About this file
This document contains questions and answers regarding a federal solicitation for commercial fabrics. UNICOR, Federal Prison Industries, Inc. is seeking a firm-fixed price requirements contract for one base year with four one-year options for cotton/polyester twill and poplin fabrics in various colors. The fabrics will be used by the Federal Bureau of Prisons to manufacture clothing for inmates. The solicitation is set aside entirely for small businesses as defined by the Small Business Administration. The estimated fabric quantities provided are for the full potential five-year term of the contract. All components of the fabrics, including fiber, yarn, greige goods and finishing, must be domestically manufactured in the United States with no exceptions. Clarification was provided on color names and that the contractor can use a manufacturing partner as long as the primary contract recipient remains a small business.

QUESTIONS and ANSWERS CT2307-21
1. On page 33 (of 35) it states “52.215-6, Place of Performance (OCT 1997). (a) The offeror or respondent, in the performance of any contract resulting from this solicitation, _____intends, Place of Performance (Street Address, City, State, County, ZIP Code) Name and Address of Owner and Operator of the Plant or Facility if Other than Offeror or Respondent”. Does UNICOR want to know the locations of the entire supply chain including yarn spinning, greige weaving and dyeing and finishing given that you require full Berry Amendment compliance? Or just the dyeing and finishing facility?
a. Please list any location that will be used, including dyeing and finishing facilities.
2. Do the goods provided under this contract need to be palletized?
a. Yes
3. Can you please either (a)clarify how a small business is defined? or (b) provide reference to SBA resource for us to review?
a. Information about SBA can be found at https://www.sba.gov/federal-contracting. A small business is defined ‘either in terms of the average number of employees over the past 12 months, or average annual receipts over the past three years.' Also, all federal agencies use SBA's size standards, and therefore it's important to determine your NACIS code
4. Regarding the following clause: “This requirement is 100% USA Domestic Only. No Foreign Made Items are Acceptable. All components of the fabric, including fiber, yarn, greige goods and finishing, must be manufactured entirely in the U.S.A.” Can you please confirm whether there are any foreign countries that would meet this requirement either under any existing trade agreements, exceptions or for any other reasons?
a. There are no exceptions to this requirement. A determination will be made if there are no offers that can meet this requirement after the solicitation deadline.
5. Can a small business recipient of a contract use a manufacturing partner for any part of the program that is NOT a small business?
a. No, unless a waiver is requested and obtain from the SBA
6. Is a large business eligible to be a direct recipient of the contract if they are the manufacturer all the items on the contract?
a. No
7. Please confirm and/or explain if the individual yardage quantities for all twill and poplin items (pages 4-17) are estimates for the full term of the contract and NOT annual estimates? Or are they annual estimates?
a. The estimates on pages 4-17 are for the full term of the contract.
8. On page 34 (of 35) it states offer must submit with proposal: “(6) a written certification on company letterhead that all line items are Berry Amendment compliant-signed and dated by a company official”. Do you want just the offeror to submit this Berry Amendment compliance certification? Or do you require that any/all manufacturing partners submit written certification as well?
a. Please disregard this requirement. The Berry Amendment applies to DOD acquisitions and does not apply for this solicitation. An Amendment will be issued to remove this requirement. However, the requirement on page 2 “100% USA Domestic Only. No Foreign Made Items are Acceptable. All components of the fabric, including fiber, yarn, greige goods and finishing, must be manufactured entirely in the U.S.A.” still applies
9. Could you please confirm the meaning of the following colors?
a. OD=Olive Drab
b. SG=Spruce Green
c. CB, CH/BR=Chocolate Brown
10. It is necessary to bid all the quantities of Fabrics at the same time? Or each year of the contract we can send you the prices of the Fabrics you will require?
a. Please bid one price per line.
11. Talking about the inventory, this has to be stored necessarily at our Warehouse or it could be in other place that the company assigns?
a. The consignment inventory will be kept at our warehouse, and when we pull from that inventory we pay for it.
