About this file

This is a Certification of Noninvolvement in Prohibited Activities in Russia or Belarus form required by the State of New Jersey pursuant to N.J.S.A. 52:32-60.1 for any vendor seeking to enter into or renew a contract with a State agency. The certification requires vendors to verify their status on the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list and confirm that they are not identified on this list due to activity related to Russia and/or Belarus, or to disclose if they are so identified. Vendors must complete one of three certification options: confirming non-involvement, acknowledging inability to certify non-involvement, or disclosing involvement while asserting consistency with federal law, regulation, license, or exemption. The form requires submission of vendor information including name, FEIN, address, phone, fax, and email, along with the signature and title of an authorized representative and submission date.

The certification applies to all vendors defined as natural persons, corporations, partnerships, limited liability entities, business associations, governmental entities, and any parent, successor, subunit, subsidiary, or entity under common ownership or control with such entities. The Department of the Treasury is authorized to impose sanctions, seek compliance, recover damages, declare parties in default, or pursue debarment or suspension of vendors who make false certifications. The form references the OFAC sanctions search portal and New Jersey Public Law 2022, Chapter 3, and must be completed and submitted prior to contract award or renewal. No specific pricing, set-asides, or contract amounts are addressed in this certification document, as it functions solely as a compliance and eligibility verification requirement.
