About this file

This document is a set of questions and answers related to a statewide contract opportunity issued by the Washington Department of Fish and Wildlife (WDFW) for the provision of fish food for WDFW hatcheries. The contract will establish multiple optional use contracts with different fish food vendors to provide a variety of fish food products to hatcheries located across multiple counties in Washington. The contract specifications cover details such as feed quality, testing, packaging, and delivery requirements. Key contract details include a 14-day delivery timeline, provisions for feed product age and availability, and liability and damage clauses.

The pricing terms allow for discounted pricing for larger orders, and vendors can provide pricing for products not listed in the provided price sheet. There is a minimum qualification requirement that vendors must have supplied fish food to hatcheries producing over 50,000 pounds of fish annually. This is an open competition, and there are no set-asides or incumbent information provided.

Sheet1

No.QuestionWDFW Answer
1In the past is that hatchery managers got to choose which feed companies that they can use and the way that I understand it now that's changing to where we can actually bid on individual hatcheries. Is that what I'm reading and hearing or is it something different than that? There is no change in how WDFW hatchery managers order fish food; individual managers select the fish food they feel will do the best job in raising fish.
2Regarding Appendix B (Specifications): 3b – How will the WDFW rule out any environmental factors or fish health challenges that may negatively impact growth, conversion factors, and mortality rates compared to “past records”?See Appendix B-1, Revised Specifications. This language has been removed.
3Regarding Appendix B (Specifications): 3c – Are there any analytical tests and or specification that the WDFW will use to determine if mortality is attributed to feed quality or to specific ingredients? The tests WDFW would rely upon include Fish - Histopathology. For feed samples tests include those conducted by Eurofins Scientific and USFWS – Abernathy Fish Technology Center for feed analysis - rancidity, TBA, peroxides, oxidative stability (TOTOX), mycotoxins, PAH, PCBs, Dioxins, heavy metals, protein, fat, moisture, and sieve sizing.
4Regarding Appendix B (Specifications): 3d – How is a normal rearing condition defined? This is defined as normal rearing conditions for that facility and includes appropriate densities and good water clarity for observing fish eating.
5Regarding Appendix B (Specifications): 7b – How is the cost of production calculated?See Appendix B-1, Revised Specifications. This language has been removed.
6Regarding Appendix B (Specifications): 7c – How is the market value calculated?See Appendix B-1, Revised Specifications. This language has been removed.
7Regarding Appendix B (Specifications): 10 – Will this analysis be conducted by a third-party lab or a WDFW lab?Analysis would be conducted by Eurofins Scientific and USFWS – Abernathy Fish Technology Center.
8Regarding Appendix B (Specifications): 13 – This point states that “testing must include at least one product that WDFW purchases. Does this mean that PCB analysis must be provided within the PCB testing report for one item that WDFW is sourcing and that all other items are not required to be tested?Yes.
9Regarding Appendix B (Specifications): 3b – In addition to feed quality, fish performance (growth, conversion factors, mortalities) is influenced by many factors including: water temps, water quality, pathogens, predation, feed rates, feeding frequency, distribution of feed, staff changes, management etc. Sometimes it is not entirely clear why fish performance changes from one year to the next. The feed company has control over feed quality, but not fish performance. We feel that this clause could be used to claim a feed problem when other factors may be the cause of poor fish performance. Can paragraph b. be eliminated from the SPECIFICATIONS?See Appendix B-1, Revised Specifications. This language has been removed.
10Regarding Appendix B (Specifications): 3f – Our feeds have no expiration dates. A label on every bag contains the “Production” date and the “Best Before” date. The feed company does not have control over how much feed is used at a hatchery, or how the feed inventory is managed at a hatchery. Our inside sales staff will not be able to calculate feed orders based on “use dates” provided by WDFW. However, our staff can confirm the age of the feed currently in stock. We suggest the wording at f. be eliminated or replaced as shown below. This information will assist the hatchery staff in managing their feed inventory: At the time of order, if requested by the hatchery manager, the feed company will confirm the production dates and best before dates of the feed that is currently available for shipping.See Appendix B-1, Revised Specifications. This language has been revised for clarity.
11Regarding Appendix B (Specifications): 3g – We will not always have all feeds available that meet these feed age guidelines. Our company is pleased to support WDFW hatcheries by offering more enhancement diets, more sizes, and more medications (in more sizes and dosages) than any other feed company. Maintaining inventory of this large number of individual items is challenging. To continue to offer this range of products, we require flexibility regarding timing of orders and age of feed. We suggest this clause be changed to:
At the time of order, if requested by the hatchery manager, the feed company will confirm the production dates and best before dates of the feed that is currently available for shipping.See Appendix B-1, Revised Specifications. The suggested revision has been incorporated.
12Regarding Appendix B (Specifications): 6. Packaging and Shipping - Many deliveries can be made within 14 days of order submission, but not all. Because we offer so many products, sometimes we do not have a particular product in stock and it needs to be produced to order. This requires more than 14 days. Can this clause be changed to the following ? :
The feed company will strive to fulfill all orders within 14 days of receipt of orders.See Appendix B-1, Revised Specifications. The suggested revision has been incorporated.
13Regarding Appendix B (Specifications): 7. Liability/Damages - As written, it is impossible to quantify the potential damages. When added together, the amounts of a. b. & c. could amount to calculated damages which exceed the value of the business that this contract will provide. This unknown and potentially large liability seems unreasonable and would prevent us from participating in this bid. We have feed contracts with many government agencies and no others have a liability clause with this broad scope of damages. Our records show that the language shown below was used in a previous WDFW contract before the current language was inserted. We suggest that section 7 be replaced with this previous paragraph:
Indemnification and Hold Harmless - Each party to this agreement shall be responsible for its own acts and/or omissions and those of its officers, employees and agents. No party to this agreement shall be responsible for the acts and/or omissions of entities or individuals not a party to this agreement.See Appendix B-1, Revised Specifications. This language has been revised.
14Regarding Appendix B (Specifications): 10. Testing Ingredients – We are happy to supply representative samples of raw materials to WDFW as requested for testing. However, it is not feasible to supply samples in advance of a particular run of feed. We suggest that section 10. be changed back to what it was previously, this is shown below:
Testing Ingredients: If requested by WDFW, the Contractor shall supply representative samples of the ingredients that are being used to produce WDFW feeds. We have considered your request, but will not revise the language at this time.
15Regarding Page 7 of 13 of the IFQ document, Refers to 2.8 Pricing – In the past we have offered a minimum order quantity for delivered pricing, and discounts for ordering larger amounts of feed. This helps us control our shipping costs while allowing us to provide discounted prices for larger orders. This has worked well for both parties.
Will this contract continue to allow for this type of discounted pricing?Yes; please provide any discount pricing as an attachment to Appendix C.
16Regarding Minimum Qualification requirement to have supplied one or more fish hatcheries that annually produce over 50,000 pounds of fish - is that for WDFW hatcheries only, or do you consider other fish hatcheries. That is for all fish hatcheries, not just those operated by WDFW.
17Are we required to use Appendix C - Vendor's Price Sheet to submit bids, or can we provide our own version as long as the context and the information in that price sheet is the same? Please use Appendix C to submit prices.
18Can we provide prices for products that are not listed in Appendix C?Yes; please provide a separate attachment for these products.
