About this file

This Statement of Work issued by the Massachusetts Department of Youth Services solicits quotes from eligible FAC120 contractors to provide snow removal services under Statewide Contract FAC120, Category 2. The services include snow plowing, pretreatment, sanding, deicing, and related snow and ice removal at the DYS facility located at 456 Flax Pond Road in Brewster, Massachusetts, situated within Nickerson State Park. The facility requires clearing and treatment of approximately 1.25 miles of access roadway from Route 6A, parking spaces, and other paved areas to maintain safe operational access throughout winter months. The contract period extends up to three years, subject to the availability of appropriated funds, continued DYS need for services, and satisfactory contractor performance. Contractors must be capable of responding to service calls throughout the day and night and must arrive at the facility no later than two hours after being contacted by authorized DYS personnel.

Pricing shall be submitted as Not-to-Exceed rates for six service categories: pretreatment (hourly), truck with plow and driver (hourly), truck with sander and driver (hourly), front-end loader and driver (hourly), salt or approved deicing material (per yard), and minimum charge per trip. Bidders must provide transparent, all-inclusive pricing for each of the three contract years, incorporating anticipated changes in labor, equipment, and materials without separate fuel, travel, or delivery surcharges. Contractors must identify any applicable non-business-hour, holiday, or emergency rates, as the facility operates outside normal business hours. All rates must comply with FAC120 pricing requirements and ceiling rates. Award will be based on best value in accordance with FAC120 requirements and Commonwealth procurement requirements. The SOW does not guarantee a minimum number of service calls, hours, quantities of materials, or total expenditures during any contract year, and sales tax shall not be charged.

1. Contract Performance and Business Specifications

1. Scope of Services This Statement of Work (“SOW”) is issued by the Massachusetts Department of Youth Services (“DYS”) under Statewide Contract FAC120 – Landscaping Services, Snow Removal, Tree Services and Related Services, Category 2 – Snow Removal Services.

DYS is soliciting quotes from eligible FAC120 contractors to provide snow plowing, pretreatment, sanding, deicing, and related snow and ice removal services at the DYS facility (“Facility”) located at 456 Flax Pond Road, Brewster, MA 02631.

All services provided under this SOW shall be performed in accordance with the terms, conditions, specifications, pricing requirements, and other applicable requirements of FAC120. In the event of a conflict between this SOW and the terms of FAC120, the applicable terms of FAC120 shall govern.

Contract Period DYS anticipates establishing an agreement for a period of up to three (3) years, subject to the continued availability and applicable term, extension, and extend-beyond provisions of FAC120; the availability of appropriated funds; continued DYS need for the services; and satisfactory Contractor performance.

Nothing in this SOW shall be construed to extend FAC120 or authorize services beyond the period permitted under the Statewide Contract.

Facility and Service Requirements The Facility is located inside Nickerson State Park. The access road from Route 6A at the entrance to the State Park to the Facility is approximately 1.25 miles long. This roadway, together with Facility parking spaces and other paved areas, must be cleared and treated as needed to maintain safe and operational access throughout the winter months.

During extremely heavy storms or when snow accumulation requires relocation of snow, DYS may authorize the use of a front-end loader or other appropriate equipment.

The Contractor must be capable of responding to service calls throughout the day or night and in varying winter weather conditions. Unless otherwise authorized by DYS, the Contractor must arrive at the Facility no later than two (2) hours after being contacted by authorized DYS personnel.

The Contractor shall check in and check out with designated DYS Facility staff to establish service start and end times for billing purposes. Billable service time shall begin upon arrival at the Facility. An allowance of up to one-quarter (¼) hour may be included for plowing or treating the approximately 1.25-mile access roadway from Route 6A to the Facility prior to check-in.

The Contractor shall coordinate with Facility staff regarding the movement of vehicles and other operational considerations necessary to maximize the areas available for snow and ice removal.

Pretreatment and Deicing Products The Contractor may pretreat paved surfaces when conditions warrant and when authorized by the DYS Facility Director, Maintenance Supervisor, or other authorized DYS representative.

Deicing and snowmelt products used in the performance of this SOW shall comply with applicable FAC120 requirements. Consistent with FAC120 environmentally preferable purchasing guidance, the Contractor shall use deicing and snowmelt products certified under the U.S. Environmental Protection Agency (EPA) Safer Choice Program, as applicable.

The Contractor shall identify the proposed deicing/snowmelt product in its Quote upon request by DYS.

Salt, deicing, and snowmelt materials included in the Contractor's performance of snow removal services may be quoted as an applicable material charge. This SOW does not constitute a solicitation for the standalone purchase of salt or deicing materials.

2. Pricing and Quote Requirements Bidders must submit specific and transparent pricing for all services, equipment, and materials anticipated under this SOW.

All quoted rates shall be Not-to-Exceed (“NTE”)/Ceiling Rates for purposes of this SOW. Quoted rates may not exceed any applicable FAC120 NTE/Ceiling Rates or other pricing limitations established under the Contractor's FAC120 award.

DYS reserves the right, consistent with FAC120, to negotiate rates below the quoted or applicable ceiling rates.

The Contractor shall disclose all applicable charges as part of its Quote. Separate fuel, travel, delivery, or similar surcharges will not be permitted. Any such costs must be incorporated into the Contractor's quoted rates.

Three-Year Pricing Bidders shall provide pricing for each anticipated Contract Year. Rates quoted for each Contract Year shall constitute the Contractor's NTE rates for that Contract Year, subject at all times to FAC120 pricing requirements.

Bidders should incorporate anticipated changes in labor, equipment, materials, and other allowable costs into their proposed rates for each applicable Contract Year.

The Contractor may not increase an established Contract Year rate without the express prior approval of DYS and compliance with FAC120 and other applicable Commonwealth requirements.

Bidders shall identify any other charge that may apply to the services requested under this SOW. No undisclosed fee, surcharge, equipment charge, material charge, or other additional cost may subsequently be imposed without the express prior approval of DYS and compliance with FAC120.

Bidders shall also identify any applicable rates for emergency services, holidays, or non-business hours where such rates differ from the rates quoted above. Any such rates must comply with the Contractor's FAC120 award and applicable NTE/Ceiling Rates.

For purposes of FAC120, Business Hours are Monday through Friday, 7:00 a.m. to 5:00 p.m., excluding holidays. Because the DYS Facility operates outside normal business hours, bidders must clearly identify any applicable non-business-hour, holiday, or emergency pricing in their Quote.

3. Award and Contract Administration This procurement is being conducted under Statewide Contract FAC120. Only contractors eligible to provide the requested services under FAC120 Category 2 – Snow Removal Services and applicable geographic coverage should submit a Quote.

DYS will evaluate responsive Quotes in accordance with FAC120 requirements and applicable Commonwealth procurement requirements. For non-construction services under FAC120, award will be based on best value.

DYS reserves the right to negotiate with the apparent successful bidder consistent with FAC120.

The successful Contractor shall reference FAC120 on all Quotes and invoices submitted in connection with this engagement.

No prepayment shall be made for services not yet rendered. Sales tax shall not be charged. Fuel, travel, delivery, and similar surcharges shall not be separately charged.

Any adjustment to an accepted Quote resulting from changes directed or approved by DYS or circumstances arising during performance shall require the express prior approval of DYS before the additional cost is incurred.

This SOW does not guarantee the Contractor any minimum number of service calls, hours, quantities of materials, or total expenditures during any Contract Year.
