C. PROPOSAL CONTENT
The proposals shall consist of two volumes. Volume I shall be the technical proposal and Volume II shall be the price proposal.
Volume I: Technical Proposal Content
The Government will evaluate relevant past performance of each Offeror. The Offeror and any proposed Subcontractor who will perform technical work relevant to the SOW shall identify three (3) ongoing or successfully completed projects performed by the Offeror or Subcontractors that demonstrate recent and relevant past performance. Recent is defined as within the last three (3) years. Relevant is defined as work similar in size and scope, as aggregated together, to the work identified in the PWS. At least one past performance reference shall be submitted for the offeror identified as the prime contractor for this quotation submission. Further, Offeror shall include a list of all relevant DHS on-going contracts or contracts, if any, completed for the specified period. For each reference, the offeror shall provide at a minimum the following
A. Name of Contractor that performed the work and whether it was performed as the subcontractor or prime contractor.
B. Contract/Task Order/Call Order name, duration, and dollar value.
C. D. Point of Contact from the Government entity (name, title, current phone number, and current e-mail) familiar with the project that can confirm the level and quality of the Offeror’s referenced past performance and work. The Government reserves the right to communicate with the Point of Contact provided.
E. A discussion of the aspects of the past performance that are similar to DHS need as reflected in the SOW, as well as aspects that are not similar.
F. If submitting a past performance example for a subcontractor, describe how the subcontractor will meaningfully contribute to performance of the contract.
The Government reserves the right to conduct reference checks using the information provided for this factor. The Government may contact the identified representative of the Government agency or company as part of the reference checks to confirm the level and nature of this past performance. If the Government exercises its reserved right to conduct reference checks and is unable to reach the past performance reference check, it will not positively or negatively impact the evaluation of corresponding past performance example.
Beyond reviewing Offeror’s submitted past performance examples and any possible reference checks, no other means will be utilized to evaluate the Offeror’s prior experience.
Past Performance
Rating Description
High Confidence
The Government has high confidence that the Offeror has relevant prior experience and will be successful in performing the contract with little or no Government intervention.
Some Confidence
The Government has some confidence that the Offeror has relevant prior experience and will be successful in performing the contract with some Government intervention.
Low Confidence
The Government has low confidence that the Offeror has relevant prior experience or will be successful in performing the contract even with Government intervention.
Neutral In the case of a offeror without a record or references of recent and relevant past performance, or for whom information on experience is not available, or so sparse that no meaningful prior experience rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on prior experience. . Therefore, the offeror shall be determined to have unknown past performance. In the context of a “unknown” past p[erformacne, the offeror rating shall be considered “Neutral”
Evaluation Standards
Adjective Definition
Benefit Any attribute of the proposal that gives the Government confidence that the Offeror will exceed the required effort as defined in the SOW.
Risk
Any attribute of the proposal that does not give the Government confidence that the Offeror will successfully perform the required effort as defined in the Statement of Work.
D. Price/Cost
Price proposals may be submitted in contractor format and shall include:
a. Signed and dated proposal/cover letter with the following information: Solicitation Number, Company name, address, Contractor point of contact, telephone number, e-mail address, Contractor DUNS Number, and the assigned Commercial and Government Entity (CAGE) Code from System for Award Management (SAM).
b. Signed acknowledgements of amendments (applicable only if any amendments are issued against this solicitation.)
(End of Provision)
(a) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. As a minimum, offers shall include—
(1) The solicitation number;
(2) The name, address, telephone number of the Offeror;
(3) The Offeror’s Unique Entity Identifier (UEI) and, if applicable, Electronic Funds Transfer (EFT) indicator;
(4) Information necessary to evaluate the factors contained in the provision at 52.212-2 or as described in the solicitation;
(5) Responses to provisions that require Offeror completion of information, representations, and certifications (other than those collected via the System for Award Management (SAM)); and
(6) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and any solicitation amendments.
(b) Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(c) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may withdraw their offers by written notice to the Government received at any time before award.
(d) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms. However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all offers if such action is in the public interest, accept other than the lowest offer, and waive informalities and minor irregularities in offers received.
(e) Debriefings. If a post award debriefing is given to requesting Offerors, the Government will disclose the following information, if applicable:
(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed Offeror’s offer.
(2) The overall evaluated cost or price and technical rating of the successful Offeror and the debriefed Offeror and past performance information on the debriefed Offeror.
(3) The overall ranking of all Offerors when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award.
(5) For acquisitions of commercial products, the make and model of the product to be delivered by the successful Offeror.
(6) Reasonable responses to relevant questions posed by the debriefed Offeror as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.
If needed, the Government intends to exercise the option or options under FAR 52.217-8 without further competition or need for justification for other than full or open competition. For purposes of evaluation, the potential need to exercise the option under FAR 52.217-8 to extend the period of contract performance for the maximum period of six (6) months will be considered the same for all Offerors. In considering the price of the base period and any option periods, the Government will consider that if the extension of service clause (FAR 52.217-8) is exercised, it will be at the exact price, other than length of performance, as the base or option period being extended. The Government will determine whether the price, inclusive of all options (including the options available under FAR 52.217-8), is fair and reasonable, and whether the price of the base period and all option periods (including the option(s) represented by FAR 52.217-8), in combination with the other evaluation factors specified in the solicitation, represents the best value to the Government.
(2) RFO 52.212-2, Evaluation—Commercial Products and Commercial Services (FEB
2026) is hereby incorporated, subject to the procedures in 12.201-2.
The following factors shall be used to evaluate the offer: meeting salient characteristics as listed in the Statement of Work, Demonstrated Prior Experience, price, and meeting the delivery time.
ADDENDUM TO RFO 52.212-2, EVALUATION
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. The Government intends to award one (1) contract to the acceptable offeror which is deemed responsible in accordance with the FAR, and which has submitted an offer conforming to the solicitation requirements. The requirements include all stated terms, conditions, and all other requirements of this solicitation. The Government intends to make an award based on the initial offer received; therefore, the initial offer should contain the offeror’s best terms from a price and technical standpoint. Offerors must be determined to be responsible according to the standards of FAR Subpart 9 to be eligible for award.
2. Failure to provide a complete, detailed, realistic, and reasonable offer may reflect a lack of understanding of the requirements and may result in a determination that the offeror’s proposal is unacceptable. The Government does not assume a duty to search for clarification data to cure problems or inconsistencies with an offeror’s proposal.
3. The award decision process is being conducted under FAR Part 12, wherein the Contracting Officer is permitted to engage in communications with individual offeror about their proposal without being subject to the policies and procedures of FAR Part 15, and without engaging in "discussions" or "negotiations" under FAR Part 15.
4. Although the Government intends to award a contract resulting from this solicitation, the Government reserves the right to reject any and all proposals received and not award any item or items from this solicitation.
PAST PERFORMANCE
The Government will evaluate the past performance submitted by the Offeror to determine its confidence level that the Offeror will successfully perform the BPA.
PRICE AND ADMINISTRATIVE
1. Price analysis shall not be conducted on offerors determined to be unacceptable for award, since the offeror will not be in line for award. All CLINs must be priced.
2. The Government will perform a price analysis to determine the reasonableness of proposed price in accordance with the FAR 15.404-1(b). The Government will utilize a comparison of proposed prices received in response to the solicitation and or the IGCE.
(a) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(b) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
3. Evaluation of options will not obligate the Government to exercise the option(s).
The effective date for the FAR 52.217-5 (Evaluation of Options) class deviation is November 3, 2025. This deviation, implemented as part of the Revolutionary FAR Overhaul (RFO) per Executive Order 14275, remains active and will continue in effect until permanently incorporated into the FAR or explicitly rescinded.
(3) Applicable Provisions.
