1 Scope of Work The United States Trustee Program (USTP) requires remote (virtual) and in-person court reporting services for proceedings such as depositions and examinations that may include transcription services, video streaming services, audio transcription services, video recording services, DVD/MPEG conversion, PTX/PDF files, stenotype services, videographer services, remote court appearance services, remote legal collaboration services, and/or telephonic proceeding services to be delivered on a nationwide basis.
1.1 Definitions
A deposition or examination is a type of proceeding for which attorneys obtain evidence for a case. Examples include depositions authorized under Federal Rules of Civil Procedure (“FRCP”) 27 and 30 and Federal Rules of Bankruptcy Procedure (“FRBP”) 7027, 7030, and 9014 and examinations under FRBP 2004. The witness being questioned may share information via their description of events or as an expert witness. The witness is under oath and questioned by the “taking” attorney. A deposition or examination service, whether remote or in-person, ensures that the process runs smoothly, and the parties involved have a reliable, accurate record of the proceeding. The functions involved in deposition or examination services include the following elements:
Remote (Virtual) proceedings are defined as proceedings where at least one participant (party, court reporter, attorney, deponent, etc.) is not physically present in the same location as the other participants and the proceeding is transmitted via live, remote video at the request of the USTP. Court reporting services for remote (virtual) proceedings involve the production of a verbatim transcript using either digital court reporting or stenotype services at the election of the USTP.
In-Person/Face-to-Face proceedings are defined as proceedings where all participants (party, court reporter, attorney, deponent, etc.) are physically present in the same location at the request of the USTP. Court reporting services for in-person proceedings involve the production of a verbatim transcript using either digital court reporting or stenotype services at the election of the USTP.
Telephonic proceeding is defined by at least one party participating remotely by telephone.
Stenotype services is defined as any proceeding, in which the court reporter uses a stenotype machine to produce a verbatim transcript.
Transcription services include recording, audio transcription, transcribing, proofing, and delivering transcriptions of a wide variety of proceedings, including depositions, sworn statements, arbitration hearings, personnel grievances and appeals, conferences, and committee meetings.
Interpreter services include certified foreign language or sign language translation services provided in-person (not telephonically) during a remote (virtual) or in-person proceeding.
Videographer services include the production of an HD video recording of the proceeding.
A proceeding is an event, including but not limited to an examination or deposition, requiring a verbatim transcript. If the request for service covers more than one event, and each event requires a separate transcript, then each event is considered a separate proceeding. If the request for service covers more than one event, and each event does not require a separate transcript, then the events may be considered one proceeding, e.g., consecutive or concurrent proceedings scheduled on the same date for the same case.
Court reporter means the individual assigned by the Contractor with primary responsibility to attend the proceeding for the purpose of providing court reporting services.
Contractor: The entity to which this contract is awarded, along with its agents, employees, and subcontractors (if any), shall be referred to as the Contractor. The Contractor shall provide qualified personnel when performing services and provide court reporters certified to administer oaths. In addition, the Contractor shall ensure that the court reporter selected for the proceeding is authorized to administer oaths and act as a court reporter under the laws of the state where the witness is located. This requirement is intended in part to ensure compliance with FRBP 7028/FRCP 28(a)(1) and FRBP 7030/FRCP 30(b)(4) and (5), but absent prior written authorization from the POC these requirements shall apply regardless of whether those rules apply to the proceeding, such as a deposition or examination, in question.
USTP Primary Point of Contact (POC): The USTP attorney, support staff, and/or their designee(s) shall be referred to as the POC. The POC has the authority to request services within the scope of the contract. The POC coordinates directly with the Contractor after the initial request is submitted and is responsible for communicating details and updates during the scheduling process.
USTP Litigation Support Team: The IT staff within USTP responsible for providing technical support for the POC throughout the scheduling process shall be referred to as the Litigation Support Team. The Litigation Support Team also communicates user feedback to the Contractor and facilitates support for all contract parties as needed.
Court reporting services include all services provided in connection with an in-person or remote (virtual) proceeding, and include:
· Interactive Realtime with live internet feeds, annotation and reporting using a secure, approved Virtual Private Network (VPN), upon request.

· Hyperlinked exhibits in Adobe PDF format that can be delivered with the electronic transcript.
· Synchronized transcript with video recording, if any, upon request.
· Hard copy transcripts and exhibits, upon request.
· If the case has a Protective Order in place, any potential exchange or shipment of hard copies with USTP shall be avoided, unless the POC specifically requests hard copies. (See also Section 4, Protective Orders)

For security reasons, any capabilities for digitally transferring case exhibits through the video-conferencing platform must be disabled. The Contractor and USTP personnel are only authorized to transfer case exhibits through JEFS, (or via encrypted email), and cannot transmit materials through the platform.
USTP may request additional security settings within these technologies that it deems necessary.
9 Artificial Intelligence Solutions As USTP explores implementation options for artificial intelligence (AI) and anticipates future needs in this area, vendors are encouraged to offer FedRAMP-authorized AI solutions to meet these needs, such as deposition summaries, outlines, and visualizations created using AI. Any AI solutions must meet all Department of Justice requirements.
10 Data All transcripts, recordings, records, exhibits, and any other material which is part of or relates to any action recorded by the Contractor shall be the property of the USTP. If requested by the POC, they shall be delivered together with the finished transcript.
11 Hours of Service Proceedings are normally held between 8:00 a.m. and 6:00 p.m., Monday through Friday, local time, except on Federal Holidays. The Contractor may be required to work at a proceeding outside the hours of 8:00 a.m. and 6:00 p.m. Monday through Friday, local time, upon request of the POC.
If the Contractor is required to attend proceedings outside of normal hours (Saturdays, Sundays, Federal Holidays or from 6:00 p.m. to 8:00 a.m., Monday through Friday, local time), the USTP will pay the Contractor the expedited transcript rate for the pages transcribed outside of normal hours. If an overnight transcript is required, the Contractor shall be paid for the pages transcribed outside of the normal hours at the fixed, per-page price specified in the contract.
12 Sale of Transcript Copies In general, USTP proceedings are considered private. The Contractor may provide copies of transcripts securely to parties of the proceeding at the requester’s expense, and in accordance with USTP’s secure transfer or shipping requirements.
13 Confidentiality Requirement The Contractor, its agents, employees, and subcontractors (if any) shall, in accordance with the provisions of the “Conditional Access to Sensitive but Unclassified Information Non-Disclosure Agreement (NDA),” hold in the strictest confidence any and all information which may be gained in the performance of duties under this contract. This confidentiality requirement continues in perpetuity.
The Contractor, and each of its agents, employees, and subcontractors (if any), shall sign the “Conditional Access to Sensitive but Unclassified Information Non-Disclosure Agreement” if they do any work under this contract. The signed agreements from those contractor employees, agents, and subcontractors known at time of contract award shall be submitted within seven (7) calendar days after the award of the contract. Each reporter or other Contractor employee, agent, or subcontractor shall sign the agreement prior to performing work under this contract and provide a copy of it to the USTP Contracting Officer and/or Contracting Specialist.
14 Conflict of Interest The Contractor, its agents, employees, and subcontractors (if any), shall have no conflict of interest related to the proceedings with individuals involved in the proceedings. If a possible conflict of interest exists, the Contractor shall immediately bring the potential conflict to the attention of the POC.
15 Legal Requirements and Permits The Contractor shall obtain, at the Contractor's expense, all necessary licenses, and permits, including a notary public license when necessary, and shall conform to all laws, regulations, and ordinances applicable to performance of this Contract.
16 Point of Contact The Contractor shall provide a Contract Administrator as a single point of contact for coordinating all contract activities. The Contractor shall also designate an Alternate Contract Administrator if the Contract Administrator is absent.
The Contractor shall notify the USTP in writing of any intended replacement for the Contract Administrator or Alternate Contract Administrator.
