Performance Work Statement (PWS)
Template
For
(Wage and Hour Division/Construction Potentials)
PART 1
GENERAL INFORMATION
1.1 Description of Services/Introduction: DOL’s Wage and Hour Division directs and coordinates the determination of prevailing wage rates under the Davis-Bacon and related Acts and the
Service Contract Act. The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform the subscription services as defined in this Performance Work Statement, except as Specified in section C-3 as government furnished property and services at contractor’s facility. The contractor shall perform to the standards in this contract.
1.2 Background:
The DOL's Wage and Hour Division (the Division) directs and coordinates the determination of prevailing wage rates under the Davis-Bacon and related Acts and the Service Contract
Act. This mandate involves a nationwide program of data collection, analysis, and research related to wage determination activities. Through its National and Regional Office network, and various contracts with agencies such as the Bureau of Labor Statistics and the U. S.
Census Bureau, the Division develops data on prevailing wage rates for occupations in the construction and service industries for local areas across the country. In addition, the Division is responsible for administering some of the Nation's most comprehensive labor laws, including the minimum wage, overtime, and child labor provisions of the Fair Labor
Standards Act; the Family and Medical Leave Act; the Migrant and Seasonal Agricultural
Worker Protection Act; and worker protections provided in several Temporary visa programs.
1.3 Objectives:
The objective of this contract is to provide vital private and public construction data to the
Department of Labor’s Wage and Hour Division that are required to enable completion of essential tasks that involves administering the wage determination construction program.
1.4 Scope:
The Contractor shall furnish data on construction projects located in the continental United States, including Alaska, Washington DC, and its five inhabited territories (American Samoa, Guam, Northern Mariana islands, Puerto Rico, and U.S. Virgin Islands) which would satisfy the
Government’s demand for information to conduct Davis-Bacon Wage Determination Surveys, sample surveys, conformance surveys and Ad-Hoc agency initiative reporting.
1.5 Period of Performance:
The period of performance shall be for one (1) Base Period of 12 months and four (4) 12-month option periods. The Period of Performance reads as follows:
Base Period 07/24/2020 – 07/23/2021
Option Period I 07/24/2021 – 07/23/2022
Option Period II 07/24/2022 – 07/23/2023
Option Period III 07/24/2023 – 07/23/2024
Option Period IV 07/24/2024 – 07/23/2025
The Government reserves the right to extend the term of this contract at the prices set forth in Section B in accordance with the terms and conditions contained in clause 52.217-9 entitled, “Option to Extend the
Term of the Contract”. The work/services shall be performed at the contractors’ place of business.
1.6 General Information
1.6.1 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.2 Government Remedies: The contracting officer shall follow FAR 52.212-4, “Contract Terms and Conditions-Commercial Items” or 52.246-4, “Inspection of Services-Fixed Price” for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.
1.6.3 Recognized Holidays: The contractor is not required to perform services on these Holidays:

President’s Day Veteran’s Day
Memorial Day Thanksgiving Day
Independence Day Christmas Day
1.6.4 Hours of Operation/Place of Performance: The contractor is responsible for conducting business between the hours of 8am to 5pm, Monday thru Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this
Performance Work Statement, when the Government facility is not closed for the above reasons.
When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential. Telecommuting or “work at home” is not authorized under this contract.
1.6.5 Type of Contract: The government anticipates award of a firm fixed price contract.
1.6.7 Security Requirements: (N/A)
1.6.7.1 PHYSICAL Security. The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured. (N/A)
1.6.7.2 Key Control. (N/A) The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer.
1.6.8 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.9 Contracting Officer Representative (COR): A COR will be delegated under separate cover.
1.6.10 Contract Manager: The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer.
The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.
1.6.11 Identification of Contractor Employees: All contract personnel attending meetings, answering
Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. (No contractor personnel will be required to obtain and wear badges in the performance of this service)

DEFINITIONS & ACRONYMS
PWS. Performance Work Statement
Contracting Officer’s Representative (COR). A representative from the requiring activity assigned by the
Contracting Officer to perform surveillance and to act as liaison to the contractor
Defective Service. A service output that does not meet the standard of performance associated with it in the Performance Work Statement.
DOL. Department of Labor
Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
Quality Control. Those actions taken by a contractor to control the performance of services so that they meet the requirements of the PWS.
Quality Assurance. Those actions taken by the government to assure services meet the requirements of the Performance Work Statement.
PART 3
GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3.1 GENERAL: The government shall provide, the facilities, equipment, materials, and/or services listed below. (N/A)

3.5 Facilities: (N/A) – Work will be performed at the Contractor’s facility.
PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4.1 General: Except for those items specifically stated to be government furnished in Part 3, the contractor shall furnish everything required to perform this PWS.
4.2 Clearance: The Contractor shall possess or be eligible to receive and maintain a [insert clearance level] clearance. The Contractor’s employees, performing work in support of this contract shall have been granted a [insert clearance level] security clearance. (N/A)
PART 5
SPECIFIC TASKS
The Contractor shall deliver the data described in the Performance Work Statement, electronically to the
Government’s agent.
5.1 BASIC SERVICES. The contractor shall provide the following services:
Furnish the U.S. Department of Labor with data on construction activity located in all 50 States, Washington D.C., and its five (5) inhabited territories (American Samoa, Guam, Northern Marina islands, Puerto Rico, and U.S. Virgin Islands)
The contractor, must be able to provide three types/sets of data:
1. A monthly file on the extent of all construction activity.
2. A quarterly file on the extent of all construction activity.
3. Periodic data on construction activity within a specific geography.
5.1.1 Monthly Data on Construction Activity
The contractor shall report monthly construction activity for all fifty (50) states, Washington
D.C., and it’s five (5) inhabited territories (American Samoa, Guam, Northern Marina Islands, Puerto Rico, and U.S. Virgin Islands). This includes:
Both privately and publicly funded projects.
New construction, additions, alterations, and renovations.
Residential, building, heavy, and highway construction, as defined by the Davis-Bacon manual of operations.
Ongoing construction activity or activity expected to begin within a reasonable timeframe (e.g., 90 days).
Specific geographic areas that show a significant portion of active construction projects in the
U.S.
Specific data fields should include:
Project ID
Project description (including location)
State and county FIPS codes
Start date (year and month)
Structure type (e.g., single family home, apartment building, water treatment plant)
Whether new construction or an addition/renovation
Ownership (federal, state, local government, private)
Framing type (e.g., load or wall bearing, steel, wood, concrete, pre-fabricated or pre-engineered)
Number of stories (where applicable)
Number of dwelling units (where applicable)
Square footage (where applicable)
Value
The structure type must be adequately detailed to entail mapping to the four Davis-Bacon construction types: residential, building, heavy and highway. Additionally, details must be available to identify multiple construction type projects. Data which are not required, but which the Dept. of Labor seeks, includes the anticipated construction end date.
5.1.2 Quarterly data on residential permit construction activity
The contractor will provide counts of residential permit projects, identified from permitting offices, at least quarterly. These data sets do not need to present all permitting offices throughout the United States, but do need to include a substantial percent of counties. These counties will be tabulated by county and permit start month.
5.1.3 Periodic data on construction activity within a specific geography
The contractor will provide detailed information on specific projects identified from the monthly file and the quarterly permit file, as requested by the Government and/or ERG (the Government’s agent). The data will be delivered within the timeframe specified by the requestor, usually 2 to 4 weeks. The
Contractor shall validate the data within the order to ensure data accuracy. The data will be delivered in both a spreadsheet format (e.g., comma, tab, or pipe-delimited) and a text format (e.g., Word, RTF). In addition to the fields identified in the monthly file, the data provided will also include:
Project address, city, state, and zip code (where applicable).
Project status
Award ID (where applicable).
General contractor’s and their address and phone number.
Owner and its address and phone number.
Architect and its address and phone number.
Low bidders and their address and phone number.
Number of buildings (where applicable).
5.1.4 Data which are not required, but which Dept. of Labor seeks include:
Anticipated construction end date.
Subcontractors and their address and phone number.
Contract email addresses.
5.1.5 Electronic Database
The Contractor shall provide the Government with an online database through which the most current information is made available.

Performance Requirements Summary
The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

Types of Surveillance to select from:
Random Sampling: Appropriate for frequently recurring tasks. Evaluate randomly selected samples of the lot to determine the acceptability of the entire lot.

100 Percent Inspection: Appropriate for tasks that occur infrequently. Inspect and evaluate performance each time task is performed
Periodic Surveillance: Evaluation of samples selected on other than 100% or statistically random basis.
