About this file

This is a Confidential Information Designation Form (Version 1, dated 12/25) issued by Collier County, Florida's Procurement Services Division in connection with an Adaptive Traffic Control System grant-funded procurement opportunity. The form provides instructions for proposers and bidders to designate specific portions of their submissions as confidential or exempt from public disclosure under Florida law. Proposers must clearly mark pages or sections containing confidential information and identify the documents or sections being claimed as exempt, along with corresponding page numbers and the statutory basis for the exemption claim.

The form outlines three primary bases for confidentiality designations: trade secrets under Florida Statute 688.002, F.S.; financial information under Florida Statute 119.071(1)(c), F.S., which exempts financial statements or information necessary to verify bidder financial adequacy for public works projects (subject to repeal on October 2, 2029, unless reenacted); and proprietary information under Florida Statute 119.071(1)(f), F.S., which covers agency-produced data processing software designated as sensitive. Proposers must provide a justification statement explaining why the designated information is confidential and how it meets statutory criteria, then sign an acknowledgment certifying that the information is exempt from public disclosure under Florida law. The form warns that failure to properly mark or justify exemptions may result in public release of the information.
