RFQ SP3300-20-Q-0047 1
1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart
12.6 in conjunction with Part 13 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Quote (RFQ) and the solicitation number is SP3300-20-Q-0047.
2. This notice incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2020-04 effective 15 January 2020 and Defense Federal Acquisition Regulation Supplement (DFARS) DPN 230120 (effective 23 January 2020) edition, and Defense Logistics Acquisition Directive (DLAD) Current to Revision 5 and PROCLTR 19- 19 through effective 14 October, 2019. 3. This Request for Quotation (RFQ) is being established for a Firm-Fixed Price (FFP) Contract for DLA Distribution Susquehanna, PA. DDSP has a requirement for seventy-eight (78) Police Duty Lockers. The contractor shall provide all necessary labor and material to cabinets, lockers, bins, and shelving. All equipment furnished shall be new from the manufacturer’s most current production and meet current industry standards, and conform to the best quality of materials and workmanship. Accessories not specifically mentioned herein, but necessary to furnish complete system ready for use, shall also be included and named. All transportation/shipping and installation shall be provided by the contractor.
Certification and Acceptance:
Final acceptance of the Police Duty Lockers will be performed by personnel at the receiving location. Delivery to DLA
Distribution Susquehanna, New Cumberland, PA. The total quantity shall be seventy-eight (78) EA.
The desired completion timeframe is within 30 days after contract award.

6. This acquisition is being solicited as a 100% Small Business Set-Aside. The Federal Supply Code (FSC) for this acquisition is 7125 and the North American Industry Classification System (NAICS) code for this solicitation is 337214 (Office Furniture (Except Wood) Manufacturing with a size standard of 1000 employees. DPAS Rating is not applicable.

shipping, packing, and packaging charges included in the Firm Fixed Unit Price. Price must be rounded to two decimal points. The Contractor shall provide all labor, material, equipment, labor and supervision necessary at DLA Distribution Susquehanna, PA.
8. PROOF OF DELIVERY: To ensure prompt payment to your company, the Proof of Deliveries must include the following:
a. CONTRACT NUMBER or ORIGINAL DOCUMENT NUMBER
b. DELIVERY ORDER NUMBER (as applicable)
c. CLIN /MATERIAL NUMBER
d. SPECIFIC QUANTITY SHIPPED IN REFERENCE TO QUANTITY ORDERED
e. PRINTED NAME AND WRITTEN SIGNATURE OF A GOVERNMENT EMPLOYEE
9. Any award resulting from this solicitation will be issued on a Standard Form (SF) 1449.
10. System for Award Management: IAW FAR 4.1102(a), offerors are required to be registered in the
System for Award Management (SAM) database at the time an offer or quotation is submitted in order to comply with the annual representations and certifications requirements. Refer to DFARS 204.1103 for helpful information on navigation and data entry in the SAM database. Registration may be done on line at: www.acquisition.gov or www.sam.gov.
11. Invoicing and Payment: Invoices shall be submitted through Wide Area Work Flow (WAWF). The WAWF website is at https://wawf.eb.mil/. The web site contains instructions for registration and use, including how contractors submit invoices via WAWF.
12. SITE VISIT: DLA Distribution intends to hold a one (1) hour site visit on Friday April 3, 2020, 11:00 AM Eastern
Time for contractors that are interested in this requirement.
A. Participants will meet at DLA Distribution Susquehanna, Pass and ID Office, at the date and time specified above, and will be escorted to the various sites. Visitors shall arrive one (1) hour early at the Pass and ID Office so that local security can complete their on the spot background checks in a timely fashion.
B. Due to security measures currently in place at DLA Distribution Susquehanna, anyone planning to attend the site visit must register ahead of time. To pre-register, submit the name of the attendee, company name, e-mail address, and phone number, to Ms. Tameka Drayton by e-mail at tameka.drayton@dla.mil. Once that information is received, a registration web site with more detail instructions will be provided via email. The registration must be completed no later than 10:00 AM on Wednesday, March 25, 2020 in order to attend the site visit. This information shall be used to run a security check on every attendee; which includes a criminal background check in accordance with AFMAN 31-113 through GCIC/NCIC. Only U.S. citizens will be permitted access.
C. On the date of the site visit, each attendee will need to present at least one (1) form of photo identification, i.e., valid driver’s license must be original and current (unexpired), (must be in compliance with the Real ID Act of 2005 and must not contain markings such as (“Not Valid for Federal Purpose” “Not for Use as Federal Identification” “Federal Limits May Apply “or similar phrasing, original or certified true copy of a birth certificate bearing a raised seal, social security card and driver license issued by a state, territory, possession or the District of Columbia, or U.S. Passport or U.S. Passport Card when arriving at the Pass and ID Office. In addition, a current state registration and insurance information is required for each vehicle entering the installation.
13. The site visit will be held solely for the purpose of giving contractors an opportunity to view the various areas and extract the Logic from Attachment 1-Locker Requirements and Attachment 2-Prop-Locker-Layout.

14. PACKING AND MARKING REQUIREMENTS: All products shall be packaged best commercial practice in accordance with ASTM 3951. All shipments must contain proper shipping documentation. Contractor shall attach, in a water resistant envelope, to the exterior shipping container a commercial packing list. All documents must include at a minimum, contract number and document number for the item, stock number, quantity, and unit of issue. Omission of any data on the shipping documentation could cause a delay in receipt of goods and significantly delay payment.
15. MARK CONTRACT NUMBER ON ALL CORRESPONDENCE
Contractor must mark the contract or purchase order number on all paperwork. The order number must appear on the exterior of the shipment. Failure to follow these instructions will hold up payment to you and could result in the return of merchandise at your expense.
16. ILLEGAL ITEMS NOT AUTHORIZED ON FEDERAL INSTALLATION: Illegal drugs, guns or other contraband are not authorized on this Federal installation. It is the contractor’s responsibility to ensure that its employees working on-site at this installation are U. S. citizens or legal aliens with no outstanding warrants. This installation is manned by a DoD Police Force who possesses apprehension authority, which includes holding suspects for local authorities. The local authorities can issue a citation that charges the individual with a specific offense and requires the individual to appear before a Federal Magistrate. This agency processes illegal aliens in accordance with INS instructions.
17. MANAGEMENT OF CONTRACTOR EMPLOYEES: The Contractor personnel are employees of the Contractor and under the administrative control and supervision of the Contractor. The Contractor, through its personnel, shall perform the tasks prescribed in the Performance Work Statement. The Contractor shall select, supervise, and exercise control and direction over its employees under this contract. The Contractor shall not supervise, direct, or control the activities of the Government personnel or the employee of any other contractor, except any subcontractor employed by the Contractor on this contract. The Government shall not exercise any supervision or control over the Contractor in the performance of contractual services under this contract. The Contractor is accountable to the Government for the actions of its personnel.
ORGANIZATIONAL CONFLICT OF INTEREST
The contractor shall be ineligible from participation as a contractor, subcontractor, or consultant in any procurement arising or resulting from any of the services provided to DLA on this contract. This restriction includes providing services to any potential bidders on such procurements. The contractor shall not incorporate its product or services in any statement of work or specification unless directed to do so in writing by the Contracting Officer.
If the contractor, in the performance of this contract, obtains access to information such as plans, policies, reports, studies, financial data, internal data, or any other non-public information or information by the Privacy Act, the contractor agrees not to release such information without prior written approval from the Contracting Officer. The use of such information for personal gain is prohibited.
In addition, the contractor agrees that to the extent it receives or is given access to proprietary data, or other confidential or privileged technical, business, or financial information under this contract, it shall treat such information in accordance with any restrictions imposed on such information.

Questions received after this date and time may not receive a response. Answers to questions will be posted to the Federal Business Opportunities website via an amendment to the solicitation. DFARS 252.232-7006 Wide Area Work Flow Payment Instructions
(a) Definitions. As used in this clause— “Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area Workflow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the Central Contractor Registration at https://www.acquisition.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web- Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (AUG 2019)
(a) Definitions. As used in this provision--Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing-- (1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

DLAD 52.233-9001 DISPUTES – AGREEMENT TO USE ALTERNATIVE DISPUTE RESOLUTION
(a) The parties agree to negotiate with each other to try to resolve any disputes that may arise. If unassisted negotiations are unsuccessful, the parties will use alternative dispute resolution (ADR) techniques to try to resolve the dispute. Litigation will only be considered as a last resort when ADR is unsuccessful or has been documented by the party rejecting ADR to be inappropriate for resolving the dispute.
(b) Before either party determines ADR inappropriate, that party must discuss the use of ADR with the other party.
The documentation rejecting ADR must be signed by an official authorized to bind the contractor (see FAR 52.233-1), or, for the Agency, by the contracting officer, and approved at a level above the contracting officer after consultation with the ADR Specialist and legal counsel. Contractor personnel are also encouraged to include the ADR Specialist in their discussions with the contracting officer before determining ADR to be inappropriate.

FAR 52.212-2 – Evaluation – Commercial Items Quotes will be evaluated in accordance with FAR 13.106-2. The Government intends to award one contract on an all-or-none basis to the responsible offeror who: 1) proposes the brand name products addressed in the requirement description and 2) offers the total overall lowest price for all contract line items. Offerors must be determined to be responsible according to the standards of FAR Part 9 to be eligible for award. Although the Government intends to award a purchase order as a result of this solicitation, the Government reserves the right to reject any and all quotes received and not award any item or items from this solicitation.
