Combined Synopsis / Solicitation

Solicitation Number: 1605C3-20-R-00002

Survey and Data Analytic Support Services

Department of Labor (DOL) Office of Wage and Hour Division (WHD)

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

proposals are being requested and a written solicitation will not be issued.

The combined synopsis/solicitation information is as follows:

(1.) Solicitation Number: 1605C3-20-R-00002

This solicitation is issued as a Request for Proposal (RFP).

(2.) The solicitation and incorporated provisions and clauses are those in effect through Federal

Acquisition Circular 2020-06 June 05, 2020.

(3.) The requirement shall be posted under the North American Industry Classification System

(NAICS) Code of 511120—Periodical Publishers. The Small Business Size Standard for NAICS

Code 511120 is 1,000 employees.

The requirement for Survey and Data Analytic Support Services shall be competed utilizing

“Full and Open Competition”.

(4.) Required Services:

CLIN 0001 – Project Life Cycle Database (PLC) – 12 Months

Subscription that allows the Government or the Government’s Agent to access Dodge Reports and to retrieve an unlimited number of Dodge Reports.

Option Year 1: July 24, 2021 through July 23, 2022

CLIN 1001 – Project Life Cycle Database (PLC) – 12 Months

Option Year 2: July 24, 2022 through July 23, 2023

CLIN 2001 – Project Life Cycle Database (PLC) – 12 Months

Option Year 3: July 24, 2023 through July 23, 2024

(5.) Description of requirements for the items to be acquired— Survey and Data Analytic

Support services. For additional information, please refer to the attached Performance Work

Statement (PWS).

(6.) Date(s) and place(s) of delivery—

The anticipated Period of Performance shall be for one (1) twelve (12) month Base Year and four

(4) 12-month Option Years. The anticipated Period of Performance is as follows:

Base Year: July 24, 2020 through July 23, 2021

Option Year 1: July 24, 2021 through July 23, 2022

Option Year 2: July 24, 2022 through July 23, 2023

Option Year 3: July 24, 2023 through July 23, 2024

Option Year 4: July 24, 2024 through July 23, 2025

The Government anticipates that work shall be completed off-site at the Contractor’s facility.

(7.) The provision at FAR 52.212-1, Instructions to Offerors—Commercial, applies to this acquisition. The Addenda to FAR 52.212-1 is as follows:

1. INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS - GENERAL

INSTRUCTIONS TO OFFERORS

PROPOSAL SUBMISSION: The Offeror’s Proposal shall be submitted as set forth below. The

Offeror’s Proposal shall consist of three (3) separate volumes. The Volumes are:

I – Technical

II – Past Performance

III – Price

All files shall not contain classified data. The intention of this standardized format is not to limit creativity. Creativity is permitted within the parameters below to allow the Government a more fair and easy assessment of Proposals.

The Order will be awarded using the rules, policies, procedures, and standards of FAR Part 12.

All rules, policies, procedures, and standards of FAR Part 15 are expressly not applicable to this acquisition, but some specific FAR Part 15 procedures may, at the Government's discretion, be used in the evaluation process.

Questions must be submitted no later than June 24, 2020 at 11:00 AM EST.

Offerors are instructed to use Attachment 2 (Offeror Questions Template) when submitting questions or comments.

Responses to questions submitted, as appropriate, will be responded to via an amendment to the solicitation only, which shall be distributed to the Offeror.

Format: The submission shall be clearly indexed and logically assembled. Each volume shall be appropriately numbered and clearly identified with the date and solicitation number in the

“Header” and / or “Footer”, and shall begin at the top of each page. A Table of Contents should be created using the Table of Contents feature in MS Word.

The following additional restrictions apply: Each paragraph shall be separated by at least one (1) blank line. A standard 12-point minimum font size applies. New Times Roman fonts are required. Tables and illustrations may use a reduced font size not less than 8-point.

ONLY ELECTRONIC COPIES OF PROPOSALS WILL BE ACCEPTED.

Content Requirements. All information shall be confined to the appropriate volume. The

Offeror shall confine submissions to essential matters, sufficient to define the Proposal details, in a concise manner, to permit a complete and accurate evaluation of each Proposal. Each volume of the Proposal shall consist of a Table of Contents, Summary Section and the Narrative discussion. The Summary Section shall contain a brief abstract of the volume. Proprietary information shall be clearly marked. The following shall be included in the Narrative discussion:

i. Volume 1 – Technical Approach

The Offeror shall provide a proposal that clearly demonstrates its understanding of the specific requirements, the overall scope of work required, and the Vendor’s technical capability to comply with all requirements contained in the Performance Work Statement (PWS).

ii. Volume 2 – Past Performance

NOTE: The submission of Past Performance Questionnaires is not required.

The Offeror shall submit a total of three (3) contract references which are recent and relevant. A recent contract is one which is currently being performed, or which was performed, for a minimum of twelve (12) months within the last three (3) years from the date of issuance of this solicitation. Relevant contracts are defined as efforts that are the same as, or similar to, the scope of the efforts required by this solicitation.

Only three (3) contract references are required. If more than three (3) contract references are submitted, they will be evaluated at the discretion of the Government.

Offerors are advised that the Government may use past performance information obtained from centralized past performance databases and sources other than those identified by the Offeror and the information obtained may be used for both the responsibility determination and the best value decision.

Offerors without relevant past performance experience, or for whom information on past performance is not available, shall not be evaluated favorably or unfavorably on past performance.

Contracts listed may include those entered into with Government agencies or private sectors. For contractors with no relevant corporate past performance, the Government may take into account information regarding the past performance of predecessor companies, key personnel with relevant past performance, or Subcontractors that will perform key aspects of the requirement.

This volume shall be organized into the following sections:

(1) Section 1 – Contract Descriptions. This section shall include the following information in the following format:

(a) Contractor/Subcontractor place of performance, CAGE Code and DUNS Number. If the work was performed as a subcontractor, also provide the name of the prime contractor and Point of

Contact (POC) within the prime contractor organization (name, and current address, e-mail address, and telephone and fax numbers).

(b) Government contracting activity, and current address, Procuring Contracting Officer's name, e-mail address, telephone and fax numbers.

(c) Government’s technical representative/COR, and current e-mail address, telephone and fax numbers.

(d) Government contract administration activity and the Administrative Contracting Officer's name, and current e-mail address, telephone and fax numbers.

(e) Government contract administration activity's Pre-Award Monitor's name, and current e-mail address, telephone and fax numbers.

(f) Contract Number and, in the case of Indefinite Delivery type contracts, GSA contracts, and

Blanket Purchase Agreements, include Delivery Order Numbers also.

(g) Contract Type (specific type such as Firm Fixed Price (FFP), Time & Materials (T&M), etc.) In the case of Indefinite Delivery contracts, indicate specific type (Requirements, Definite

Quantity, and Indefinite Quantity) and secondary contract type (FP, CR, T&M, etc.)).

(h) Awarded price.

(i) Final or projected final price.

(j) Original delivery schedule, including dates of start and completion of work.

(k) Final or projected final delivery schedule, including dates of start and completion of work.

(2) Section 2 - Performance. Offerors shall provide a specific narrative explanation of each contract listed in Section 1 describing the objectives achieved and detailing how the effort is relevant to the requirements of this solicitation.

(a) For any contracts that did not/do not meet original schedule or technical performance requirements, provide a brief explanation of the reason(s) for the shortcomings and any corrective action(s) taken to avoid recurrence. The Offerors shall list each time the delivery schedule was revised and provide an explanation of why the revision was necessary. All

Requests for Deviation and Requests for Waiver shall be addressed with respect to causes and corrective actions. The Offerors shall also provide a copy of any Cure Notices or Show Cause

Letters received on each contract listed and a description of any corrective action implemented by the Offeror or proposed subcontractor. The Offerors shall indicate if any of the contracts listed were terminated and the type and reasons for the termination.

(3) Section 3 – New Corporate Entities. New corporate entities may submit data on prior contracts involving its officers and employees. However, in addition to the other requirements in this section, the Offeror shall discuss in detail the role performed by such officers and employees in the prior contracts cited. Information should be included in the files described in the sections above.

iii. Volume 3 – Price Proposal

The government is requesting a pricing quote from Offerors. Offerors are encouraged to provide reasonable, but competitive prices and submit pricing structures in accordance with Pricing

Worksheet (Attachment 3) and the PWS.

The Government will evaluate offers for award purposes by adding the total of all CLIN prices, including all options to ensure pricing is not unbalanced. Price will be evaluated for completeness and reasonableness using the techniques in the FAR. Price will become significantly more important as technical ratings approach equality.

In order to provide guidance and maintain consistency, Offerors may use the attached Pricing

Worksheet (Attachment 3) provided with the Solicitation to create the Price Proposal.

The Pricing Worksheet (Attachment 3) includes the option periods.

Therefore, Offerors are only required to enter proposed pricing in the Pricing Worksheet, which automatically calculates the total price for the Base Year, each Option Year, and the Grand Total for the requirement.

Offerors are responsible for proposing the appropriate hours, labor mix, and costs to perform the requirement. The data contained in the Pricing Worksheet is provided for informational purposes only.

(8.) The evaluation procedures to be used are as follows:

BASIS FOR AWARD

The Government will award a single contract from this solicitation to the responsible Offeror whose offer conforming to the solicitation is most advantageous to the Government based on the best overall quotation that is determined to be the most beneficial to the Government, with appropriate consideration given to the following three (3) evaluation Factors:

Factor I - Technical Approach

Factor II – Past Performance

Factor III – Price

The relative order of importance of factors is as follows:

a) The Technical Approach Factor is significantly more important than the Past

Performance Factor.

b) The Past Performance Factor is More Important than the Price Factor.

c) All non-Price evaluation factors, when combined, are Significantly More Important than the Price Factor.

The Contracting Officer shall also conduct a price reasonableness evaluation in accordance with the FAR. The non-Price factors combined are significantly more important than Factor III, Price. However, price will become more important as non-price factors approach equality.

Offerors are cautioned that the award may not necessarily be made to the lowest price offered.

The Government is more concerned with obtaining superior technical features than with making an award at the lowest overall price to the Government.

However, the Government will not make an award at a significantly higher overall price to the

Government to achieve slightly superior technical features. The Government intends to evaluate offers and award an Order without discussions with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting

Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in Proposals received.

FACTORS TO BE EVALUATED.

The following factors shall be used to evaluate Proposals:

FACTOR I – Technical Approach

The Government will evaluate the Offeror's technical approach on its quality and appropriateness in accomplishing the tasks and deliverables of this contract from a technical perspective. The

Government will also evaluate the Offerors on the clarity of their approach and their ability to convey to the Government their understanding of and ability to perform the requirements of this

Performance Work Statement (PWS).

FACTOR II - Past Performance

The offer will be evaluated on the scope and responsibilities of the Offeror in engagements relevant to the requirements of this contract.

Offerors without relevant Past Performance experience, or for whom information on Past

Performance is not available, shall not be evaluated favorably or unfavorably on Past

Performance.

Offerors are advised that the Government may use past performance information obtained from centralized past performance databases and sources other than those identified by the Offeror and the information obtained may be used for both the responsibility determination and the best value decision.

Offerors will be evaluated on the extent and quality of their own corporate Past Performance

(including that of established affiliates, subsidiaries, units or divisions of the Offeror’s own company or parent company that are being proposed to support this effort).

As such, the Offeror’s own corporate Past Performance (as a Prime Contractor) will be weighed significantly more heavily than the Offeror’s experience as a Subcontractor.

FACTOR III – Price

The Offeror’s Price Proposal will be evaluated for award purposes in the following manner:

The Pricing Worksheet (Attachment 3), once completed by the Offeror, will calculate the total proposed price for the Offeror. The total proposed price will be used as the basis of comparison for trade-off purposes. The total proposed price will consist of the proposed prices for the Base

Year and all Option Years.

The Government will not rate or score price but will evaluate each Offeror’s Price Proposal for fairness and reasonableness. The Government will evaluate the reasonableness of the proposed price by assessing whether the proposed price elements are reasonable for the work to be performed; reflect a clear understanding of the requirements; and are consistent with the unique methods of performance and materials (if applicable) described in the Offeror’s technical approach.

The Offeror’s Price Proposal will be evaluated using one or more of the techniques defined in the

Federal Acquisition Regulation (FAR) in order to determine fairness and reasonableness.

Evaluation of Options – The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Unbalanced Pricing – Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable

Proposal, the price of one or more items is significantly over or understated as indicated by the application of price analysis techniques. The Government will analyze offers to determine whether they are unbalanced with respect to separately priced items. Offers that are determined to be unbalanced may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

No adjectival ratings will be used to evaluate Price.

(9.) All Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror

Representations and Certifications—Commercial Items, with its offer.

(10.) FAR Clause 52.212-4, Contract Terms and Conditions—Commercial Items, shall apply to this acquisition by reference—no addenda shall be attached.

(11.) FAR Clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or

Executive Orders—Commercial Items, shall apply to this acquisition. Specifically, the following

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
