Solicitation Number 19GE5020Q0021
The Regional Procurement Support Office Frankfurt hereby provides the following Combined
Synopsis and Solicitation for:
Supply and Delivery Anti-Riot Shield
U.S. Embassy Beirut
Synopsis:
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; offers are being requested and a written so-licitation will not be issued. The solicitation number is 19GE5020Q0021 and is issued as a Request for Quotes (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2020-04, effective January 15, 2020.
Contract Type:
The Government intends to award a single, firm fixed-price contract to the responsible offeror whose offer is evaluated as the lowest-priced and technically acceptable. The total price shall in-clude all labor, equipment, delivery charges, materials, overhead, profit, insurance, and all other expenses necessary to deliver the required equipment.
No additional sums will be payable on account of any escalations in the cost of materials, equip-ment, or labor, or because of the Contractor’s failure to properly estimate or accurately predict the cost or difficulty of achieving the results required by this contract. Nor will the contract price be adjusted on account of fluctuations in currency exchange rates.
Term of Contract:
This ensuing contract shall be effective from the date of the Contracting Officer’s signature. De-livery of Supplies and Services are required within 90 days of award. Location of delivery is the
US Embassy Beirut.
Brand Name or Equal
The buyer is allowing sellers to submit offers for alternate products as long as the offered specifi-cations meet the stated salient characteristics/specifications. Sellers must state exactly what prod-uct/brand name they are bidding (including make, model, and description) and provide descriptive literature for the offer to be considered. It is the offeror’s responsibility to prove that the offered product meets the specifications.
Compliance with Specifications:
Offerors shall also provide with their offer, at a minimum, existing product literature to substantiate the acceptability of their offered products in accordance with the specifications provided in this docu-ment.
Descriptive Literature Required:
Definition: (a) "Descriptive literature" means information (e.g., cuts, illustrations, drawings and origi-nal manufacturers' brochures) that is submitted as part of an offer. Descriptive literature is required to establish, for the purpose of evaluation and award, details of the product offered that are specified elsewhere in the solicitation and pertain to significant elements such as (1) design; (2) materials; (3) components; (4) performance characteristics; and (5) methods of manufacture, assembly, construction, or operation. The term includes only information required to determine the technical acceptability of the offered product. It does not include other information such as that used in determining the respon-sibility of a prospective contractor or for operating or maintaining equipment. (b) Descriptive literature must be (1) identified to show the item(s) of the offer to which it applies and (2) received by the time specified in this solicitation for receipt of offers. (c) Data displaying more than one model or size shall be clearly marked so as to indicate the specific item being offered. (d) Offers which do not present sufficient information to permit complete technical evaluation by the Government may be rejected. It is the bidder’s responsibility to prove that their proposed solution meets or exceeds the requested spec-ifications, subject to any limitations elsewhere in this solicitation.
Customs Clearance and Delivery
The Contractor shall estimate a reasonable number of days for custom clearances and delivery.
Should the contractor fail to provide any required paperwork for the custom clearance process to the U.S. Embassy Beirut shipping office and the custom clearances procedure is delayed, the con-tractor shall be required to pay any additional costs occurred (storage fees).
Other Specific Requirements:
If applicable, the Contractor shall comply with all import requirements mandated by the
Government of Lebanon. Further, the Contractor shall provide all the necessary documen-tation required at destination for importation of the proposed items.
The Contractor must obtain all necessary export licenses regardless of shipping method.
The end user is the Internal Security Forces of Lebanon. The Contractor must state in its export license request that this is a U.S. government funded contract.
All manuals and literature shall be in the English language.
Basis of Price:
The price of all items shall include their transportation f.o.b. destination to the designated delivery point in Beirut in accordance with FAR 52.247-35.
Warranty:
Warranty for all purchased goods, factory defects only, is 2 years from the date received and ac-cepted at delivery location. The price for warranty shall be included in the price for each item.
Delivery and Acceptance:
Delivery shall be made f.o.b. destination as soon as possible but not later than 90 calendar days
(3 months) from the date of contract award. Partial deliveries are not acceptable.

Coordination:
The Contractor shall coordinate the delivery with the Point of Contact. Upon award POC infor-mation will be provided.
Condition of Delivered Equipment:
The equipment must be new.
Duty-Free Clearance:
Duty-free clearance shall include all imported materials, equipment and personnel, all shipping containers or otherwise, and shall be labeled as follows:
ATTN: Customs & Shipping (P.O. 19GE50-20-P-XXXX) to be completed by the Contractor
Items shall be marked as “Diplomatic Cargo”.
The Contractor shall follow the instructions of the purchase order as to the manner of labeling the shipping containers or otherwise processing shipments of imported materials in order to obtain, or continue to receive, duty free clearance through customs. The Contractor shall be solely responsi-ble without right of reimbursement from the Government, for the payment of customs duties, if any, which:
1. are imposed on items which are not labeled and processed in accordance with the contract instructions,
2. are imposed on the Contractor's tools, construction equipment and machinery imported for use on the project, or
3. are otherwise ineligible for duty-free entry.
Free Entry of Goods:
To obtain a free entry for the goods the contractor shall provide the COR with the following doc-umentation twenty (20) days prior to the arrival of goods:
- Detailed description of goods (including number of crates)
- Approximate weight
- Approximate value of goods
- Mode of shipment
The Contractor shall provide an Advance Notice to the U.S. Embassy shipping office twenty (20) calendar days before any shipment is to be made.
Payment Schedule and Invoice Submission (Fixed-Price)
The Contractor will receive the payment once the good are delivered to the agreed destination and respecting all the conditions listed here in this solicitation, upon confirmation via report from the local authorities.
Once the items are delivered to Beirut port/airport, the Internal Security Forces shall need at least
2 weeks to clear the shipment. After that they are going to be delivered to the final destination so it will be generated a receiving report. The payment will be processed then within 30 days.
Payment shall be made to the contractor’s address as specified on the cover page of this contract, unless a separate remittance address is specified.
(ii) TECHNICAL CAPABILITY
The proposed devices shall meet all of the required technical specifications and the delivery terms contained herein. In addition, the offeror shall provide:
(A) A confirmation that delivery can be provided within 90 days (3 months) of award to final destination.
(B) Warranty provisions as described under Warranty in this solicitation document.
(C) Descriptive Literature

INSTRUCTION TO OFFERORS
Addendum to FAR 52.212-1 Instruction to Offerors – Commercial Items (Oct 2018)
Pursuant to FAR 12.302(d), the provision at FAR 52.212-1, Instruction to Offerors – Commercial
Items (Oct 2018) is augmented as follows: Preparation of Offers – Offerors shall prepare and sub-mit its offer in two (2) volumes as set forth below.
Volume I – Prices
Volume II – Technical proposal
BASIS OF AWARD
The Government intends to award a contract resulting from this solicitation to the responsible offeror (as determined within the meaning of FAR Part 9, paragraph 9.104), whose offer conforms to the solicitation and is determined to be the lowest price technically acceptable offer. Evaluation will be based on FAR 52.212-2, as provided in this solicitation.
ADDITIONAL INFORMATION
Applicable laws and regulations:
Solicitation and award will be subject to laws and regulations of the United States of America.
PREPARATION OF OFFERORS
Offerors shall prepare and submit offers through email only. In addition, offerors shall complete and submit the following:

The offeror shall complete FAR 52.212-3 Representations and Certifications – Commercial Items
(Dec 2019). This provision is accessible via https://www.acquisition.gov/far/.
SUBMISSION OF OFFERS
The complete offer submission shall include:
(1) Price Offer and Representations and Certifications
(2) Technical Capability – Completed Technical Compliance Matrix and descriptive literature

OFFER DUE DATE
Offers shall be submitted as soon as possible but not later than 1600 hrs Central European Sum-mer Time (CEST) on Thursday, May 07, 2020. Late offers will not be considered.
52.212-2 Evaluation – Commercial Items (Oct 2014)
(a) The Government shall award a contract resulting from this solicitation to the responsible offeror whose offer is the lowest priced, technically acceptable. The following factors shall be used to evaluate offerors:
1. Price;
2. Technical capability of the item offered to meet the Government requirement
3. Past performance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the
Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Other Evaluation Requirements:
- An offer MUST be valid for 30 calendar days after submittal.
- Offerors must be registered in the System for Award Management (SAM) database before an award can be made to them. If the offeror is not registered in the SAM, it may do so through the
SAM website at https://www.sam.gov/portal/public/SAM/.
- A completed copy of the “Representations and Certifications-Commercial Items”, as provided under FAR clause reference 52.212-3 must be submitted with the offer.
- A written notice of award or acceptance of an offer mailed or otherwise furnished to the success-ful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.225-17 Evaluation of Foreign Currency Offers (Feb 2000)
If the Government receives offers in more than one currency, the Government will evaluate offers by converting the foreign currency to United States currency using http://www.federalre-serve.gov/releases/h10/current/ in effect as follows:
(a) For acquisitions conducted using sealed bidding procedures, on the date of bid opening.
(b) For acquisitions conducted using negotiation procedures–
(1) On the date specified for receipt of offers, if award is based on initial offers; otherwise
(2) On the date specified for receipt of proposal revisions.
