Air Force Memorial Base Operational Support (AFM BOS)

Joint Base Anacostia-Bolling

Notice to Offeror(s)/Supplier(s): Funds are not presently available for this effort. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligations to reimburse an offeror for any costs.

This is a combined solicitation/synopsis for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as a Request for Proposals (RFP), solicitation number

FA7060-23-R-0002, in accordance with FAR Parts 12 and 13, and is in accordance with provisions and clauses effective in Federal Acquisition Circular (FAC) 2022-04, effective 31 Jan 2022.

The North American Industry Classification System (NAICS) number is 561210 and

PSC Code Z1JZ, and the small business size standard is $41.5M. The proposed acquisition is set aside as a 100% 8(a) small business set-aside. All 8(a) Small

Businesses are encouraged to participate by submitting proposals. Please see details below.

The following FAR references may be accessed from acquisition.gov.

A. Offerors shall comply with all instructions contained in FAR 52.212-1, Instructions to Offerors – Commercial Items.

FAR 52.212-1 Addendum

In order to be determined responsive to this combined synopsis/solicitation, offerors shall have an active registration in SAM.gov and submit the following documentation via email to the points of contact listed in paragraph G of this document:

1. Technical Proposal:

Offeror’s Technical Proposal IAW requirements as outlined in the

Government’s PWS.

2. Past Performance:

Offerors shall provide past performance information for a maximum of (3) references in which they operated as prime contractors. An offeror without a record of relevant past performance, will not be evaluated favorably or unfavorably.

3. Price Proposal:

The offeror shall complete Attachment 3, Pricing Worksheet. The Offeror shall submit pricing for the Base Period and all Option Periods.

Offerors’ registration in SAM.gov will be verified and a review will be conducted to ensure that all aspects of the solicitation have been addressed. Failure to have an active registration in SAM.gov or failure to adhere to all requirements of the solicitation will result in the offer being labeled as non-responsive and not considered for award.

Pricing shall be reflective of the specified service requirements as stated in each

CLIN in accordance with (IAW) the Performance Work Statement (PWS). All offers and pricing shall document a validity period of 45 days minimum from the date of solicitation closing. Pricing shall be submitted on the Pricing Worksheet in this solicitation (see ATTACHMENT 3)

B. IAW FAR 52.212-2 – Evaluation – Commercial Items. The Government will award a contract, resulting from this solicitation, to the responsible offeror whose offer, conforming to the solicitation, presents the best value to the Government.

The Government intends to make a trade-off determination with past performance as the most important factor. Although price is not expected to be the most significant factor in the selection of an offeror, the degree of importance of price as a factor could become greater depending upon the equality of the proposals. The Government will make a subjective evaluation to determine if the offeror’s technical proposal, past performance and proposed price represents the greatest value to the Government.

C. The following factors shall be used to evaluate offers:

1. The Offeror’s Technical proposal will be evaluated against the criteria stated below and will receive a technical rating of “Acceptable” or

“Unacceptable”. In order to receive a technical rating of

“Acceptable”, the offeror’s Technical Proposal shall outline its ability to effectively manage an organizational structure consisting of appropriate leadership, manning levels and skill sets based upon qualifications, certifications, and training requirements as applicable to the maintenance, repair and inspection of vertical transportation equipment. A technical proposal that reiterates the Government’s

PWS will not be found acceptable. The proposal must outline the

Offeror's unique approach to meeting all technical requirements.

2. Offerors shall use the Past Performance Questionnaire (PPQ), Attachment 4, to document its past performance. The PPQ must be fully completed and signed by a Government Official who has/had oversight of the project. If a signature cannot be obtained, Section 2 of Attachment 4 must be completed by the Offeror. The government reserves the right to review other sources, such as CPARS, in determining an Offeror’s performance history.

A recent contract reference is defined as a contract reference with performance occurring within the past three years. All recent past performance references will be assigned a relevancy rating.

Relevancy for this RFP is defined as having provided all management, tools, supplies, equipment, parts and labor necessary to maintain, repair, and inspect the real property vertical transportation equipment that ensured continuous and safe operation. Relevancy ratings will be assigned to each past performance reference using the following chart:

Overall Performance Confidence Assessment is an evaluation of the likelihood (or Government’s confidence) that the offeror will successfully perform the solicitation’s requirements. Based upon recency, relevancy, and all past performance information obtained or received by the Government, each offeror will receive an Overall

Performance Confidence Assessment Rating.

Performance Confidence Assessment ratings will be assigned using the following chart. An offeror with no record of past performance, will receive a “Neutral” rating.

Substantial Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Offeror has at least one or more “very relevant” past performance rating.

Satisfactory Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Offeror has at least one or more “somewhat relevant” past performance ratings.

Neutral No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Unsatisfactory Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the effort.

3. Price fairness, reasonableness, and balance. Price will be evaluated using techniques established in FAR 15.404-1 to ensure the Government receives a fair, reasonable, and balanced price. The techniques and procedures described under

FAR 15.404-1(b) and FAR 15.404-1(g) will be the primary means of accomplishing the price analysis, including reasonableness. In instances where an offeror receives an acceptable technical rating and at least a neutral confidence past performance rating, yet proposed prices appear unrealistically low or unreasonable, offerors may be requested to address this disparity, providing evidence of their capability and/or experience providing similar service(s) at similar price(s). An exceptionally or unrealistically low or unreasonable offer may pose an unacceptable risk to the Government and may be a reason to reject an offeror’s proposal without further communication with the offeror.

D. A site visit for this requirement will be held on 04 January 2023, 1:00 PM EST.

Potential offerors will have an opportunity to formally submit questions, via email, up to 4:00 PM EST, 09 January 2023. The Contracting Officer will post answers to all questions received by the deadline to sam.gov no later than 11 January 2023.

All proposals are due by the solicitation close date of 4:00 PM EST, 13 January

2023.

E. For the site visit, all personnel requesting access to Joint Base Anacostia-Bolling must possess a valid State or Government picture identification card.

Furthermore, individuals presenting identification cards from a state that is non-compliant with the REAL ID Act will require additional documentation to gain unescorted base access. Additional documentation include a valid U.S. or foreign government issued passport, an employment authorization document that contains a photograph, or identification cards issued by federal state or local government agencies that include a photo and biographic information. A full list of REAL ID Act compliant and non- complaint states can be found at https://www.dhs.gov/current-status-states-territories. Personnel requesting vehicle access to Joint Base Anacostia-Bolling must provide a valid driver's license, current vehicle registration, and valid vehicle insurance.

F. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. If an offer does not comply with every requirement, that offer will not be technically acceptable, and therefore will not be considered.

Offers received after this date and time will be considered as late submissions in accordance with FAR

52.212-1(f) and will not be evaluated or considered. Please refer any questions to

A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer’s specified expiration time, the Government may accept an offer

(or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

H. By offer submission in response to this synopsis/solicitation, the offeror agrees to comply with all terms and conditions IAW FAR 52.212-4 – Contract Terms and Conditions – Commercial Items.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes.

The ombudsman may refer the interested party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(a) In performing work under this contract on a Government installation, the contractor shall: (1) Take all reasonable steps and precautions to prevent accidents and preserve the health and safety of contractor and Government personnel performing or in any way coming in contact with the performance of this contract; and (2) Take such additional immediate precautions as the contracting officer may reasonably require for health and safety purposes.

(b) The contracting officer may, by written order, direct Air Force Occupational

Safety and Health (AFOSH) Standards and/or health/safety standards as may be required in the performance of this contract and any adjustments resulting from such direction will be in accordance with the Changes clause of this contract.

(c) Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds

5352.242-9000 Contractor Access to Air Force Installations Oct 2019

(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.

(b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing.

When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver s license, current vehicle registration, valid vehicle insurance certificate, and <> to obtain a vehicle pass.

(c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site.

(d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with <> citing the appropriate paragraphs as applicable.

(e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.

(f) Failure to comply with these requirements may result in withholding of final payment.
