About this file
This is a Vendor Preference Certificate issued by the State of West Virginia's Purchasing Division to establish eligibility criteria for bidders seeking preferential consideration on non-construction contracts under West Virginia Code 5A-3-37. The document outlines seven distinct preference categories available to qualifying vendors at the time of bid submission, with preferences applied solely as an evaluation method to cost bids. No specific products, services, quantities, response dates, or contract terms are detailed in this document, as it functions as a standalone certification form rather than a solicitation notice.
The preference structure provides a 2.5 percent cost preference for resident vendors or partnerships maintaining headquarters continuously in West Virginia for four years prior to certification, resident vendors employing 75 percent West Virginia residents throughout contract performance, and nonresident vendors with substantial state employment meeting specified criteria. An additional 3.5 percent preference is available for veteran-owned businesses meeting residency and employment requirements, while a combined 5 percent preference applies to bidders meeting multiple criteria. A separate 3.5 percent preference category exists for non-resident small, women- and minority-owned businesses certified by the Purchasing Division. The document requires bidders to certify under penalty of perjury that all stated information is accurate and to notify the Purchasing Division immediately of any material changes occurring during contract performance. Failure to maintain preference eligibility may result in bid rejection or penalties up to 5 percent of the bid amount, enforced by the Secretary of Revenue and Director of Purchasing.
