About this file

This document is a Request for Statement of Qualifications (RFSQ) issued by the Utah Department of Health and Human Services (DHHS) to establish an open-ended Approved Vendor List (AVL) with qualified vendors to provide a variety of behavioral health services. The services requested include psychotherapy, psychological and neuropsychological evaluation, pharmacologic evaluation, psychosocial rehabilitative services, and various other clinical and support services. Vendors must meet mandatory minimum requirements and may be required to submit sample evaluation reports for certain service codes. The AVL will remain open until DHHS determines there is no longer a need for additional vendors, at which point it may be closed with 30 days' notice. Vendors on the AVL may then be selected for future procurements through bidding, request for proposals, or small purchase processes.

The RFSQ does not require vendors to submit pricing, as rates will be established by DHHS. There is no guarantee of use for vendors placed on the AVL. The RFSQ is open-ended, and vendors may submit responses at any time prior to the closing date. The RFSQ does not mention any set-asides, incumbents, or specific funding sources, but notes that rates are subject to change based on legislative appropriations or DHHS budgetary action.

DHHS anticipates that this solicitation will remain open until the posted closing date. However, DHHS may close the solicitation upon 30 days’ notice published in SciQuest if DHHS determines there is no longer a need for additional vendors. DHHS may reopen the solicitation for a period of not less than 30 days if DHHS determines it needs additional vendors.

7. Documentation of Meeting Mandatory Minimum Requirements:

Submit documentation for each service you are applying for that demonstrates compliance with the minimum mandatory requirements found on DHHS91073 Form 4 – Service Application.

8. Sample Forensic and DSPD Eligibility Evaluation Reports For each individual proposing to provide evaluation services, the vendor must submit a sample evaluation report prepared by that individual for each type of evaluation service the individual is proposing to provide. Sample reports must:

a. Have all names substituted with a pseudonym to protect confidentiality; and

b. Meet the requirements described in the Scope of Work for the type of evaluation report being submitted.

Evaluation: The evaluation criteria and any score thresholds are found on the Evaluation Score Sheet.

Pricing: Vendors should not submit pricing for this solicitation. Pricing for contracts awarded pursuant to this solicitation are based on rates established by DHHS. Rates are subject to change based upon legislative appropriations or DHHS budgetary action.

No Guarantee of Use: A contract award is not a guarantee that the contractor will be requested to provide any services.

Restrictions on Communication: From the RFSQ issue date until an AVL is published, vendors are prohibited from communications regarding this RFSQ with the evaluation committee members or other associated individuals EXCEPT for the DHHS procurement officer overseeing this RFSQ. Failure to comply with this requirement may result in disqualification.

Question and Answer Period: All questions must be submitted through SciQuest. The Question and Answer (“Q&A”) period closes on the date and time stated in SciQuest. Questions may include notifying DHHS of any ambiguity, inconsistency, scope exception, excessively restrictive requirement, or other errors in this RFSQ. Questions are encouraged. Answers from DHHS will be posted on SciQuest and may modify requirements. Vendors should review questions and answers prior to submitting a response. Exceptions taken by a vendor to the content of this RFSQ that are not raised during the Q&A period may result in the vendor being rejected.

Addenda: Vendors are encouraged to check SciQuest for addenda. Any modification to this RFSQ will be made by addendum published on SciQuest. Addenda to this RFSQ may change the Scope of Work, the schedule, the qualification requirements, the criteria, or other requirements of this RFSQ.

Protected Information: Any vendor requesting that a record be protected must include with its response a completed Claim of Business Confidentiality form (https://purchasing.utah.gov/wp-content/uploads/Business-Request-for-GRAMA-Business-Confidentiality-Claim.pdf) including a redacted copy of the response for public release that is clearly labeled “REDACTED COPY FOR PUBLIC RELEASE”. An entire response cannot be identified as confidential and if submitted as such, will be considered non-responsive unless the vendor removes the designation.

PART 2: PROPOSAL EVALUATION & CREATION OF AVL

Stage 1: Mandatory Minimum Requirements All responses will be reviewed for responsiveness to the mandatory minimum requirements. Responses that do not meet the mandatory minimum requirements will be deemed non-responsive and rejected. Responsible vendors who successfully pass Stage 1 will either have their names placed on the AVL or move on to Stage 2, whichever is applicable. Stage 2 is for forensic evaluation and DSPD eligibility evaluation service codes only.

Stage 2: Evaluation of Sample Forensic and DSPD Eligibility Evaluation Reports Sample forensic and DSPD eligibility evaluation reports shall be evaluated and scored by an evaluation committee using the score sheet published with this RFSQ. Sample reports must meet the minimum score threshold for each required element of the report in order for the individual who prepared the sample report to be found qualified to provide the type of evaluation service for which the sample report was submitted. Sample reports must comply with, and be scored against, the scope of work requirements for evaluation reports. In order to be considered for an award for a service code, vendors must receive a score of three or greater from each evaluator for each service code criteria.

Responses that do not meet the minimum required score thresholds will be deemed non-responsive and rejected. Only responsible vendors whose responses meet the mandatory minimum requirements, evaluation criteria, and score thresholds will be included on the AVL.

If a vendor’s response is rejected for not being responsive, the vendor may resubmit during the open period of this RFSQ.

AVL Placement: The AVL will include only responsible vendors who: (i) submit a responsive statement of qualifications; and (ii) meet the minimum requirements, evaluation criteria, and applicable score thresholds.

AVL Period: Vendors approved through this RFSQ process may remain on the AVL for a period of 18 months after which time the vendor’s qualifications must be reverified for the vendor to remain on the AVL.

Rating System: A performance rating system will not be used for evaluating the performance of vendors on the AVL.

Secondary Process: After the AVL is created, DHHS may use a bidding, request for proposals, or small purchase process, or DHHS may award a contract to a vendor at established prices in accordance with UCA 63G-6a-507(6). Only vendors on the AVL will be able to participate in the procurements stated above. DHHS anticipates using the AVL to contract with multiple vendors.

PART 3: GENERAL TERMS

Debarment: By submitting a response the vendor certifies that neither it nor its principals are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction (contract) by any governmental department or agency. If the vendor cannot so certify, it must attach a written explanation for review by DHHS.

Utah Tax Liens: By submitting a response, the vendor certifies that it does not have any outstanding tax liens in Utah which would prevent it from responding to this RFSQ under UCA § 63G-6a-905 or, if it does, it will notify the procurement officer.

Costs: All costs incurred by a vendor in the preparation and submission of a response are the responsibility of the vendor and will not be reimbursed.

Service Changes: DHHS may change service elements during the term of any contract resulting from the RFSQ in accordance with the Utah Procurement Code.

PART 4: ADDING SERVICES TO AN EXISTING CONTRACT

Vendors who previously responded, were added to the AVL, and awarded a contract may submit a request to add new services to their contract as long as the vendor is still on the AVL with an active contract. Requests to add services to an existing contract must include the following:

1.DHHS91073 Form 4 - Service Application with only the newly requested services checked; and
2.Any required documents to demonstrate that the contractor meets the required qualifications to provide the newly requested services.

Submit the requests to add services via email to susanstengel@utah.gov and include “RFSQ #DHHS91073, Request to Add Services” and the Vendor’s name in the subject line.
