COMBINED SYNOPSIS/SOLICITATION

SUBJECT: Request for Quote (RFQ) FA910122QB056, Miller ProHeat 35

This is a combined synopsis/solicitation for commercial products prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested.

The solicitation document and incorporated provisions and clauses are those in effect through Federal

Acquisition Circular, FAC 2022-07 dated 10 August 2022, Department of Defense Federal Acquisition

Regulation (DFARS) Change 6/23/2022 effective 23 June 2022, and Air Force Federal Acquisition

Regulation (AFFARS) Change 7/1/2022 effective 01 July 2022.

– Technical Acceptability – Miller ProHeat 35. Attachment 2 details how technical acceptability will be determined. The provisions in Attachment 3 will be removed from the final award.

As prescribed in FAR 12.301(c), the Contracting Officer may insert a provision substantially as follows:

FAR 52.212-2, Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government intends on awarding a contract without interchanges. The Government reserves the right to enter into interchanges with all, some, or none of the offerors if it is in the best interest of the

Government. The intended award resulting from this solicitation will be to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered utilizing the Lowest Price Technically Acceptable (LPTA) evaluation method. The following factors shall be used to evaluate complete offers: price, technical acceptability (pass/fail basis in accordance with in Attachment 1 – Miller ProHeat 35 Specification). The Government has provided the technical acceptability form that may be used for convenience (Attachment 2 - Technical Acceptability -

Miller ProHeat 35).

A complete offer:

1. The offeror(s) shall price each CLIN (unit price and extended price) and the total price in United States

Dollars (USD).

2. The offeror(s) shall provide the delivery timeframe.

3. The offeror(s) shall provide a valid quote for at least 30 days.

4. The offeror(s) shall provide their Unique Entity ID (UEI).

5. The offeror(s) shall provide all technical requirement specifications to make a technical acceptability determination.

The Government will evaluate quotes on a lowest price technically acceptable (LPTA) basis. First, The

Contracting Officer shall validate complete quotes, if items are missing then the quote will be considered incomplete and may not be evaluated further. Then the quote(s) will be evaluated for technical acceptability in order of lowest total price to highest total price. Once a quote has been determined to be technically acceptable, then the Government may stop evaluating other offeror(s). Next, the Government shall evaluate total pricing utilizing FAR 13.106-3 procedures to determine price fair and reasonable. This evaluation process will be repeated until reaching a technically acceptable quote, or until all quotes are evaluated. In order to determine price fair and reasonable, the evaluation process may continue until reaching two technically acceptable quotes (to establish adequate price competition).

Applicable definitions are outlined below:

Completeness - The Offeror’s price will be reviewed to determine the extent to which all the price elements have been addressed. The Offeror’s price quote will be evaluated to ensure continuity and traceability of prices to the technical quote and between the initial quote and any revisions. The review will determine the adequacy of the contractor’s quote in addressing and fulfilling the RFQ requirements.

Reasonableness - For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices fair and reasonable through the use of one or more of the price analysis techniques at FAR 13.106-3(a).

Unbalanced pricing - Contractors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items or sub-line items. An

offer that is determined to be unbalanced may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
