B. GENERAL INFORMATION

1. This is a combined synopsis/solicitation for commercial item prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.

2. This solicitation is issued as a Request for Quotation (RFQ).

3. This acquisition is set-aside 100% for Small Business Competition. The North American Industry Classification System Code (NAICS) is 562910- Environmental Remediation Services, with a size standard of 1,000 employees. PSC Code R499- Support – Professional: Other.

C. REQUIREMENT INFORMATION

1. Description of requirement: See Attachment 1 Performance Work Statement “PWS Range Cleaning” dated 21 August 2024.

2. Schedule of Services:

a. The Schedule of Services is identified in Appendix A.

b. Acceptance/ FOB Point for all CLINS is: DESTINATION

c. New Mexico Gross Receipts Tax (NMGRT) may be applicable to the proposed effort.

FAR 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services Addendum

a) The contract provision pertinent to this section is FAR 52.212-1 which has been incorporated by reference.

b) Submission of Quotes. Quotes shall be submitted no later than 12:00 PM Mountain Daylight Time, 17 September 2024 via email to the Contracting Officer, Ms. Stacey Lee, stacey.lee.2@us.af.mil and the Contract Specialist, Ms. Lauren Hook, lauren.hook@us.af.mil. All quotes submitted after the deadline will be considered untimely and ineligible for award.

c) Quotes shall be submitted via email with the subject line of ‘FA9401-24-Q-0026 CATM Range Cleaning Submission’ to the Contract Specialist and Contracting Officer identified in Section (b), Submission of Quotes. Electronic documents shall be submitted in .pdf, .doc, or .xls and less than 30MB. Communication containing documents in any other format may be blocked or stripped by the Government’s server and may not be received by this office. Files in .zip format may not be received by this office.

d) All questions regarding this RFQ must be emailed to the Contracting Officer and Contract Specialist by 12:00 PM Mountain Daylight Time on Wednesday, 4 September 2024. The subject line of the email should be “FA9401-24-Q-0026 CATM Range Cleaning Questions.”

e) To assure timely and equitable evaluation of quotes, vendor must follow the instructions contained herein. The quote shall be clear, concise and include sufficient detail for effective evaluation. Responses to this solicitation shall strictly adhere to the requirements set forth in the solicitation and the corresponding Performance Work Statement. The quotes shall not contain any extraneous information such as advertisements, or marketing information. Vendors must clearly identify any exception(s) taken to the solicitation terms and conditions, and provide complete accompanying rationale. Submissions that do not adhere to format and content requirements may be considered non-compliant. The Government reserves the right to eliminate any such quotes from consideration for award.

f) Quotation Preparation Instructions: Provide one (1) electronic quotation that includes the following:

1. Administrative: The vendor shall submit a cover letter that provides all elements of FAR 52.212-1(b). The cover letter shall not exceed two (2) pages.

2. Factor 1: Technical - The Vendor shall submit a technical plan demonstrating their approach and understanding of the CATM Range Cleaning Requirement as described in “2024.08.21_PWS Range Cleaning” dated 21 August 2024. The technical plan shall not exceed 6 pages.

3. Factor 2: Price - The Vendor must complete and return Appendix A as part of their quote. All dollar amounts should be rounded to the nearest dollar. The vendors Total Evaluated Price (TEP), for award purposes, will be based upon the total price proposed for each Contract Line-Item Number (CLIN) including all options as calculated from Appendix A.

a. Information beyond that required by this instruction shall not be submitted, unless the vendor considers it essential to support its price position.

b. Kirtland AFB is located in the state of New Mexico. Please ensure you consult the New Mexico Taxation and Revenue regulations to determine if New Mexico Gross Receipts Tax (NMGRT) is applicable. Taxes, fees, and surcharges are to be included in the firm-fixed price amount quoted on the CLIN schedule and are not subject to adjustment.

4. The Government reserves the right to use information obtained from other sources available to the Government, including, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), the Federal Awardee Performance and Integrity Information System (FAPIIS), or other databases; and sources available both inside and outside the Federal Government to verify contractor responsibility.

5. All companies must be registered in the System for Award Management at https://www.sam.gov/portal/public/SAM to be considered for award.

52.212-2 Evaluation—Commercial Products and Commercial Services. (Nov 2021)

(a) The Government’s intent is to award a contract resulting from this solicitation to the responsible Vendor whose proposal represents the best value in accordance with the factors of this solicitation.

(1) Basis for Award. Pursuant to FAR 12.602, contract award will be made using Simplified Acquisition Procedures, in accordance with FAR 13.106-3. The Government will select the quote with the Lowest Price Technically Acceptable, Award will be made to the Vendor who: is deemed responsible IAW FAR 9.1, as supplemented, is rated “Acceptable” in Factor 1 Technical; has the lowest evaluated price IAW Factor 2 Price; and whose quote conforms to the solicitation requirements (to include all stated terms, conditions, representations, certifications, and all other information required by this solicitation).

(2) Evaluation Process: Each RFQ response will first be reviewed for compliance with the requirements of this solicitation. Vendor is required to address all solicitation requirements, such as terms and conditions, representations and certifications, and PWS requirements. The Government may reject any RFQ submission that fails to adequately address a significant portion of the requirement or contract terms and conditions.

Vendors will be placed in order from lowest price to highest price. Next, the two (2) lowest priced proposals (lowest two proposals in terms of total evaluated price) will be evaluated for technical acceptability. If these Vendors’ submissions are technically acceptable, the lowest priced quote will be considered the best value to the Government. If one or both is found to be technically unacceptable, the next lowest-priced quote(s) will be put forward for evaluation of technical acceptability. This process will continue, proceeding down the quotes one by one, until a quote is evaluated as technically acceptable and having a fair and reasonable price.

(3) The following factors shall be used to evaluate offers:

1. Factor 1: Technical - The Vendor shall submit a technical plan demonstrating their approach and understanding of the CATM Range Cleaning Requirement https://www.sam.gov/portal/public/SAM as described in “2024.08.21_PWS Range Cleaning” dated 21 August 2024.

The technical plan shall not exceed 6 pages.

a. The Vendor’s technical approach must be determined to be acceptable in accordance with the instructions of this RFQ and the requirements of the PWS. Technical Approach will be evaluated on an ACCEPTABLE/UNACCEPTABLE basis. These terms are defined as follows:

Adjectival Rating Description

Acceptable Based on the vendor’s technical approach, the Government has a reasonable expectation that the Vendor will be able to successfully perform the required effort.

Unacceptable Based on the vendor’s technical approach, the Government does not have a reasonable expectation that the Vendor will be able to successfully perform the required effort.

2. Factor 2: Price - Price will be evaluated for fair and reasonableness in accordance with FAR 13.106-3. The purchase order resulting from this solicitation will include FAR 52.217-8 “Option to Extend the Term of the Contract”. A six-month extension period under this clause will only be utilized if necessary. IAW 52.217-8, the extension pricing will be based on the pricing on contract if utilized. As such, the six-month extension is calculated by dividing the total proposed price of Option Year (OY) IV in half. The Total Evaluated Price (TEP) will be calculated by the Government by adding the proposed pricing for the base year, OYIV, and the six-month extension calculation described above. TEP will be used for evaluation purposes only.

Evaluation of extension pricing shall not obligate the Government to exercise the extension. The six-month extension period is not to be considered part of the base year period of performance and will be a separate option exercise if it is utilized.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) Contractor Responsibility. In order to receive award, the selected vendor must be determined to be responsible in accordance with FAR 9.104.

(d) Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the vendors that may address any aspect of the quote and may or may not be documented in real time. The Government intends to make award based on the initial quote submissions without conducting interchanges. Therefore, each quote should contain the vendor’s best terms from a price and technical standpoint. However, the Government reserves the right to hold interchanges using Interchange Notices (INs) if, during the evaluation, it is determined to be in the best interest of the Government. The Government may conduct Interchanges with one, some, none, or all vendors at its discretion. If INs are used, vendor responses to INs will be considered in making the best value decision. Interchanges may be written or verbal.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
