SECTION ONE – INTRODUCTION

A. INSTRUCTIONS

To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two (2) separate volumes:

(1) Volume I – Technical Proposal

(2) Volume II – Pricing Proposal

The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

All Questions are due not no later than Thursday, August 4, 2016, 3:00 P.M. Eastern Standard Time and submitted directly to crandell.mcdonald@csosa.gov and cc: vaughn.oswald@csosa.gov. Responses to questions will only be available via an amendment to the RFQ which will be posted on FBO. Please make your questions very clear and concise.

Response to this RFQ shall be submitted no later than Monday, August 15, 2016, 3:00 P.M. Eastern Standard Time. All submissions shall be in PDF or Excel formats (for pricing). The quote shall be submitted directly through Federal Business Opportunities website (www.fbo.gov) and provide a copy to crandell.mcdonald@csosa.gov and cc: vaughn.oswald@csosa.gov via email. Proposals received in any other method shall not be accepted or reviewed. Proposals received after this time will not be reviewed or accepted.

The quote MUST include the following information:

1. Tax identification number (TIN)

2. Dun & Bradstreet Number (DUNS)

3. Complete Business Mailing Address

4. Contact Name

5. Contact Phone

6. Contact Fax number

7. Contact email address

8. Date of Quote and expiration period of quote

The Contractor shall address an understanding of the overall and specific requirements of the Statement of Work (SOW)(s); convey the Contractor’s capabilities for transforming their understanding into accomplishments for performing the contract, and any other miscellaneous issues of which the Government should be aware.

The Contractor shall indicate if any technical assumptions have been made, conditions have been stipulated or exceptions have been taken with the Government SOW as written. If technical assumptions are not noted, it will be assumed that the vendor’s quote reflects no technical assumptions for award and agrees to comply with all of the terms and conditions set forth herein.

Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic award. To account for the additional six month option year(s) possible under 52.217-8, the Government will take the price for all CLINs in the final option year, prorated to a six month value, and add it to the sum of all CLINs (base plus all option years). This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the years.

FAR 52.217-8 can be exercised at any point during the period of performance of the Contract and applies to the period of performance immediately preceding exercising the option.

If a contractor anticipates their pricing would change as a result of exercising FAR 52.217-8, they shall identify this in Assumptions, Conditions, or Exceptions. Should a change be identified, the price change shall be evaluated as part of the best value determination.

B. EVALUATION AND BASIS FOR AWARD – see Attachment J-1

Evaluation Criteria

The government shall award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation shall be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers.

Factor 1 – Technical

a. Contractors shall meet all required specifications. The contractors shall propose in accordance with the required deliverable(s) and meet all mandatory requirements of the RFQ.

b. The Contractor shall submit resumes for evaluation of ALL key personnel expected to perform under the resultant contract.

1. Key Personnel The Contractor shall submit resumes for evaluation of ALL key personnel expected to perform under the resultant contract.

All Contractor personnel will be required to receive approval from the COR through resume submission. The Government reserves the right to accept or reject any or all of the candidates.

KEY PERSONNEL

The personnel listed below are considered essential to the work being performed hereunder. Prior to substituting, removing, replacing, or diverting any of the specified individuals, the Contractor shall notify the Contracting Officer 15 working days in advance and shall submit a written request and justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on this Contract. The proposed substitution of personnel must meet or exceed the education, experience, and other technical requirements of the personnel being replaced. No change in personnel shall be made by the Contractor without the prior written consent of the Contracting Officer. However, in urgent situations, as determined or agreed to by the Contracting Officer, an oral request to substitute key personnel may be approved and subsequently ratified by the Contracting Officer in writing. Such ratification shall constitute the consent of the Contracting Officer required by this paragraph. The Contracting Officer will notify the Contractor within 10 working days after receipt of all required information of the decision on the substitution(s). In the event the proposed substitution of key personnel does not meet or exceed the education, experience, and other technical requirements of the personnel being replaced, the Government reserves the right to require continued performance of previously approved key personnel or to require substitution of acceptable replacements for the individuals specified below. The key personnel listed below may, with the consent of the contracting parties, be amended from time to time during the course of the Contract to either add or delete personnel as appropriate.

[To be determined by the Government on review of technical Proposals]

Name
Position/Labor Category

All Contractor personnel will be required to receive approval from the COR through resume submission. The Government reserves the right to accept or reject any or all of the candidates.

The number of required qualified Contractor personnel may vary throughout the course of the contract. Therefore, the Contractor can submit a rotating pool of qualified Contractor personnel to provide services under this contract, not to exceed 20, unless approved by the COR.

The Contractor will provide sufficient personnel possessing the skills, knowledge, and training to perform the services required by this contract. All Contractor staff will be fully proficient in the areas in which they work.

The Contractor will ensure that its staff maintains any required professional certifications, accreditations, and proficiency relative to their areas of expertise as required in Section 16.1, Qualifications and Section 16.2, Certifications, of the Contract. The Contractor will retain documentation of such records. The Government will not pay expenses incurred by the Contractor or by individual Contractor employee to meet professional certifications requirement.

Factor 2 – Past Performance

a. Submit a list of 3 customers for whom similar services have been performed. Include specific points of contact and phone numbers. Past Performance will be evaluated by the Contracting Officer on quality or service and overall customer satisfaction. NOTE: An offeror without any record of past performance or for whom information on relevant past performance is not available will be evaluated as neutral.

Factor 3 – Price

a. For evaluation purposes, the total evaluated price will be the sum of all line items.

Technical and past performance, when combined, are more important when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The contractor is also responsible for ensuring that its employees and those of its subcontractor(s) do not disturb papers on desks, open desk drawers or cabinets, use government telephones, except as authorized, or otherwise jeopardize the security and the privacy of government employees, its clientele, and the contents and property of the federal building(s) in which the task order work is performed Each employee or supervisor of the contractor is expected to adhere to standards of behavior that reflect credit on themselves, their employer, and the federal government.

The contractor will be responsible for taking such disciplinary action, including suspension without pay or removal from the worksite, with respect to its employees, as may be necessary to enforce those standards.

Where applicable, the requirements of this clause must be expressly incorporated into subcontract(s) and must be applicable to all subcontractor employees who may perform recurring services or work at the federal building and grounds of this task order.

The Government retains the right to permanently remove any employee of the contractor from performing duties assigned under this task order at the federal building should the employee’s performance so warrant. The CO will verbally inform the contractor about the employee, followed by a written confirmation or determination. Specific reasons for the removal of an employee will be provided to the contractor in writing. In the event of a dispute, the CO will make a final determination.

· Upon a determination of the Government that an employee of the contractor be removed from or denied access to a federal building worksite, the employee’s clearance and access to the federal building must be immediately revoked or otherwise terminated. Furthermore, if applicable, the building pass and/or other access device(s) previously given to the employee must be immediately surrendered, returned, or delivered to the security officer of the federal building.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
