About this file

This document is a Determination and Findings (D&F) for Brand Name Justification from the U.S. Marine Corps Forces, Special Operations Command (MARFORSOC). The document justifies a sole-source procurement of Symantec anti-virus software for 550 computers, citing critical integration and operational requirements. Key justification points include the substantial labor cost and operational disruption that would result from switching anti-virus providers, including the need to manually remove existing Symantec software from nearly 500 computers, potential gaps in malware protection for deployed units, and the requirement to create a new system image with alternative software. The determination concludes that sourcing the specific Symantec product is appropriate under Federal Acquisition Regulation (FAR) 13.106-1(b)(1), with the procurement representing the most cost-effective and operationally efficient approach for MARFORSOC's cybersecurity needs.

UNITED STATES MARINE CORPS

DETERMINATION AND FINDINGS

DETERMINATION FOR BRAND NAME JUSTIFICATION (FAR 13.106-1(b)(1))

Subj: Symantec – M209705774245

FINDINGS

U.S. Marine Corps Forces, Special Operations Command (MARFORSOC), Camp Lejeune, North Carolina, has submitted a supply requirement for renewal of the Symantec anti-virus protection to be installed on 550 computers. The required supply will be purchased via brand name justification based on the following:

The required supplies must be brand name specific to meet the minimum needs of the Government (MARFORSOC). The equipment must be compatible in all aspects (form, fit, function) and integrate with existing systems presently installed. Changing to another anti-virus software will require touch labor on almost 500 computers within MARFORSOC. This would require technicians to remove Symantec from each computer and install alternate software. This would cost hundreds of man hours to accomplish. Also, computers that are currently deployed with Symantec will not be protected from malware. The customer does not have any methods to provide the new software version to deployed units. Additionally, a new image will need to be created with a different software if an alternate anti-virus is used. An alternative anti-virus would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

DETERMINATION

Based on the foregoing, it is hereby determined that the subject requirement involves supplies that must be sourced through companies that sell the identified brand name and is within the concept set forth by FAR 13.106-1(b)(1). Therefore, award and execution of the contract is appropriate.
