About this file
This document is a Certification of Non-Involvement in Prohibited Activities form issued by the State of New Jersey, specifically addressing vendor interactions with Russia and Belarus. The form requires vendors seeking to enter into or renew contracts with state agencies to certify their status regarding the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list. Vendors must select one of three certification options: (A) not identified on the list for Russia/Belarus-related activities, (B) identified on the list for Russia/Belarus-related activities, or (C) identified on the list but engaged in activities consistent with federal law.
The certification is mandated under N.J.S.A. 52:32-60.1 and applies to a broad definition of "vendor" including corporations, partnerships, governmental entities, and other non-governmental organizations. The form provides legal consequences for false certifications, with potential actions including sanctions, compliance enforcement, damage recovery, default declaration, and potential debarment or suspension. Vendors must complete the form by providing their contact information, authorized representative details, and potentially explaining any Russia or Belarus-related activities if applicable.
