About this file

This is Amendment 2 to Solicitation DCKA-2026-A-0066, issued by the Government of the District of Columbia Office of Contracting and Procurement on August 21, 2026, regarding a Bus Shelter Franchise Agreement. The amendment extends the proposal due date to September 8, 2026, and provides clarification on revenue and payment data that contained discrepancies in the previous amendment. The solicitation calls for a franchisee to design, install, operate, and maintain up to 1,500 bus shelters throughout the District of Columbia while managing commercial advertising on those shelters. Proposals must acknowledge receipt of this amendment prior to the submission deadline through one of three methods: completing items 8 and 15 and returning the amendment, acknowledging receipt on each copy of the offer submitted, or submitting a separate letter or fax referencing the solicitation and amendment number. Failure to acknowledge receipt by the specified date and time may result in rejection of the proposal.

The amendment addresses discrepancies in historical revenue and payment estimates provided in Amendment 1, acknowledging that the data contained errors and were provided for informational purposes only. Questions from potential bidders revealed inconsistencies regarding the treatment of minimum annual guarantees (MAG) and revenue share payments in 2026 under the current contractor's agreement, which was modified by Civil Action No. 2022 CA 003260. The District stated it is unable to provide additional information beyond the updated historical estimates included in the amendment and confirmed that all other terms and conditions of the original solicitation remain unchanged and in full force and effect. The contracting officer for this amendment is Benita F. Scott.

14. Description of Amendment/Modification (Organized by UCF Section headings, including solicitation/contract subject matter where feasible.)

The purpose of this amendment is to:

1) EXTEND the due date for proposals referenced in § L.3.1 to 9/8/2026.

2) REPLACE the table in Amendment 1 Item #3 with the following (Note, the previous data was erroneous. The historical revenue and payment estimates remain for informational purposes only):

3) ADD the following questions and answers into the solicitation:

Question 109: Given that we are aware that the current contractor was no longer obligated to pay a MAG in 2026 and instead was required only to pay a Revenue Share (Civil Action No. 2022 CA 003260), the values in Item 3 of Amendment 1 do not make sense as reflected. If payments in 2026 were only based on Revenue Share and the MAG was eliminated, how is it possible that Payments to the District exceeded Gross Revenue in all cases? Can DDOT please provide clarification about the accuracy of the provided revenue and payment data?

Answer 109: Although the historical data shared in Amendment 1 were estimates for informational purposes only, there were discrepancies in the information provided. Please see the updated historical estimates in Item 2 of this Amendment. Note that the District is unable to provide further information than what is in Item 2 of this Amendment.

Question 110: Can DDOT confirm that these revenues are accurate and, if so, provide any context for why there has been such a drastic decline? Have shelters been removed from the inventory? Are there issues with the digital screens?

Answer 110: See Answer 109 above.

Except as provided herein, all terms and conditions of the document referenced in Item 9A or 10A remain unchanged and in full force and effect.
