All inquiries must be submitted in writing no later than eight business days prior to bid opening. The initial contract term is one year from the date of execution, with one optional one-year renewal by mutual written agreement executed at least thirty days prior to expiration, not to exceed twenty-four consecutive months total. The contract may be terminated by the Township for cause with ten days' written notice and opportunity to cure, or for convenience with thirty days' written notice.

Work must be estimated and authorized through Township purchase orders prior to commencement, with estimates under $2,500 requiring brief written descriptions and those of $2,500 or more requiring detailed scope, labor-by-classification, itemized materials with markup applied separately, and not-to-exceed pricing. The New Jersey Prevailing Wage Act applies on a project-by-project basis when individual project costs meet or exceed the current municipal threshold of $19,375, which requires payment of applicable prevailing wage rates, certified payrolls, and site posting of rates. Contractors must obtain and pay for all required permits and comply with the New Jersey Uniform Construction Code and all applicable federal, state, and local regulations. Bid security in the amount of 10 percent of the bid (maximum $20,000) is required, and the successful contractor must maintain commercial general liability insurance of $1,000,000 per occurrence, automobile liability insurance of $1,000,000 combined single limit, and statutory workers' compensation coverage, with the Township named as an additional insured on all policies.

The New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq., applies to this contract on a project-by-project basis. It does not apply automatically to every project performed under this contract.
6.1 When Prevailing Wage Applies
The Prevailing Wage Act applies to a specific project only if the total contract price for that individual project equals or exceeds the municipal prevailing-wage threshold then in effect (currently $19,375, subject to adjustment). The Township and Contractor shall identify, prior to each Purchase Order, whether the threshold will be met. Related work shall not be artificially split to avoid the prevailing-wage requirement.
6.2 Compliance When Threshold Is Met
For any project meeting or exceeding the threshold: (a) the Contractor and all subcontractors shall pay no less than the applicable prevailing wage rates; (b) the Township will obtain a current Prevailing Wage Determination from NJDOL; (c) the Contractor shall submit certified payrolls per N.J.A.C. 12:60-6; and (d) the Contractor shall post applicable rates at the project site.

9.2 Basis for Comparison
To compare bids, the Township will evaluate each bid based on the submitted labor hourly rates, material markup percentage, and curbing and sidewalk unit prices. The Township will apply its own estimated work volumes to rank bids. Submitted rates and prices are not guaranteed work volumes and do not constitute a commitment by the Township as to the amount of work to be ordered.
