If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract;
and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

ALL PERSONNEL WORKING ON THIS CONTRACT MUST BE A U.S. CITIZEN AND POSSESS A FINAL DOD CLEARANCE OF AT LEAST SECRET OR EQUIVALENT LEVEL OF ACCESS. THE CONTRACTOR SHALL PROVIDE AND MAINTAIN A SYSTEM OF ADEQUATE SECURITY CONTROLS AS SET FORTH IN THE NATIONAL INDUSTRIAL SECURITY PROGRAM OPERATING MANUAL (NISPOM) CFR 32, CH 117. THE CONTRACTOR, AND ANY SUB-CONTRACTORS, SHALL ALSO COMPLY WITH THE DOD OPERATIONS SECURITY (OPSEC) PROGRAM MANUAL, DOD 5205.02-E, AND THE
CONTRACTOR OPSEC PLAN.
No Security Classification Guides (SCGs) currently exist for this contract. As required on individual Task Orders, SCGs would be provided for additional security guidance. In the absence of a SCG, classified information generated in support of this contract must be marked in accordance with the source material provided.

Access to classified information, if applicable, will be provided by the sponsoring Program Office at the performance location reflected in Item 8 of this DD Form 254, and any other location established per this contract. Item 11(j): The Contractor shall utilize the NNSY Critical Information and Indicators List(CIIL), to help identify and protect critical information associated with this contract.
Item 11(j): During the period of this contract, the Contractor may be exposed to, use, or produce, NNSY Critical Information (CI) and/or observables and indicators which may lead to discovery of CI. NNSY's CI will not be distributed to unauthorized third parties, including foreign governments, or companies under Foreign Ownership, Control, or Influence (FOCI).
Item 11(j): Assembled large components/systems being transported to and from testing areas, other production or government facilities (whether or not on public roadways) shall be in an enclosed van trailer or covered flatbed trailer. Component/System outside storage, staging, and test areas shall be shielded/obscured from public view wherever physically possible.
Item 11(j): NNSY's CI shall not be publicized in corporate wide newsletters, trade magazines, displays, intranet pages or public facing websites. Media requests related to this project shall be directed to NNSY Public Affairs Office listed in Item 12 of this DD Form 254.
Item 11(j): Any attempt by unauthorized third parties to solicit, obtain, photograph, or record, or; incidents of loss/compromise of government Classified or CI, Business Sensitive, Company Proprietary information related to this or other program must be immediately reported to the Facility Security Officer, Defense Counterintelligence & Security Agency and/or the Naval Criminal Investigative Service, and the NNSY Industrial Security (Code 1122). Questions concerning these requirements shall be directed to the NNSY Industrial Security (Code 1122).
Item 11(j): Performance under this contract requires the contractor to adhere to OPSEC requirements. OPSEC requirements are additional to the requirements of US CFR 32, CH 117, National Industrial Security Program Operating Manual, therefore, the Contractor may not impose OPSEC requirements on its subcontractors unless NNSY NAVSEA C-1122 approves the OPSEC requirements.
Item 11(l): U-NNPI CUI must be protected in accordance with OPNAVINST N9210.3 and may not be stored or processed on Non-federal AIS without written authorization of NAVSEA 08, Naval Reactors.

CUI such as FOUO, Security Classification Guides (SCG), and other technical information with Distribution Statements B, C, D, E or F are not authorized for public release and cannot be placed on a publicly accessible web site or web server. All emails containing such information or attachments, shall be protected per NIST SP-800-171. All transmissions to personal email accounts (AOL, Yahoo, Hotmail, Comcast, etc.) and posting on social media websites (Facebook, Instagram, Twitter, LinkedIn, etc.) are prohibited. Destroy all CUI associated with this contract by any of the following approved methods: A cross-cut shredder; a certified commercial destruction vendor; a central destruction facility; incineration; chemical decomposition; pulverizing, disintegration; or methods approved for classified destruction.
Classified or unclassified technical papers to be presented at a classified symposium must be approved by the Contracting Officer's Representative (COR) and Subject Matter Expert (SME) prior to the presentation.
The Contractor must submit a request for sharing of classified and other sensitive information between prime contracts and subcontractors in writing to NNSY Industrial Security (Code 1122) Security Officer identified in block 17 of this form for approval. Each request must reference the specific contract as well as identify the specific information for which approval is being sought, a justification for needing to share the information, the name of other contractor and its contract number under which the requested information will be shared.
Personnel designated as derivative classifiers shall receive derivative classification training prior to access from the contractor's Facility Security Officer (FSO). The FSO shall ensure personnel receive initial and annual refresher training during the life of this contract.
Evidence of completion, training certificates or equivalent, shall be provided to the Information System Security Manager (ISSM) no later than the individual's due date.
All contractors requiring access to DoD or DoN Information Systems and computer networks will be required to complete all command access authorization documentation as well as provide evidence of the completion of initial/annual security requirements training. All contractors and FSOs will allow NNSY NAVSEA Personnel Security to own/service their respective personnel in the DoD System of Record (DISS or its successor system).
All classified documents must be destroyed using a National Security Agency (NSA) approved high security crosscut shredder listed on the NSA/CSS evaluated products list (EPL) for high security crosscut paper shredders, or other approved method for destroying classified information.
Copies of preliminary inquiry or investigative reports of security incidents involving classified information shall be scanned and forwarded to the NNSY Industrial Security (Code 1122).
The contractor must also provide a copy of the subcontractor DD 254s issued under this contract to the COR and the NNSY Industrial Security (Code 1122).
Contact the COR and the certify official in block 17 on this DD254 for any security questions related to this contract.
All reports of contractor security violations associated with this contract shall be sent by the Cognizant DCSA field office directly to the certifying official in Item 17 of this DD254.
All security related requests pertaining to this contract shall be submitted in writing by the contractor’s Facility Security Officer (FSO) to the certifying official in Item 17 of this DD254.

What is OPSEC?
OPSEC is a process used to protect sensitive information from exploitation by an adversary. Sensitive information, which is also referred to as Critical Information (CI), is defined as information that needs to be protected from unauthorized disclosure whether classified or unclassified.
What is an OPSEC Plan?
An OPSEC plan is used to record, identify and monitor the contractor’s OPSEC activities during the performance of the contract. After award but prior to availability start date, this OPSEC Plan must be signed by the Prime contractor and forwarded to the assigned contracting official by encrypted email, through the approved Department of Defense Safe (DoD) Secure Access File Exchange (SAFE) at https://safe.apps.mil, or by United States Postal Service.
Consideration shall be given depending on the type of work being performed, the environment, and circumstances in which contract performance will occur. In some cases, an OPSEC Plan will be required. In other cases, the contractors may only simply be required to receive this basic OPSEC contract requirements form.

Responsibility of the Contractor
It is the responsibility of all contractors and subcontractors to avoid inadvertent disclosure of unclassified or classified information during the period of this contract.
OPSEC compromise is the disclosure of Critical Information (CI) or sensitive information, which has been identified by the Command and any higher headquarters to adequately protect its personnel and equipment.
During the period of this contract, contractor personnel may be exposed to, use, or produce, U.S. Government CI and observable indicators which may lead to disclosure of CI. NNSY CI will not be distributed to unauthorized third parties, including foreign government or companies under Foreign Ownership, Control or Influence (FOCI). The contractor shall protect all CI in a manner appropriate to the nature of the information.
U.S. Government CI shall not be publicized in corporate wide newsletters, trade magazines, displays, internet page or public websites. All transmission to personal email accounts (AOL, Yahoo, Gmail, Hotmail, Comcast, etc.,) and posting on social media websites (Facebook, Instagram, Twitter, LinkedIn, etc.,) is prohibited. Media requests related to this project shall be directed to NNSY Public Release Authority.
The Contractor and its personnel should realize that disclosure or compromise of CI to unauthorized persons, whether willfully or through gross negligence, carelessness, or indiscretion, may warrant action to remove the individual assigned or to terminate contract. Furthermore, such conduct may be cause for criminal prosecution and imposition of criminal and civil penalties.
Protect Controlled Unclassified Information (CUI): Unclassified information requiring safeguarding and dissemination controls, consistent with applicable law, regulation, or government-wide policy. Any attempt by unauthorized third parties to solicit, obtain, photograph or record incidents of loss or compromise of CUI or other pertinent sensitive

NNSY Portable Electronic Device (PED) Policy
Portable electronic devices (PEDs) include, but are not limited to: pagers, mobile/cellular telephones (with/without cameras), personal digital assistants/job performance aids, laptop/notebook/handheld computers, digital imagery (still/video) devices, analog/digital sound recorders (e.g. I-PODs), Fit-Bits, I-Watches, video game devices, USB devices, and devices of similar capability, functionality, or design. These devices are controlled and their use is dependent upon Shipyard guidance. Before use, coordinate with your sponsor, who can assist you by obtaining and sharing these requirements/controls with you. It is expected that if additional guidance is needed, the sponsor will coordinate with NNSY Computer Security division and determine what can be used and what is prohibited. Failure to do so risks security violations for the holder of the device.

• Contractor shall not post classified information or Controlled Unclassified Information (CUI) to company websites, publications, newsletters or other media, images, data or information that reveal sensitive government operations, personnel, or equipment details.
• Shred ALL sensitive information, CUI and other pertinent critical information when no longer needed. Do not throw any shipyard related documents in the trash. Use the approved NSA crosscut shredders assigned.
• DO NOT post shipyard related information on public social media websites.
• Remove issued badges when you leave the shipyard, including lunch hours. Upon completion of contract, return all access badges, passes, keys before leaving NNSY premises. Badges and passes may not be duplicated, copied or loaned to others. Lost or stolen identification badges must be reported immediately.
• Report any unauthorized disclosure or, known and suspected compromises of critical information immediately to the unit sponsor, prime contract officer and the units Command Security Manager.

Applicability and DoD Requirement This form is only completed by NNSY (UIC 42158) requiring activity representative requesting contract work on board NNSY. When submitting a requirement for a contract, this questionnaire shall be completed prior to solicitation or sole source award by the requiring activity, with the assistance from the assigned contracting representative, or Government Contracting Activity (GCA). The requiring activity representative, assigned contracting representative, or GCA must work with the NNSY OPSEC Program Manager (PM)to identify the scope of work to be performed and determine security provisions for Critical Information (CI) if disclosed in the Statement of Work (SOW), Request for Proposal (RFP), or Performance Work Statement (PWS).
Before the contracting representative submits to the supporting contracting company, the OPSEC PM is required to conduct an OPSEC review of the SOW, RFP, or PWS prior to the release to contract bidders. As a publicly released document, the SOW, RFP or PWS may reveal CI or indicators of CI.
What is an OPSEC Security Plan?
An OPSEC Plan is used to identify and monitor a contractor’s OPSEC activities during the performance of a contract. It is intended to be a living document that will require periodic updates throughout the life of the contract. The OPSEC plan; (1) Describes the OPSEC environment to include identification of CI, the OPSEC threat and vulnerabilities an adversary might exploit to acquire CI, (2) Documents the OPSEC risk analysis, (3) Identifies proposed and actual OPSEC measures,(4)Defines and assigns specific OPSEC responsibilities and ties the OPSEC Plan to the contractor’s corporate OPSEC Program, and (5) Serves as a repository of the OPSEC history of the contract.
If an OPSEC plan is required, the requirement activity representative, assigned contract representative, or GCA will forward the NNSY OPSEC Plan to the potential awardee by encrypted email, through Department of Defense Safe (DoD Safe) Secure Access File Exchange (https://safe.apps.mil). After award but prior to availability start date, the OPSEC plan must be signed by the Prime contractor and forwarded back to the assigned contracting official or the requirement activity representative by encrypted email. In other cases, the contractor may only simply be required to receive the basic OPSEC contract requirements, which means no OPSEC Plan is required.

The OPSEC Contract Requirements and the OPSEC Standard Language are combined as one document. The OPSEC Contract Requirement document must be included in all solicitations and awards. This way, the OPSEC requirements are not buried in contract language and can be provided in a separate attachment.
NOTE: The OPSEC Standard Language must be included in all contract solicitation and the resulting contract awards in sufficient detail to ensure complete contractor understanding of all OPSEC provisions.

PERFORMANCE WORK STATEMENT
NORFOLK NAVAL SHIPYARD PRODUCTION SUPPORT TOUCH LABOR
INDEFINITE DELIVERY/INDEFINITE QUANTITY
1.0 INTRODUCTION
1.1 Scope: This Performance Work Statement (PWS) supports touch labor requirements under Norfolk Naval Shipyard (NNSY) Naval Supervisory Authority (NSA) Lead Maintenance Activity (LMA) cognizance. The purpose of this Firm-Fixed-Price (FFP) contract is to provide a specific supply of production touch labor to support the repair, maintenance and alterations requirements for U.S. Navy waterborne vessels, surface ships and submarines at any location under NNSY NSA/LMA cognizance.
The Contractor(s) shall provide all labor, labor skill sets, management, supervision, coordination, safety management, environmental management, material, equipment, and transportation necessary to perform the requirements of each Task Order issued. The Contractor shall ensure adequate (required quantity and skill set) resources are dedicated to complying with the standards, guidelines and procedures as stated to satisfy the requirements of associated Task Orders.
1.2 Level of Effort: The table accompanying this PWS as Attachment 1, represents the level of effort in man-days of direct labor needed, straight time (ST) hours and over time (OT) hours for each of the ELIN labor category services for the five-year ordering period. The total number of man days of direct labor includes subcontracted labor hours, but does not include holiday, sick leave, vacation, and other absence hours. One man day equals eight hours.”
2.0 GENERAL CONTRACT REQUIREMENTS
2.1 Vessel Knowledge: The Contractor shall have expertise and experience for the performance of this contract involving naval ship/vessels to include, but not limited to, the following characteristics:

2.2 Ship, Submarine and Vessel Repair Projects: The Contractor shall provide the following, in support of ship and vessel project, to include but not limited to, welding; marine pipefitting; shipfitting; blasting; painting;
equipment in-place repair, removal, repair, and installation; sheet metal forming, shaping, cutting and stamping;
electrical/electronic repairs and modernization; electrical/electronic alteration; pump/motor and ship’s mechanical systems repair and alignment; tank cleaning; rigging; and temporary scaffolding removal/installation.
2.3 Task Requirements: A Performance Work Statement (PWS), which includes specific requirements of work items/work requirements, deliverables, documentation, training; applicable Government/departmental/industry standards, on-boarding timeline, etc., will be delineated in each Task Order Request for Proposal (RFP).
2.4 Hot Work: The Contractor shall perform hot work as defined at the task order level. Hot work is defined as all flame heating, welding, torch cutting, brazing, carbon arc gouging, or any work that produces heat, by any means, of 400 degrees Fahrenheit (204 degrees Celsius) or more. In the presence of flammables or flammable atmospheres, hot work includes other ignition sources such as spark or arc producing tools or equipment, static discharges, friction, impact, open flames or embers, and non-explosion proof lights, fixtures, motors or equipment.
2.5 Hazardous Energy Control Work: The Contractor shall follow NNSY’s Hazardous Energy Control (HEC) Program. HEC involves use of Lockout/Tags-Plus (LOTP) procedures to protect employees by locking out hazardous energy of all types. A Tags-Plus system may be used if the hazardous energy source cannot be locked out; however, a strict approval process is required to use HEC tags. NNSY’s HEC instruction is the NAVSEA Occupational Safety, Health and Environment Control Manual (OSHECM) Chapter 250 with NNSY’s Appendix H (latest revision); for the purpose of this information, the term OSHECM Chapter 250 includes the use of NNSY’s Appendix H. For the intent of NNSY’s HEC program, use of the term “Lockout” will be used to also represent Lockout/Tags-Plus should this system ever be used.
2.6 Hazardous Material: The Contractor Supervisor shall ensure contractor personnel handling/using hazardous materials in accordance with NAVSHIPYDNORINST P5090.2 Volume III Chapter 5, Hazard Communication. Examples of hazardous materials include, but are not limited to, materials that exhibit flammable, combustible, ignitable, reactive, poisonous, corrosive, or toxicity characteristics such as paints, solvents, adhesives, cleaners, pesticides, acids, bases, greases, oils, lubricants, and oxidizers. The Contractor Supervisor shall ensure that contractor employees are trained on the location and content of applicable Safety Data Sheets (SDS), and ensure employees are knowledgeable on how to access SDS.
2.7.1 The Contractor and any Subcontractor(s) shall comply with the requirements of applicable safety and health laws and regulations such as Occupational Safety and Health standards which include Maritime Standards Code of Federal Regulations (CFR) (29 CFR 1915), General Industry Standards (29 CFR 1910), and other applicable federal, state and local environmental protection laws, codes, ordinances and regulations, in disturbing or removing paint during data collection for a specific task. All paints on naval vessels are considered to contain heavy metals, i.e., lead, chromium or cadmium unless it can be established otherwise by laboratory analysis.
2.8 Material and Equipment:
2.8.1 Contractor Furnished Material
2.8.1.1 The Contractor shall provide personal hand tools and other work apparel typically provided for accomplishment of work when required to include, but not limited to, respirators and fall protection devices.
2.8.1.1.1 The Contractor shall validate any measuring device (e.g. machinist scale) being bought into the shipyard as a tool against a calibrated/checked standard.
2.8.1.2 The Contractor shall provide Personal Protective Equipment (e.g. safety shoes, helmets and eye protection).
2.8.1.3 The Government may inspect any contractor-owned safety equipment (e.g harnesses).
2.8.2 Government Furnished Equipment
2.8.2.1 The Government may provide powered tools and tools that require calibration before use (e.g. torque wrenches, dial calipers, micrometers).
2.9 Trade Specific Requirements:

2.9.1.1.1 A Personal Fall Arrest System (PFAS) program in accordance with 29 CFR 1915.159, Subpart I.
2.9.1.1.2 A Confined/Enclosed Space Entry program in accordance with 29 CFR 1915, Subpart B.
2.9.1.1.2.1 The Contractor, by accepting work under this contract and subsequent associated Task Order(s), shall accept the Navy competent person services of NNSY.
Confined and Enclosed Entry: S6470-AA-SAF-010- Rev. 4 - Technical Manual for Naval Maritime Confined Space, section 2.8.2 authorizes naval maritime facilities, at the discretion of the naval maritime facility commander, to provide Navy competent person services to contractors in those situations where the provision of such services is advantageous to the government and the contractor desires and agrees to accept such services. Competent person services must be provided in accordance with 29 CFR 1915 and section 2-8 of S6470-AA-SAF-010- Rev. 4.
2.9.1.1.3 A Respirator program in accordance with 29 CFR 1910.134, Subpart I.
2.9.1.1.4 A training plan for PFAS. The Contractor shall submit copies of the training plan for PFAS, Confined/Enclosed Space, and Respirator programs with their proposal.
2.9.1.2 Contractor personnel reporting to NNSY shall be qualified to work in confined spaces such as tanks, voids, and any other areas that require gas-free controls.
