor must notify the Contracting Officer’s Technical Representative (COTR) and, if necessary, provide a backfill for that vacant position.

1.8 Place of Performance: All work under this contract will be performed at the Contractor’s location “offsite” with the exception of the Database Analyst (DOL). However, the contractor will be required to attend weekly meetings on site at the DOL.

1.9 Type of Contract: The Government anticipates the award of an Indefinite Delivery Indefinite Quantity (IDIQ) type contract with fixed price rates and labor hours contract line item numbers (CLINs).

1.10 Security Requirements

1.10.1 Security Requirements: This document is unclassified; however, the classification of the work to be performed on specific work assignments issued under this contract may require security clearances. If a security clearance is required the contractor will need to have the individual performing the Task Order complete a Standard Form (SF) 86, Questionnaire for National Security Position, SF-86A, Continuation Sheet to the Questionnaire for National Security Position, Form FD-258, and fingerprint card. The contractor shall ensure all personnel are capable of meeting the criteria for a background investigation and have the ability to obtain a Government issued identification badge.

1.10.2 Background Checks/Security: Contractor shall hold, at a minimum, an interim secret facility clearance prior to the RFP closing date. All contractor personnel that require regular access to DOL must submit to the Department’s process for obtaining a Personal Identity Verification (PIV) card. The PIV process includes a background investigation as required by the Homeland Security Presidential Directive-12 (HSPD-12) Policy for a Common Identification Standard for Federal Employees and Contractors,” which the President issued on August 27, 2004.

1.10.3 Physical Security: Contractor personnel shall be responsible for safeguarding all Government property issued for contractor use. All Government property and facilities shall be properly secured at the close of each work period.

1.10.4 Confidentiality and Security Requirements/Nondisclosure of sensitive and/or proprietary data:

In the performance of this contract the contractor may receive or have access to sensitive information, including information provided on a proprietary basis by carriers, equipment manufacturers and other private or public entities. The contractor agrees to use and examine this information exclusively in the performance of this contract and to take the necessary steps in accordance with Department of Labor regulations to prevent disclosure of such information to any party outside the Department of Labor or Department of Labor designated support contractors possessing appropriate proprietary agreements.

1.10.5 IT Systems Security Specifications: The Contractor agrees to comply with the IT system security and/or privacy specifications set forth in the Statement of Work, the Computer Security Act of 1987 Office of Management and Budget (OMB) Circular A-130 is, Appendix III, "Security of Federal Automated Information Systems," and the DOL Computer Systems Security Handbook (Release 2.0, dated April 2004). The Contractor further agrees to include this provision in any subcontract awarded pursuant to this prime contract. NOTE: OMB A-130 is accessible via web site.

1.10.6 Key Control: The Contractor shall establish and implement methods for making sure all keys/key cards issued to the Contractor by the Government are not lost/misplaced and are not used by unauthorized personnel. Keys and key cards issued to the Contractor personnel are not to be duplicated. The contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the COTR. The contractor will be required to return all keys/key cards to the COTR upon completion of the contract.

1.10.7 In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the COTR, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the contractor.

1.10.8 The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The contractor shall prohibit the opening of locked areas by contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, unless specifically authorized by the COTR.

1.11 Non-Disclosure: The contractor shall ensure that (prior to contract performance) all employees assigned to the contract sign a Non-Disclosure agreement. This agreement must be signed by each contract staff prior to arriving at the worksite. Inability to sign such an agreement shall be deemed as criteria for non-employment.

1.12 Indoctrination of Personnel: The contractor agrees to indoctrinate its personnel who have access to the sensitive nature of the information and the relationship under which the contractor has possession of or access to the information. Contractor personnel shall not engage in any other action, venture, or employment wherein sensitive information will be used for the profit of any party other than those furnishing the information. Contractor personnel will complete nondisclosure agreements. The contractor shall restrict access to sensitive/proprietary information to the minimum number of employees necessary for contract performance. The contractor shall be required to coordinate and exchange directly with other contractors as designated by DOL information pertinent and essential to performance of Task Orders issued under this contract. The contractor shall discuss and resolve any problems between the Contractor and those contractors designated by DOL. The CO and COTR shall be notified in writing of any disagreement(s), which has (have) not been resolved in a manner so as not to impact the completion of activities or deliverables that is in accordance with the documented and agreed upon project plan and project work-breakdown structure. The contractor shall furnish the CO and COTR all copies of communications between the contractor and associated contractor(s) relative to contract performance.

Further, the close interchange with and between contractor(s) may require access to or release of proprietary data, within the guidelines of ARTICLE H.9. In such an event, the Contractors shall enter into mutually acceptable agreement(s) to protect such proprietary data from unauthorized use or disclosure so long as it remains proprietary.

1.13 OMB Clearance: In accordance with HHSAR 352.270-7, Paperwork Reduction Act; the Contractor shall not proceed with surveys or interviews until such time as Office of Management and Budget (OMB) Clearance for conducting interviews has been obtained by the Project Officer and the Contracting Officer has issued written approval to proceed.

1.14 Privacy Act: This procurement action requires the vendor to do one or more of the following: design, develop, or operate a system of records on individuals to accomplish an agency function in accordance with the Privacy Act of 1974, Public Law 93-579, December 31, 1974 (5 USC 552a) and applicable agency regulations. Violation of the Act may involve the imposition of criminal penalties. The Privacy Act System of Records applicable to this project is Number DOL/OASAM-4. This document is incorporated into this contract as Attachment.

1.15 Request for Information/Press Releases: The contractor shall refer any request for information, or request for press conferences to the U.S. Department of Labor, Office of Public Affairs, 200 Constitution Avenue, NW, Rm. N-2514, Washington, DC 20210. Contractor will not release any information regarding this contract without the prior written approval of the Contracting Officer.

1.16 EPA Energy Star Requirements: In compliance with Executive Order 12845 (requiring Agencies to purchase energy efficient computer equipment) all microcomputers, including personal computers, monitors, and printers that are purchased using Government funds in performance of a contract shall be equipped with or meet the energy efficient low-power standby feature as defined by the EPA Energy Star program unless the equipment always meets EPA Energy Star efficiency levels. The microcomputer, as configured with all components, must be Energy Star compliant.

This low-power feature must already be activated when the computer equipment is delivered to the agency and be of equivalent functionality of similar power managed models. If the equipment will be used on a local area network, the vendor must provide equipment that is fully compatible with the network environment. In addition, the equipment will run commercial off-the-shelf software both before and after recovery from its energy conservation mode.

1.17 Special Qualifications:

1.17.1 All potential resume(s) should be submitted through the Contracting Officer to the Contracting Officer’s Technical Representative (COTR) for review prior to job placement.

1.17.2 Personnel: Included below are labor categories identified by the Department as potentially relevant to this effort. Each labor category provides guidelines for the technical proficiency required for that labor category. Upon hiring or contracting, the contractor shall ensure that the individual possesses the required skills, abilities and knowledge specified herein. The contractor is responsible for ensuring that the technical capabilities and skills of each individual currently assigned to a labor category are maintained and upgraded as appropriate.

1.17.2.1 Program Manager - Position Description:

The Program Manager coordinates and monitors the scheduling, pricing, and technical performance of all projects within the program. Responsibilities also include managing contractual changes, obtaining resources, and reporting on the financial condition of the program. Ensures adherence to master plans and schedules; develops solutions to program problems, and directs work of incumbents assigned to program from various departments. Ensures projects are completed on time and within budget. Acts as advisor to program team regarding projects, tasks, and operations. Relies on extensive experience and judgment to plan and accomplish goals. Performs a variety of complex tasks. A wide degree of creativity and latitude is required. Is the point of contact for weekly reports and meetings at DOL and.

Specific responsibilities include:

· Serve as the primary point of contact for program-related issues and activities.

· Allocate and track contract resources across all projects/task orders in the program.

· Ensure the preparation and submission of all reports as specified in the contract.

Minimum Qualifications:

· Bachelor’s degree in a computer-related field or equivalent experience.

· Demonstrated experience as a team member on web application development projects engaged in all aspects of the project life cycle from requirements definition through development and implementation.

· Demonstrated experience as a systems analyst or programmer designing or developing web-based applications utilizing scalable RDBMS back-ends, including Oracle.

· Demonstrated experience facilitating JAD/RAD programming efforts.

· Demonstrated experience with ColdFusion or similar web development tools.

· Demonstrated experience providing technical leadership and project leadership on a variety of professional service engagements and technical projects.

· Demonstrated experience in driving changes, process improvement, and having a significant improvement of quality and service levels for users, applications, communication, and processes.

· Excellent oral and written communication skills with the ability to develop and present technical presentations.

· Familiar with software development concepts and practices including requirements definition, use cases, business rules, entity relationships, wireframes, and testing.

1.17.2.2 Project Manager I - Position Description:

The Project Manager I is responsible for coordinating and completing projects of small size and limited complexity within the information technology department. Oversees all aspects of projects. Sets deadlines, assigns responsibilities, and monitors and summarizes progress of project. Builds and maintains working relationships with team members, vendors, and other departments involved in the projects. Prepares reports for upper management regarding status of project. Relies on limited experience and judgment to plan and accomplish goals. Performs a variety of tasks. Leads and directs the work of others. A limited degree of creativity and latitude is expected.

Minimum Qualifications:

· Bachelor’s degree in a computer-related field or equivalent experience.

· Experience as a project manager on projects of small and limited complexity.

· Demonstrated experience as a team member on web application development projects engaged in all aspects of the project life cycle from requirements definition through development and implementation.

· Demonstrated experience as a systems analyst or programmer designing or developing web-based applications utilizing scalable RDBMS back-ends, including Oracle.

· Demonstrated experience facilitating JAD/RAD programming efforts.

· Demonstrated experience with ColdFusion or similar web development tools.

· Good oral and written communication skills.

· Familiar with software development concepts and practices including requirements definition, use cases, business rules, entity relationships, wireframes, and testing.

1.17.2.3 Project Manager II - Position Description:

The Project Manager II is responsible for coordinating and completing projects of medium size and moderate complexity within the information technology department. Oversees all aspects of projects. Sets deadlines, assigns responsibilities, and monitors and summarizes progress of project. Builds and maintains working relationships with team members, vendors, and other departments involved in the projects. Prepares reports for upper management regarding status of project. Relies on limited experience and judgment to plan and accomplish goals. Performs a variety of tasks. Leads and directs the work of others. A limited degree of creativity and latitude is expected.

Minimum Qualifications:

· Bachelor’s degree in a computer-related field or equivalent experience.

· Experience as a project manager on projects of medium size and moderate complexity.

· Demonstrated experience as a team member on web application development projects engaged in all aspects of the project life cycle from requirements definition through development and implementation.

1.17.2.5 Computer Systems Analyst I (14101) - Position Description:

The Computer Systems Analyst analyzes business or scientific problems for resolution through electronic data processing, gathers information from users, defines work problems, and, if feasible, designs a system of computer programs and procedures to resolve the problems. This Worker develops complete specifications or enables other Computer Programmers to prepare required programs and analyzes subject-matter operations to be automated; specifies number and types of records, files, and documents to be used and outputs to be produced; prepares work diagrams and data flow charts; coordinates tests of the system and participates in trial runs of new and revised systems; and recommends computer equipment changes to obtain more effective operations. The Computer Systems Analyst may also write the computer programs.

At this level, initial assignments are designed to expand practical experience in applying systems analysis techniques and procedures. This Analyst provides several phases of the required systems analysis where the nature of the system is predetermined, uses established fact-finding approaches, knowledge of pertinent work processes and procedures, and familiarity with related computer programming practices, system software, and computer equipment.

This Worker carries out fact finding and analyses as assigned, (usually of a single activity or a routine problem); applies established procedures where the nature of the system, feasibility, computer equipment and programming language have already been decided; may assist a higher level systems analyst by preparing the detailed specifications required by computer programmers from information developed by the higher level analyst, and may research routine user problems and solve them by modifying the existing system when the solutions follow clear precedents. When cost and deadline estimates are required, results receive closer review.

The supervisor defines objectives, priorities, and deadlines. Incumbents work independently; adapt guides to specific situations; resolve problems and deviations according to established practices; and obtain advice where precedents are unclear or not available.
