About this file
This document is a Request for Proposal (RFP) issued by the Illinois Department of Human Services (IDHS) for a provider to deliver a continuum of community-based services and programming, including assessment, treatment, and surveillance services for Sexually Violent Persons (SVPs) transitioning from a secure facility and placed within Illinois communities. The SVP Commitment Act provides for the detention, treatment, evaluation, and conditional release of certain sex offenders deemed dangerous due to a mental disorder. IDHS is seeking a vendor to provide specialized sex offender treatment, assessment, and surveillance services, as well as general case management, mental health, medical, and other support services for SVPs on conditional release. The initial contract term is five years, with an optional four-year renewal. A mandatory pre-submission conference is scheduled for January 13, 2020, and sealed offers are due by January 30, 2020.
The RFP outlines detailed service requirements across seven categories, including intensive surveillance and monitoring, sex offender assessment and treatment, mental health and medical services, and aggressive case management. Vendors must propose a multi-level conditional release supervision strategy and provide pricing based on the number of SVPs served. The contract will be awarded to the most responsive and responsible offeror. A 5% Business Enterprise Program (BEP) participation goal is included. The successful vendor will be expected to assume services for the existing caseload of conditionally released SVPs.

If interested and able to meet these requirements, the State appreciates and welcomes an Offer.
Brief Description:
This Request For Proposal (RFP) seeks a provider for services ONLY for Sexually Violent Persons ordered by the Illinois courts to serve a term of conditional release in Illinois communities (hereafter releasees). The Sexually Violent Person (SVP) Commitment Act (725 ILCS 207) as amended, provides for the detention, treatment, evaluation and conditional release of certain sex offenders who have been determined by a court to remain dangerous due to a mental disorder that makes it substantially probable that they will engage in acts of sexual violence. The Act provides that persons determined to be sexually violent can be committed to either secure custody of conditionally released to the community. The Department currently has a vendor providing treatment services to the Sexually Violent population judicially ordered to secure custody.
This RFP seeks a vendor to provide a continuum of community based services and programming, including assessment, treatment and surveillance services for releases in transition from the secure facility and placed within the Illinois communities. • Objective sex offender assessment services including Abel screening, phallometric testing and clinical polygraph services,
• Specialized sex offender surveillance, monitoring and supervision services.

In no event will the total term of the contract, including the initial term, any renewal terms, and any extensions exceed ten (10) years. 30 ILCS 500/20-60. If an offeror does not comply with requests for information and cooperate, the State may reject the offer as non-responsive to the solicitation. Submitting an offer does not entitle Offeror to an award or a contract. Posting a vendor’s name in a Bulletin notice does not entitle the vendor to a contract. If no offeror meets a particular requirement, the State may waive that requirement.
A.23.1.6. When the specification calls for “Brand Name or Equal,” the brand name product is acceptable. Other products will be considered with proof that the other product meets stated specifications and is equivalent to the brand product in terms of quality, performance and desired characteristics.

A.23.2. RESPONSIBILITY: A responsible Offeror is one who has the capability in all respects to perform fully the contract requirements and who has the integrity and reliability that will assure good faith performance. The State determines whether the Offeror is a “responsible” offeror; an offeror with whom the State can or should do business. For example, the State may consider the following:
A.23.2.1. A “prohibited bidder” includes any person assisting an employee of the State of Illinois by reviewing, drafting, directing, or preparing any invitation for bids, a request for proposal, or request of information, or providing similar assistance unless such assistance was part of a publically issued opportunity to review drafts of all or part of these documents. For purposes of this section, an employee of the State of Illinois means one who, by the nature of his or her duties, has the authority to participate personally and substantially in the decision to award a State contract. No person or business shall submit specifications to a State agency unless requested to do so by an employee of the State. No person or business that contracts with a State agency to write specifications for a particular procurement need shall submit a bid or proposal or receive a contract for that procurement need.
Nothing herein is intended to prohibit a vendor from bidding or offering to supply developing technology, goods or services after providing the State with a demonstration of the developing technology, goods, or services; provided the subject of the demonstration to the State represents industry trends and innovation and is not specifically designed to meet the State's needs. Nothing herein is intended to prohibit a person or business from submitting a bid or offer or entering into a contract if the person or business: (i) initiates a communication with an employee to provide general information about products, services, or industry best practices and, if applicable, that communication is documented in accordance with Section 50-39 of the Illinois Procurement Code or (ii) responds to a communication initiated by an employee of the State for the purposes of providing information to evaluate new products, trends, services, or technologies.
A.23.2.2. Other factors that the State may evaluate to determine responsibility include, but are not limited to: political contributions, certifications, conflict of interest, financial disclosures, taxpayer identification number, past performance in business or industry, references (including those found outside the Offer), compliance with applicable laws, financial responsibility, insurability, effective equal opportunity compliance, payment of prevailing wages if required by law, capacity to produce or sources of supply, and the ability to provide required maintenance service or other matters relating to the offeror’s ability to deliver in the quality and quantity within the time and price as specified in this solicitation.

OFFER TO THE STATE OF ILLINOIS
Illinois Department of Human Services RFP 21 Section 1. Part C. Offer to the State of Illinois V.20.1
D. SPECIFICATIONS/QUALIFICATIONS/STATEMENT OF WORK
D.1. GOAL:
The Sexually Violent Persons (SVP) Commitment Act, 725 ILCS 207 et. Seq. became effective January 1, 1998. It has undergone several legislative amendments since that time. The Act provides for the detention, evaluation, treatment, and conditional release of sex offenders either adjudicated delinquent, criminally convicted or found Not Guilty by Reason of Insanity of the following offenses. 720 ILCS 5/12-13 Criminal sexual assault, 720 ILCS 5/12-14 Aggravated criminal sexual assault, 720 ILCS 5/12-14.1 Predatory criminal sexual assault of a child, 720 ILCS 5/12-16 Aggravated criminal sexual abuse; Any former law of Illinois specified in Section 11-1(rape), 11-3 (deviate sexual assault), 11-4 (indecent liberties with a child) or 11-4 (aggravated indecent liberties with a child); Sexually motivated first degree murder; and any solicitation, conspiracy or attempt to commit any of the above offense and who have been determined by an Illinois court to remain dangerous due to a mental disorder that makes it substantially probable that they will engage in acts of sexual violence.
The Department of Human Services is statutorily required, upon court offered civil commitment, to arrange for control, care and treatment of the person in the least restrictive manner consistent with the requirements of the person and in accordance with the court’s commitment order. The Act provides that upon a judicial order for conditional release, the Department has sixty (60) days to present its conditional release plan to the court for its approval, unless the Department and the person to be released request additional time to develop the plan. Under the Act, the Illinois Department of Human Services (IDHS) must provide “control, care and treatment until such time as the person is no longer a sexually violent person”.
This Request for Proposal seeks to provide services only for those Sexually Violent Persons who have been judicially ordered to conditional release in an Illinois community. This Request for Proposal does not seek to provide services for any SVP judicially ordered to serve a term of secure confinement.
Since the date of implementation of the program, 154 persons have been civilly committed and ordered to conditional release in Illinois communities; 55 were judicially ordered back to the secure facility as a result of violation of the rules of the conditional release; 26 were judicially found to no longer be a SVP and were discharged from the program and IDHS care and custody. As of October 21, 2019, there are 70 individuals currently residing in Illinois communities.
The duration of the conditional release term is not specified by statute; therefore it is possible that Sexually Violent Persons may be supervised for a period of natural life. It is equally possible that Sexually Violent Persons will be judicially discharged from conditional release requirements after a shorter period of time. It is also possible that any Sexually Violent Persons conditional released will be judicially ordered to return to secure custody as a result of a violation of the rules of conditional release or treatment rules. The Department of Human Services has designed a multi-level Conditional Release Surveillance Strategy contained in the RFP package that anticipates persons will present varying levels of risk of reoffense and therefore the need for specialized supervision and casework services of varying intensities and type which will fluctuate over time.
As of October 21, 2019, there were 167 detainees pending commitment proceedings and 389 civilly committed Sexually Violent Persons in secure custody. Average number of new admissions to the secure facility has been three per month. These numbers reflect the current pool of persons potentially releaseable to Illinois communities who remain under the care, custody and control of the Department of Human Services. Because this population is released to the community as a result of a judicial order, prediction of who will be released and when the release will occur is difficult. IDHS may be aware of which persons are being considered for the conditional release program, however the final decision to release is purely a judicial one. Further, once a person is released to an Illinois community, their length of stay within the community is dependent upon their compliance with the rules of release, treatment rules, and compliance with state and local laws and ordinances. Over the past three (3) years, an average of eighteen (18) Residents were released to Illinois Communities per year. Previously the average was eleven (11) releases per year.
While it is anticipated that releasees will have progressed through and completed a rigorous sex offender specific treatment program, prior to release to the community, due to statutorily created judicial discretion, it is not guaranteed. Vendors are encouraged to design sex offender specific treatment and monitoring programs that provide a continuum of graduated services that respond to the individual needs and risks presented by the specific releasee.
The Department of Human Services is not statutorily required to focus individual release planning efforts within the original county of commitment, however it is encouraged. The successful vendor resulting from the RFP will be required to work very closely with staff and contractors of the secure Treatment and Detention Facility and independent evaluators under contract with the Department of Human Services, in the development of a conditional release plan for submission to the circuit courts on all persons ordered to serve a term of conditional release.
D.2. SUPPLIES AND/OR SERVICES REQUIRED:
The following seven categories consist of the required services. Please describe in 20 pages or less how the services will be rendered.
Vendors proposing to contract with IDHS for less than all seven categories of services will not be considered. Subcontracting services is acceptable.
Overview Vendors will be expected to assume service delivery for all existing conditionally released Sexually Violent Persons and therefore, will include in the proposal a recommended transition plan for assuming service delivery for the current releasee caseload. Vendors, employing subcontracting, should give priority to current service providers in developing the transition plan for continuity of care.
Vendors will be expected to explain how the program will be administered addressing the following:
Organizational capacity for effective and efficient management
Clinical education and expertise
Corporate capacity to carry out the proposal
Clear lines of overall responsibility for daily operation, and
Contact person
The following table is provided to assist vendors in the formulation of a multi-level case management strategy. Initial assignment of case management level and all subsequent changes will be approved in advance by TDF Program Director or designee.
