About this file

This is a Contracting with Entities of Foreign Countries of Concern Prohibited Affidavit required by Florida Statutes Section 287.138 for the Hillsborough County Public Schools (HCPS) Primary Foodservice Distributor contract. The affidavit must be completed and executed by an authorized representative of any proposer or contractor submitting a bid, proposal, or quote to HCPS for this foodservice distribution opportunity. The associated bid or proposal will not be accepted without submission of this completed affidavit. The contract involves establishing a prime foodservice distributor agreement for delivery of frozen, refrigerated, grocery, and dry foods, as well as commodity processed products to individual school sites for use in the USDA's National School Breakfast and Lunch Programs, Summer Food Service Program, and Child Care and Adult Food Program's After School Meals Program.

The affidavit requires the proposer to certify that the legal company name does not meet any criteria that would disqualify it under Florida Statutes Section 287.138, specifically that the entity is not owned by a foreign country of concern, does not have a foreign country of concern with controlling interest, and is not organized under the laws of or principally located in a foreign country of concern. Foreign countries of concern are defined as the People's Republic of China, the Russian Federation, the Islamic Republic of Iran, the Democratic People's Republic of Korea, the Republic of Cuba, the Venezuelan regime of Nicolas Maduro, and the Syrian Arab Republic. The authorized representative must sign the affidavit under penalties of perjury, certifying the truthfulness of the attestation.
