Determination to Solicit from a Single Source

This is a single-source justification document for solicitation 140R2026Q0048 issued by the U.S. Department of the Interior, California Great Basin, Acquisition Services in Sacramento, California. The procurement is a firm-fixed-price, portion brand-name acquisition from American Emergency Response Training (AERT), Inc., located at 2175 Stock Creek Blvd, Rockford, Tennessee 37853-3053. The contract will provide confined-space rescue equipment and training for the Northern California Area Office (NCAO) personnel with an estimated value and 60-day delivery lead time after order receipt.

The required items include multiple AERT-branded personal gear sets in various sizes (totaling 11 sets), rescue technician kits, stretcher packs, safety equipment such as litters and ropes, tripod systems, gloves, and various specialized climbing and rescue hardware. While some items are marked as AERT brand-name requirements, others may be procured as equivalents. AERT is the sole source because the equipment contains proprietary functions requiring continuity with existing NCAO rescue operations, and AERT holds exclusive licensing rights for the required training, methodologies, and training platforms. No other vendor is authorized to deliver the specialized instruction or access the controlled training content. Additionally, NCAO personnel are already trained on AERT equipment models currently in use, and standardizing on the same brand eliminates operational risk and training variability. Price reasonableness will be determined through competitive quotes on the portion brand-name items. Market research confirmed AERT does not have a GSA contract, and SBA search identified only 10 vendors capable of fulfilling the requirement. The solicitation is set aside as a total small business set-aside.

4. Description of Circumstances, including why only one source is reasonably available.

procured from AERT because the items contain proprietary functions that require continuity with existing Northern California Area Office (NCAO) rescue equipment and training.

This acquisition requires the procurement of specific training associated with the items listed above. The contractor, AERT, holds the proprietary licenses necessary to provide training on these required items. Due to the proprietary nature of AERT’s licensed materials, methodologies, and training platforms, no other vendor is authorized to deliver the required instruction or access the controlled training content.

AERT’s exclusive licensing rights limit the availability of qualified sources capable of meeting the Government’s technical and instructional requirements. As a result, training for these items cannot be obtained through alternative providers without compromising compliance, technical accuracy, or the integrity of the proprietary systems involved.

legal authority and capability to provide the licensed training needed to support the Government’s operational requirements.

Moreover, NCAO rescuers have been trained specifically on the AERT equipment models currently in use. Procuring the same brand ensures that personnel can operate the equipment across the rescue team eliminates variability that could compromise established rescue protocols or introduce operational risk.
