About this file

This is a Darfur Contracting Act Certification Form issued by the State of California Department of General Services Procurement Division. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years and seeks to bid on or submit a proposal for a State of California contract, including the referenced IFB #S26-33383 for Office Moving Services with the Central Coast District. Companies meeting this criterion must certify either that they are not a scrutinized company as defined under Public Contract Code Section 10476, or alternatively, that they have obtained written permission from the Department of General Services to submit a bid despite being classified as a scrutinized company.

The certification process requires an authorized company official to complete one of two options: Option #1 involves certifying under penalty of perjury that the prospective bidder is not a scrutinized company and that the signatory is duly authorized to legally bind the organization; Option #2 applies to scrutinized companies that have received case-by-case written permission from the DGS Director pursuant to Public Contract Code Section 10477(b), with such companies required to include a copy of the written permission with their bid or proposal. Both options require submission of the company name, Federal ID Number, authorized signature, and printed name and title of the signing official, with completion of this form being mandatory for eligibility to bid on the specified state contract.
